BACKGROUND:
Pittsylvania County Board of Supervisors approved the utilization of grant funds from the Department of Criminal
Justice Service in 2006 for the development of a program for the diversion of juveniles from incarceration in W.W.
Moore facility and the Pittsylvania County Jail. This was a one year grant however due to the success of the grant,
the Board of Supervisors kept the program, funding it through the amount of funds saved by diverting juveniles
from the W.W. Moore facility and from the Pittsylvania County Jail to local programs and supervision under the
courts.
DISCUSSION:
Attached hereto, is a Memorandum of Agreement from the 22nd Judicial Court Services Unit and Pittsylvania
County for the operation and administration of the Intake Diversion Specialist position. This position will be
supervised under the 22"d Judicial Court Service Unit but paid by Pittsylvania County through the savings of funds
under Juvenile Detention. This is the 5`h year of operation of this program that has been highly successful through
the three Intake Specialists over the 5 year period.
RECOMMENDATION:
Staff recommends the Board of Supervisors to authorize the County Administrator to sign this agreement on the
behalf of Pittsylvania County, authorizing supervision by 22"d Judicial Court Services Unit ofthe Intake Diversion
Specialist funded by Pittsylvania County.

Memorandum of Agreement
The Following represents a memorandum of agreement between the Department of
Juvenile Justice, 22nd District Court Services Unit and the County of Pittsylvania,
Virginia. This memorandum of agreement sets forth operational administrative and
logistical support parameters to be used as guidance for providing direction and support
to Pittsylvania County employees assigned to the Department of Juvenile Justice.
Conditions of the agreement are as listed below:
1. The County of Pittsylvania will be responsible for providing to the Department of
Juvenile Justice persons to work on job activities related to the INTAKE
DIVERSION SPECIALIST position.
2. The County of Pittsylvania may elect to hire persons specifically to work at DJJ
as INTAKE DIVERSION SPECIALISTS or it may assign persons already
employed by the County to work as INTAKE DIVERSION SPECIALISTS. At
its option, the County of Pittsylvania may invite DJJ representatives to assist in
the hiring of persons to work as INTAKE DIVERSION SPECIALISTS. DJJ, if
asked to assist, will be informed about all applicable County of Pittsylvania policy
and procedures.
3. Persons assigned to DJJ by the County of Pittsylvania will remain employees of
the County of Pittsylvania and subject to the personnel rules and practices
governing the employees of the locality and the personnel rules of the Department
of Juvenile Justice that do not conflict with County personnel rules or practices.
4. DJJ will provide the direct supervision of INTAKE DIVERSION SPECIALISTS
assigned to the unit by the County of Pittsylvania. Supervisors will be informed
by the Organizational Unit Head of the DJJ Unit with assistance from the
Pittsylvania County Administrator of procedures to follow in addressing the work
performance of persons assigned as INTAKE DIVERSION SPECIALISTS.
Specific emphasis will be placed on procedures to be taken to complete annual
job performance evaluations and to report interim job performance observations.
5. The Organizational Unit Head of the DJJ Unit in conjunction with the Probation
Supervisor will develop the work plan, plan for the availability of required
resources, establish work hours and evaluate the work activities of County
employees assigned to DJJ within County guidelines.
6. DJJ and the County of Pittsylvania representatives will follow procedures within
County guidelines for reporting and acting upon work-related disciplinary
infractions committed by County employees assigned to DJJ. County employees
will be provided the opportunity to seek management resolution of workplace
issues and to initiate formal grievance if deemed appropriate by the employee.

