DISCUSSION: Attached hereto are proposals that were re-drafted from the City of Danville's application process for the Board of Supervisors to approve concerning citizen application for appointed positions. In addition, the Honorable Brenda Bowman has presented the issue of whether or not should be with no pay. This would require the Board of Supervisors to consider establishing ordinances that set up the definitions of pay or no pay, similar to the Board of Supervisors' Chapter 22- Compensation for the Board of Supervisors, of the Pittsylvania County Code. RECOMMENDATION: Staff submits this for the Board of Supervisors for their review and approval. At that time, the Board requested that payment to Regional One be approved on a monthly basis. A total of $70,000 has been appropriated for Regional One in the 2012 Budget, which will cover Regional One's monthly cost for the entire budget year. DISCUSSION: It is time to approve payment for Regional One for the month of June. The amount due to Regional One is $5,833.33 per month. This amount has already been appropriated in the FY2012 budget. RECOMMENDATION: Staff recommends that the Board of Supervisors approve $5,833.33 for payment to Regional One for June 2012. P15 PITTSYLVANIA COUNTY Board of Supervisors EXECUTIVE SUMMARY AGENDA TITLE: Out of State Travel to Cary, NC -Economic Development AGENDA DATE: 5-15-12 ITEM NUMBER: 5(b) SUBJECT/PROPOSAL/REQUEST: Out of State Travel STAFF CONTACT(S): Mr. Sleeper ACTION: No CONSENT AGENDA: ACTION: ATTACHMENTS: No INFORMATION: INFORMATION: BACKGROUND: The Board of Supervisors' Travel Policy requires the Board of Supervisors to approve out of state travel for employees traveling to other states. DISCUSSION: There are two trips that need to be identified in this motion. (1) Out of State Trip to Cary, North Carolina for the Administrative Assistant in Economic Development who will be attending an IBM Conference where there is no subscription charge to the conference. The Administrative Assistance will be driving a County vehicle to the conference. However, the Board of Supervisors will have to provide for accomdations for this out of state travel, estimated at $300.00. (2) The Director of Economic will be taking a trip to Chattanooga, Tennessee in June 2012 for economic development purposes. The estimated cost for this trip is $1200.00. Funds are coming from Economic Development Travel. RECOMMENDATION: Staff recommends the Board of Supervisors approve both of these out of state travel requests in that they are economic development program related in accordance with the Pittsylvania County Travel Policy. DISCUSSION: This expansion project will begin at the Pittsylvania County/Halifax County line and provide a 24-inch gas line from Pittsylvania County to Brunswick County in order to support Dominion Power's new 1,300- megawatt, combined-cycle natural gas-fired power station in Brunswick County. This method would continue for the next 5 years until Pittsylvania County employees pay the entire 5% member contribution. All employees hired by Pittsylvania County after July 1, 2012 will automatically pay the 5% member contribution upon commencement of employment. It is not an option to phase these individuals in. RECOMMENDATION: Staff recommends that the Board approve the attached resolution (Resolution 2012-OS-OS) to elect the member contribution schedule effective July 1, 2012 with the Virginia Retirement System. Such payments shall be credited to the members' contribution account. No county, city, town, or other local employer other than a local public school board shall be allowed to elect to pay any amount of member contributions except to pay the d~erence between five percent and the employee contribution during the phase-in period described in this subdivision for a member who was in service on June 30, 2012. 4. A member who is an employee of a local public school board, regardless of whether the member is a person who becomes a member on or after July 1, 2010, shall be required to pay member contributions on a salary reduction basis in accordance with § 414(h) of the Internal Revenue Code in the amount of frve percent of creditable compensation as follows: (i) any member who commences or recommences employment on or after July 1, 2012, shall be required to contribute five percent of his creditable compensation upon commencing or recommencing employment and (ii) members in service on June 30, 2012, shall be required to contribute five percent of their creditable compensation no later than July 1, 2016. Such member described in subdivision (ii) shall contribute a minimum of an additional one percent of his creditable compensation beginning on each July 1 of 2012, 2013, 2014, 201 S, and 2016, or until the member's contribution equals five percent of creditable compensation, but the local public school board employer may elect to require members to contribute more than an additional one percent each year, in whole percentages. In no case shall a member be required to contribute more than five percent of his creditable compensation for each pay period for which he receives compensation. Publication: Any proposed change in the schedule of the aforementioned rates, fees, and charges by the PCSA shall be published in a newspaper having general circulation in the County in accordance with the requirements set forth in the Code of Virginia, 1950, as amended. SEC. 21-8. ENFORCEMENT OF RATES, CHARGES, AND FEES The owners of all houses, buildings, or