03/06/2012 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING March 6, 2012 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, March 6, 2012, in the General District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Motley called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Arthur, seconded by Mr. Weatherford, and by unanimous vote the February 7, 2012, minutes were approved as presented. CHAIRMAN’S REPORT Mr. Shelton reported that Mr. Coy Harville’s mother passed away on Saturday, March 3, 2012, and he sent a plant to the family on behalf of the Planning Commission. He also stated he would receive a bill at the end of the month and would divide the cost equally among the members. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately 7:02 p.m. Planning Commission March 6, 2012 Page 2 Case 1, William T. Willis, Jr., & Delores B. Willis, R-12-008. Mr. Motley opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that William and Delores Willis had petitioned to rezone 13.11 acres, located on Highway 41/Franklin Turnpike, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use (farming). William Willis was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:03 p.m. A motion was made by Mr. Weatherford, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 2, Guy Frederick Rinker & Janice Gibson Rinker, R-12-009. Mr. Motley opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that Guy and Janice Rinker had petitioned to rezone 1.43 acres, located on Bunker Lane, in the Dan River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for future subdivision of the property for sale of the homes located on the property. Janice Rinker was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:05 p.m. A motion was made by Mr. Welborn, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 3, C-W, Inc., R-12-010. Mr. Motley opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that C-W, Inc., had petitioned to rezone 1.082 acre (part of 1.69 acre), located on Highway 41/Franklin Turnpike, in the Westover Election District from B-2, Business District, General to RMF, Residential Multi-Family District to be combined with GPIN # 2319-59-6307 zoned RMF and to expand for apartments. Phyllis Marshall was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:06 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from B-2, Business District, General to RMF, Residential Multi-Family District. Motion passed unanimously. Case 4, Dorothy Kelly, R-12-011. Mr. Motley opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Dorothy Kelly had petitioned to rezone 1.00 acre, located on State Road 636/Kellys Drive, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjoining parcels of land. Jeffrey Kelly was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:08 p.m. During the discussion, it was stated that everything around the petitioned parcel is zoned A-1, Agricultural District. A motion was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. This concludes the Rezoning Cases. Case S-1, Matthew R. Mitchell, S-12-003. Mr. Motley opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Matthew Mitchell had petitioned for a Special Use Permit on 1.357 acre (part of 21.16 acres), located on State Road 834/Bearskin Road, in the Callands-Gretna Election District for placement of a single-wide mobile home for his personal residence. Matthew Mitchell was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:10 p.m. A motion was made by Ms. Mease, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. This concludes the Special Use Permit case. Planning Commission March 6, 2012 Page 3 OLD BUSINESS There was no old business. NEW BUSINESS Mr. Shelton stated there is no money for training, education or certification in the Pittsylvania County 2012-2013 proposed budget.