The County of Pittsylvania will be responsible for final disciplinary actions.
7. DJJ and the County representatives will ensure that measures are in place to
account for the receipt, utilization and safeguarding of DJJ and/or County
property provided County employees assigned to DJJ.
8. The County of Pittsylvania representatives will ensure that measures are in place
that provides insurance or other liability coverage for County employees assigned
to DJJ. Such coverage as a minimum will be equal to that afforded all other
County employees performing similar duties.
9. Pittsylvania County employees assigned to DJJ as INTAKE DIVERSION
SPECIALISTS will be permitted to drive state vehicles. In order to drive a state
vehicle, county employees must have a valid Virginia driver's license.
Background Investigation Results on County employees must also show that no
criminal record exists that would negatively impact the county employees' ability
to operate a state vehicle or impact negatively on clients that may be transported
in state vehicles. All county employees shall follow DJJ Travel Regulations.
10. All INTAKE DIVERSION SPECIALISTS must have a criminal background
investigation, a child abuse background investigation, and a drug screen
completed before they are assigned to DJJ, in order to ascertain their fitness [o
have responsibility for the safety and well- being of children.
11. This agreement shall be effective from the date of its approval by the Director of
the Department of Juvenile Justice and the County Administrator for the County
of Pittsylvania, Virginia unless otherwise terminated by either party. Notice of
termination shall be provided 30 days in advance of any termination. This
agreement may be reviewed and/or amended provided that the Amendment is
agreed to in writing and signed by both parties.

BACKGROUND:
The Chatham Rescue Squad, Chatham Fire Department and the Danville Pittsylvania County Red Cross hold an
annual SK Run in Chatham during the month of October. In past years, facilitators of this event were given
permission from the Farm Service Agency to use the lobby of the Captain Martin Building for the purpose of
compiling runner statistics.
Attached hereto, is a letter from James H. and Leslie McDole, Co-Race Directors, requesting use of Captain Martin
Building lobby and the adjoining parking lot on the corner of Center Street and Main Street in Chatham. The
purpose of using the lobby is solely for statistic compilation and not to hold any other activity associated with the
event.
RECOMMENDATION:
Staff submits this to the Board of Supervisors for their review, consideration and approval.

BE IT RESOLVED that at the Adjourned Meeting of the Pittsylvania County Board of
Supervisors on September 6, 2011, the Boazd hereby certifies by a recorded vote that to the best
of each board member's knowledge only public business matters lawfully exempted from the
open meeting requirements of the Virginia Freedom of Information Act and identified in the
motion authorizing he closed meeting were heazd, discussed or considered in the closed meeting.
If any member believes that there was a departure from the requirements of the Code, he shall so
state prior to the vote indicating the substance of the departure. The statement shall be recorded
in the minutes of the Board.

POLICY REGARDING OPENING INVOCATIONS
BEFORE MEETINGS OF THE BOARD OF SUPERVISORS OF
PITTSYLVANIA COUNTY, VIRGINIA
RESOLUTION
#2011-09-OS
WHEREAS, the Boazd of Supervisors of Pittsylvania County, Virginia ("Boazd of
Supervisors"), is an elected legislative and deliberative public body, serving the citizens of
Pittsylvania County, Virginia; and
WHEREAS, legislative bodies in America have long maintained a tradition of
solemnizing proceedings by allowing for an opening prayer before each meeting, for the benefit
and blessing of the Boazd of Supervisors; and
WHEREAS, the Board of Supervisors now desires to adopt this formal, written policy to
clarify and codify its invocation practices; and
WHEREAS, such prayer before deliberative public bodies has been consistently upheld
as constitutional by American courts, including the United States Supreme Court; and
WHEREAS, in Marsh v. Chambers, 463 U.S. 783 (1983), the United States Supreme
Court rejected a challenge to the Nebraska Legislature's practice of opening each day of its
sessions with a prayer by a chaplain paid with taxpayer dollazs, and specifically concluded, "The
opening of sessions of legislative and other deliberative public bodies with prayer is deeply
embedded in the history and tradition of this country. From colonial times through the founding
of the Republic and ever since, the practice of legislative prayer has coexisted with the principles
of disestablishment and religious freedom." Id., at 786; and
WHEREAS, the Supreme Court further held, "To invoke divine guidance on a public
body. is not, in these circumstances, an `establishment' of religion or a step toward
establishment; it is simply a tolerable acknowledgment of beliefs widely held among the people
of this country." Id., at 792; and