properties used for human occupancy, employment, recreation, or other purposes, presently existing or constructed subsequent to the installation of the heretofore described water and sewerage systems and situated within the project areas of the Authority and a butting on any street, alley, right-of--way, public right-of--way, or easement in which there is located a public sanitary sewer and/or water main at a distance not greater than two hundred (200) feet from such houses, buildings, or properties, shall be required to install suitable toilet and other disposable liquid waste facilities therein and to connect such facilities directly with the public sewer and water main. All such connections shall be made in accordance with rules and regulations adopted by the Authority, which may provide for a reasonable charge for making such connections. No public water main or sanitary sewer line or systems shall be constructed along any street in the Service Area until at least fifty-one (51) percent of the property owners fronting the street, road, or highway shall have agreed to or petitioned the PCSA for such water or sewer service. Where such construction is agreed to or petitioned for by the property owners, the feasibility and advisability to construct such water or sewer lines or systems shall be determined by the PCSA. If connection is not made to the systems upon the completion of the particular system, the owner, occupant, or tenant shall have thirty (30) days to connect to the system. In the event the connection is not made at the expiration of such thirty (30) day period, the connection fee is then due and payable to the Authority the same as if the connection had been made. A service charge applicable to the property, as if the connection had been made, shall begin to accrue as of the expiration of such thirty (30) day period and shall be payable to the same as if such connection had been made as of that date. Notwithstanding any other provision of this chapter, those persons having a domestic supply or source of potable water shall not be required to discontinue the use of such water. However, persons not served by a water supply system, as defined by § 15.2-2149 of the Virginia Code, 1950, as amended, producing potable water meeting the standards established by the Virginia Department of Health may be required to pay a connection fee, a front footage fee, and a monthly nonuser service charge, which charge shall not be more than that proportion of the minimum monthly user charge, imposed by the Authority, as debt service bears to the total operating and debt service costs, or any combination of such fees and charges. Notwithstanding any other provision of this chapter, those persons having a private septic system or domestic sewage system meeting applicable standards established by the Virginia Department of Health shall not be required under this chapter to discontinue the use of such system. However, such persons may be required to pay a connection fee, a front footage fee, and a monthly nonuser service charge, which charge shall not be more than that proportion of the P46 minimum monthly user charge, imposed by the Authority, as debt service bears to the total operating and debt service costs, or any combination of such fees and charges. Persons who have obtained exemption from or deferral of taxation pursuant to an ordinance authorized by § 58.1-3210 of Virginia Code, 1950, as amended, may be exempted or deferred by the authority from paying any charges and fees authorized herein, to the same extent as the exemption from or deferral of taxation pursuant to such ordinance. SEC. 21-9. UNLAWFUL AND ILLEGAL USE OF FIRE HYDRANTS AND PENALTY FEES. A. Any person who (i) tampers with any metering device to the facilities owned by the PCSA or as set forth in Section 18.2-162, of the Code of Virginia, 1950, as amended, or otherwise intentionally prevents such a metering device from properly registering the degree, amount, or quantity of service supplied, or (ii) diverts such service, not owned or controlled by any such company, shall be guilt of a Class 1 misdemeanor. B. Any person who willfully and maliciously (i) diverts any public wastewater or sewer line, or (ii) diverts or wastes any public water supply by tampering with any fire hydrant shall be guilty of a Class 2 misdemeanor. C. The court may order restitution for the value of the services unlawfully used and for all costs. Such costs shall be limited to actual expenses, including the base wages of employees acting as witnesses for the County, and suit cost, and the amount shall not exceed $250.00, excluding the value of the service. D. Any person who shall intentionally destroy or damage any facility of the PCSA or as identified in Section 18.2-162 of the Code of Virginia, 1950, as amended, which is used to furnish water service to the public, shall be guilty of a Class 4 felony, provided that in the event the destruction or damage may be remedied or repaired for $200.00 or less, such act shall constitute a Class 3 misdemeanor. No other Authority has been created under the provisions of the Act serving the whole or part of the same area for the same purposes, and none of the powers granted by said Act shall be exercised by the Authority in construction, improvement, maintenance, extension of operation of any project or projects, which in whole or in part, shall duplicate or compete with existing utilities, public or private, serving substantially the same purposes.
