01/05/2012 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING January 5, 2012 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Thursday, January 5, 2012, in the General District Courtroom, Chatham, Virginia. Mr. Shelton, Director of Code Compliance, called the meeting to order at approximately 7:00 p.m. Mr. Motley gave the invocation. Mr. Shelton called the roll. Miller, Jr. Banister District APPOINTMENT OF CHAIRMAN AND VICE CHAIRMAN FOR THE YEAR 2012 – Upon motion of Mr. Motley, seconded by Mr. Harville, and by unanimous vote Mr. Stowe was elected Chairman for the year 2012. By motion of Mr. Weatherford, seconded by Mr. Harville, and by unanimous vote Mr. Motley was elected Vice Chairman for the year 2012. HEARING OF THE CITIZENS No citizens came forward to speak. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Mr. Harville, and by unanimous vote the December 6, 2011, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. Planning Commission January 5, 2012 Page 2 DOLLAR GENERAL SITE DEVELOPMENT PLAN – Mr. Shelton reported on the Dollar General Site Development Plan and stated that Mr. Bryant Gammon has not provided any further information regarding the Erosion and Sediment Control Plan for the site. Mr. Shelton then stated when this information becomes available, he will present it to the Board at the Planning Commission meeting. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:02 p.m. Case 1, Gertrude H. Fifer, R-12-001. Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code Compliance, reported that Gertrude Fifer had petitioned to rezone 3.42 acres, located on State Road 638/Harbor Drive, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District, for placement of a second dwelling, a single-wide mobile home, for her daughter’s residence. Gertrude Fifer and Cynthia Sigler were present to represent the petition. They stated they had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:04 p.m. During the discussion, it was stated that the adjoining farm is zoned A-1, Agricultural District. A motion was made by Mr. Arthur, seconded by Mr. Harville, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 2, Hosea Stone, Jr., R-12-002. Mr. Stowe opened the public hearing at 7:05 p.m. Mr. Shelton, Director of Code Compliance, reported that Hosea Stone, Jr., had petitioned to rezone 0.46 acre, located on State Road 926/Macy Herndon Lane, in the Chatham–Blairs Election District from R-1, Residential Suburban Subdivision District to RC-1, Residential Combined Subdivision District to combine his three (3) parcels of land and resubdivide to create two (2) parcels. Hosea Stone was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:06 p.m. During the discussion, it was stated this will allow the parcels to be the same zoning district and compatible with the surrounding area. A motion was made by Mr. Motley, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to RC-1, Residential Combined Subdivision District. Motion passed unanimously. Case 3, Joan M. Hupp Scruggs, R-12-003 – Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Joan Scruggs had petitioned to rezone 2.06 acres, located on Coleman Estates Road, in the Westover Election District from R-1, Residential Suburban Subdivision District to RC-1, Residential Combined Subdivision District, for placement of a second dwelling, a single-wide mobile home, for her granddaughter’s residence. Stacy Drye, Ms. Scruggs’ granddaughter, was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:08 p.m. During the discussion, it was stated this is consistent with the surrounding area. It was also stated there are lots of mobile homes in the area, which makes it compatible with the surrounding area. A motion was made by Mr. Weatherford, seconded by Mr. Harville, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to RC-1, Residential Combined Subdivision District. Motion passed unanimously. Case 4, Bray’s Retail & Rental, Inc., R-12-004 – Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Bray’s Retail & Rental, Inc., had petitioned to rezone a total of 7.23 acres, more or less, six parcels, located on State Road 1076/Clark Street, on U.S. Highway 58/South Boston Highway, and State Road 734/Clark’s Mill Road in the Dan River Election District from R-1, Residential Suburban Subdivision District and DZ (R-1, Residential Suburban Subdivision District and B-2, Business District, General) to B-2, Business District, General to allow for future business development. Joseph Bray was present to represent the petition. He stated he had nothing to add, except that he has no immediate plans for the properties. Mr. Stowe closed the public hearing at 7:11 p.m. During the discussion, it was stated there are lots of parcels of land zoned B-2 along Highway 58 East, and the area is a mixture of business and residential zoning. A motion was made by Mr. Welborn, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone the properties from R-1, Residential Suburban Subdivision District and DZ (R-1, Residential Suburban Subdivision District and B-2, Business District, General) to B-2, Business District, General. Motion passed unanimously. This concludes the Rezoning Cases. Case S-1, Moncie E. Mease, II, S-12-001. Mr. Stowe opened the public hearing at 7:12 p.m. Mr. Shelton, Director of Code Compliance, reported that Moncie E. Mease, II, had petitioned for a Special Use Permit on 100 x 100 feet (10,000 square feet), part of 144 acres, more or less, located on Route 40/West Gretna Road, in the Callands-Gretna Election District for a 195 foot telecommunications tower, lattice design, with equipment shelter for Verizon Wireless. Attorney Lori Schweller, Agent for Verizon Wireless, was present to represent the petition. She stated that Verizon is licensed for three (3) different technologies and the cell tower will have a total of twelve (12) antennas, four (4) antennas for each technology. She also stated this tower supports all objectives in the Comprehensive Plan. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:14 p.m. During the discussion, it was stated this will benefit the county and will be a plus for the citizens of the county. Ms. Mease then requested that she abstain from voting on this case, due to the fact that she is owner of the petitioned property. A motion was made by Mr. Motley, seconded by Mr. Harville, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. Case S-2, James A. Chalmers & Angela Miller Chalmers, S-12-002. Mr. Stowe opened the public hearing at 7:15 p.m. Mr. Shelton, Director of Code Compliance, reported that James and Angela Chalmers had petitioned for a Special Use Permit on 100 x 100 feet (10,000 square feet), part of 23.03 acres, located off State Road 1431/Neighborhood Road, in the Banister Election District for a 300 foot telecommunications tower, self-support design, with equipment shelter for Verizon Wireless. Attorney Lori Schweller was present to represent the petition. She stated this tower supports all objectives in the Comprehensive Plan and will be an added benefit for the businesses in the county and will also be quite a plus for the neighborhood. She also stated the tower will be 300 feet in height with lightning rods and a total of twelve (12) antennas. Phyllis Jones spoke in opposition to the petition. She stated her brother, George W. Keatts, an adjacent property owner, had received a letter regarding the petition for the Special Use permit. Her concern was if her brother decided to build a home on his property at a later date, would the cell tower pose a threat to him and the other adjacent property owners. Ms. Schweller offered a rebuttal and stated this cell tower would pose no threat to the adjacent property owners and it would benefit everyone with good phone service. Mr. Stowe closed the public hearing at 7:27 p.m. During the discussion, it was stated this will be a benefit to the county and the neighborhood. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. This concludes the Special Use Permit Cases. OLD BUSINESS There was no old business. Planning Commission January 5, 2012 Page 4 NEW BUSINESS Ms. Mease recognized Mr. Jerry Hagerman, the Board of Supervisors Representative for the Callands-Gretna District, who was in attendance at the meeting.