WHEREAS, the Supreme Court affirmed in Lynch v. Donnelly, 465 U.S. 668 (1984),
"Our history is replete with official references to the value and invocation of Divine guidance in
deliberations and pronouncements of the Founding Fathers and contemporary leaders." ld., at
675; and
WHEREAS, the Supreme Court further stated, "Those government acknowledgments of
religion serve, in the only ways reasonably possible in our culture, the legitimate secular
purposes of solemnizing public occasions, expressing confidence in the future, and encouraging
the recognition of what is worthy of appreciation in society. For that reason, and because of their
history and ubiquity, those practices are not understood as conveying government approval of
particular religious beliefs." Id., at 693 (O'Connor, J., concurring); and
WHEREAS, the Supreme Court also famously observed in Zorach v. Clauson 343 U.S.
306, (1952), "We are a religious people whose institutions presuppose a Supreme Being." Id, at
313-14;and
WHEREAS, the Supreme Court acknowledged in Holy Trinity Church v. United States,
143 U.S. 457 (1892), that the American people have long followed a "custom of opening
sessions of all deliberative bodies and most conventions with prayer...," Id., at 471; and
WHEREAS, the Supreme Court has determined, "The content of [such] prayer is not of
concern to judges where ...there is no indication that the prayer opportunity has been exploited
to proselytize or advance any one, or to disparage any other, faith or belief" Marsh, 463 U.S. at
794-795; and
WHEREAS, the Supreme Court also proclaimed that it should not be the job of the
courts or deliberative public bodies "to embark on a sensitive evaluation or to parse the content
of a particular prayer" offered before a deliberative public body. Id.; and
WHEREAS, the Supreme Court has counseled against the efforts of government
officials to affirmatively screen, censor, prescribe andlor proscribe the specific content of public
prayers offered by private speakers, as such government efforts would violate the First
Amendment rights of those speakers. See, e.g., Lee v. Weisman, 505 U.S. 577, 588-589 (1992);
and
WHEREAS, the Board of Supervisors intends to adopt a policy that does not proselytize
or advance any particular faith, or show any purposeful preference of one religious view to the
exclusion of others; and
WHEREAS, the Board of Supervisors recognizes its constitutional duty to interpret,
construe, and amend its policies and ordinances to comply with constitutional requirements as
they are announced; and
WHEREAS, the Board of Supervisors accepts as binding the applicability of general
principles of law and all the rights and obligations afforded under the United States and Virginia
statutes.

NOW, THEREFORE, BE IT RESOLVED by the Boazd of Supervisors of
Pittsylvania County, Virginia, that it hereby adopts the following written policy regarding
opening invocations before meetings of the Board of Supervisors to wit:
1. In order to solemnize proceedings of the Board of Supervisors it is the policy of
the Board of Supervisors to allow for an invocation or prayer to be offered before its meetings
for the benefit of the Board of Supervisors.
2. The prayer shall not be listed or recognized as an agenda item for the meeting or
as part of the public business.
3. No member or employee of Pittsylvania County or the Board of Supervisors or
any other person in attendance at the meeting shall be required to participate in any prayer that is
offered.
4. The prayer shall be voluntarily delivered by a single member of the Board of
Supervisors, scheduled on a rotating basis among all Board of Supervisors members who
voluntarily choose to participate in the rotational list.
5. The designated member of the Boazd of Supervisors shall deliver the prayer or
invocation in his or her capacity as a private citizen, and according to the dictates of his or her
own conscience.
6. No guidelines or limitations shall be issued regazding an invocation's content,
except that the Board of Supervisors shall request by the language of this policy that no prayer
should proselytize or advance any faith, or dispazage the religious faith or non-religious views of
others.
7. No member of the Boazd of Supervisors shall receive supplemental compensation
of any kind for providing the prayer or invocation.
8. No member of the Board of Supervisors shall be scheduled to offer a prayer at

WHEREAS, Pittsylvania County has experienced an intense early to mid season drought
that encompassed the entire geographical area of the County and has significantly affected many
annual crops and most perennial crops including hay and pasture; and
WHEREAS, livestock watering has been affected with creeks drying, wells drying up
and report of one well collapsing, producers are reducing herd numbers and feeding hay, and
weight gain decreases due to the severe nature of this drought and there is an increased incidence
of pink eye; and

45%, pasture-40%, hay land-40%; irrigated Burley Tobacco-15%; irrigated Flue Tobacco-20%;

BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors
declare a disaster area in Pittsylvania County due to the extreme drought and petition the
Honorable Robert E McDonnell, Governor of the Commonwealth of Virginia, to declare
Pittsylvania County a disaster area due to the extreme drought conditions in order to provide the
means for those affected to qualify for any available relief assistance; and

IN SUPPORT OF RESTORATION OF STATE FUNDING FOR AID TO
LOCALITIES
WHEREAS, state financial assistance for mandated and high priority programs, including public
education, health and human services, public safety and constitutional officers, is $800 million less in
FY2012 than it was in FY2009; and
WHEREAS, cities and counties in the Commonwealth of Virginia are struggling to balance their budget
in a difficult economic time in which future state assistance in unreliable, federal stimulus dollars are
dwelling, and real estate assessment are declining; and
WHEREAS, the Virginia Appropriation Act contains $60 million in across-the-board cuts to cities and
counties for both FY2011 and FY2012, under which localities are required to either elect to take
reductions in particular State Aid Programs, or send the State a check for the amount determined by the
Department of Planning and Budget; and
WHEREAS, these reductions are applied to essential services, including law enforcement, jail
administration, foster care and child protective services, comprehensive services programs, election
services, and the administration of social service; and
WHEREAS, the state budget cuts are not accompanied by any reduction in the state imposed mandates,
standards and service requirements, nor do they provide any administrative flexibility for local agencies;
and
WHEREAS, the County of Pittsylvania remitted $505,161 in FY2011 and will be required to remit
another $542,536 in FY 2012; and

WHEREAS, these reductions shift a State costs to local taxpayers and artificially increase the amount of
the State surplus revenues while reducing the ability of a locality's to utilize local revenues for local
support; and
WHEREAS, the Commonwealth of Virginia has reported a surplus in excess of $544 million for
FY2011; then
BE IT HEREBY RESOLVED, by the Pittsylvania County Board of Supervisors in regular session on
Tuesday, September 6, 2011, that they respectfully request Governor Bob McDonnell to submit a budget
amendment for the 2012 Session of the General Assembly to reverse the $60 million a year reduction in
the current year for FY2012 and to eliminate the aid to locality reduction and the budget submitted for
FY2013 and FY2014; and
BE IT FURTHER RESOLVED, that the Board of Supervisors of Pittsylvania County respectfully
request the County Representatives to the General Assembly support a budget amendment for 2012
Session of the General Assembly to reverse the $60 million a year reduction for the current FY 2012, and
to eliminate the aid to locality reduction in the budget submitted for FY20] 3 and FY2014.
Public Hearines
Amendments to the Pittsylvania County Budget for Fiscal Year 2011-2012: This public
hearing had remained open from the previous meeting of August 16, 2011. No one had signed up
to speak and Mr. Barber closed the public hearing at 7:54pm. Recommendation came from the
Finance Committee, which had met at S:OOpm prior to this meeting of the Board, to remove the
$841,144.70 carryover funds listed under Pittsylvania County School until more specific
information about the this carryover's use towards the high school renovations could be provided
by the School Board and approve the remainder of the amended budget. The following Roll Call
Vote was recorded: Mr. Harville-Yes; Mr. Ecker-Yes; Mr. Davis-Yes; Mr. Snead-Yes; Mr.
Pritchett-No; Mr. Ingram-Yes; and Mr. Barber-Yes. Mr. Harville's motion passed by a 6-1
majority vote with Mr. Pritchett in opposition.

WHEREAS, Pittsylvania County operates a Parks and Recreation Department established to
provide recreational activities, games and contests within the jurisdiction of Pittsylvania County;
and
WHEREAS, the operation of the Pittsylvania County Department of Parks and Recreation is
partially funded by recreational gate fees for the entrance and attendance to any and all the
County Parks and Recreation sponsored or affiliated games, contests and activities; and

WHEREAS, in accordance with Chapter 36 of the Pittsylvania County Code, a fee assessment
must be set by the Boazd of Supervisors via resolution; and
WHEREAS, no person shall be admitted to attend or gain entry to any recreational game or
contested by the County Department of Parks and Recreation for which a fee is charged without
first paying the fee; then
BE IT HEREBY RESOLVED, that the Pittsylvania County Boazd of Supervisors establishes a
gate fee of TWO DOLLARS ($2.00) per person for the entrance and attendance to any of the
Pittsylvania County Parks and Recreation sponsored or affiliated recreational games, contests or
activities; and
BE IT FURTHER RESOLVED, that the Director of the Pittsylvania County Parks and
Recreation Department shall be responsible for the operation of a petty cash fund in the amount
of THREE HUNDRED DOLLARS ($300.00) to be utilized at various activities throughout the
County during the annual operation of Pazks and Recreation sponsored or affiliated recreational
games, contests and activities. The Director of Parks and Recreation shall be responsible for the
annual audit, balance and receipt reporting to the Director of Finance of all gate fees received in
accordance with this resolution.
BE IT STILL FURTHER RESOLVED, that this resolution shall be a standing resolution until
such time as the Board of Supervisors expressly authorizes a corrected resolution establishing a
new or revised gate fee.

RESOLUTION REQUESTING NO THRU TRUCK ON
RINGGOLD ROAD (STATE ROUTE 734)
WHEREAS, the Pittsylvania County Boazd of Supervisors requested the Virginia
Department of Transportation and the Virginia Transportation Board to place a "No Thru Truck"
restriction on Ringgold Road (SR 734) from U.S. Route 58 to the new Cane Creek Parkway
intersection on Bazker Road (SR 733); and
WHEREAS, the current restrictions still allow semi-tractor trailers to drive on U.S. RT
58 to SR 733 to the reaz entrance of the existing Yorktowne Cabinetry division; and
WHEREAS, this additional semi-tractor trailer truck traffic is placing an unsafe
condition in a residential area on Ringgold Road (SR 734) where the alternate route of Cane
Creek Parkway provides a much better and safer route for these semi-tractor trailers to travel
without interfering with residential community local traffic; and
WHEREAS, the County of Pittsylvania is receiving numerous complaints from citizens
on Ringgold Road (SR 734) concerning this continued traffic by industrial semi-tractor trailers;

RESOLUTION AUTHORIZING THE UNDERTAHING
OF CERTAIN PRELIMINARY ACTIONS
WITH RESPECT TO THE FINANCING OF LANDFILL IMPROVEMENTS
BY PITTSYLVANIA COUNTY, VIRGINIA
2011-09-06
WHEREAS, the Board of Supervisors of Pittsylvania County, Virginia (the
"Board") has determined that Pittsylvania County, Virginia (the "County") has an immediate
need for certain capital improvements to the County's landfill, including the construction of a
new cell (the "Project");
WHEREAS, the Boazd is seeking to obtain financing for the Project from the
Virginia Resources Authority (the "VRA");
WHEREAS, the County has submitted an application (the "Application") to the
VRA to participate in the VRA's Virginia Pooled Financing Program for the Fall of 2011 (the
"Pool Program';
WHEREAS, VRA requires that prospective participants 9n the Pool Program
make a fmal decision to participate by September 16, 2011 or be liable for any costs incurred in
withdrawing from the Pool Program after such date up to the date of the execution of a local
bond sale agreement or local lease acquisition agreement, after which no withdrawal is
permitted;
WHEREAS, the Pool Program offers two financing structure options that aze
applicable to the financing of the Project, one in the form of a revenue bond issued by the
County (the "Revenue Bond Option") secured by a pledge of Project revenues set aside in a
specially-created enterprise fund and further secured by a moral obligation or support agreement
from the County to VRA to fund any deficits in the debt service payments due to VRA and any
shortfall in the payment of the Project's operating expenses, and [he second in the form of a lease
obligation (the "Lease Option") secured by a pledge by the County of collateral having an

assessed value and other particulazs acceptable to VRA and with the payments under the lease
being subject to annual appropriation; and
WHEREAS, the VRA desires that the Board select either the Revenue Bond
Option or the Lease Option so that the necessary documents can be drafted and due diligence
conducted;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
SUPERVISORS OF PITTSYLVANIA COUNTY, VIRGINIA:
]. It is hereby determined to be in the best interests of the County to
undertake the financing of the Project with VRA.
2. The Board hereby ratifies, approves and confirms the filing of the
Application with VRA for participation by the County in the VRA's Pool Program.
3. The Board acknowledges that the County will not be able to withdraw its
Application after September 16, 2011 without being liable for costs incursed by VRA and VRA's
counsel, including without limitation the drafting of documents and the conducting of due
diligence.
4. The County Administrator and his staff are authorized to work with VRA
in connection with the financing of the Project, including the provision of such financial and
other information as may be necessary for VRA to approve the Application and the ftnancing of
the Project contemplated thereby.
5. The Board hereby selects the Lease Option as the financing structure for
the Ptoject and authorizes the County Administrator and his staff to take such actions in
connection therewith as may be deemed necessary or desirable, it being understood that al]
documents to be executed by the County in connection with the Lease Option shall be subject to
approval by the Board by resolution adopted at a subsequent meeting.

Ms. Karen Maute of the Westover District made comments on the difficulty of finding
the Pittsylvania County Service Authority (PCSA) agendas online, comments on the PCSA's
ordinance requiring 51 % of homeowners to connect to service lines and yet this did not appear to
be happening; and was disappointed to see the Board had taken prayer off its agenda and wished
they would consider putting invocation back on the agenda.
Mr. Richard Shumate of the Westover District made comments in favor of the citizen
attendance at the last Board meeting.

FIRE PREVENTION WEEK
OCTOBER 9-15, 2011
WHEREAS, the County of Pittsylvania is committed to ensuring the safety and security of all
those living in and visiting our state; and
WHEREAS, fire is a serious public safety concern both locally and nationally, and homes aze
the locations where people are at greatest risk from fire; and
WHEREAS, home fires killed more than 2,500 people in the United States in 2009, according to
the latest research from the nonprofit National Fire Protection Association (NFPA), and fire
departments in the United States responded to more than 360,000 home fires; and
WHEREAS, cooking equipment is the leading cause of home structure fires and associated
injuries, and the third leading cause of home fire deaths; and
WHEREAS, heating and electrical equipment and smoking materials are among the leading
causes of all reported home fires; and
WHEREAS, home candle fires are reported to a US fire department every 30 minutes, on
average; and
WHEREAS, the risk of dying in a home structure fire caused by smoking materials rises with
age; and
WHEREAS, working smoke alarms cut the risk of dying in reported home fires in half; and
WHEREAS, automatic fire sprinkler systems cut the risk of dying in a home fire by about 80%;

WHEREAS, Virginia's first responders are dedicated to reducing the occurrence of home fires
and home fire injuries through prevention and protection education; and
WHEREAS, Pittsylvania County's residents are responsive to public education measures and
are able to take personal steps to increase their safety from fire, especially in their homes; and
WHEREAS, residents who have planned and practiced a home fire escape plan are more
prepared and will therefore be more likely to survive a fire; and
WHEREAS, the 2011 Fire Prevention Week theme, "It's Fire Prevention Week. Protect your
Family
from Fire!" effectively serves to remind us all of the simple actions we can take to keep our
homes and families safe from fire during Fire Prevention Week and year-round.
THEREFORE, We, the Board of Supervisors of Pittsylvania County, do hereby proclaim
October 9-15, 2011 as Pire Prevention Week throughout the County of Pittsylvania, and we urge
all the residents of Pittsylvania County to protect their homes and families by heeding the
important safety messages of Fire Prevention Week 2011, and to support the many public safety
activities and efforts of Pittsylvania County's fire and emergency services.
Item 12 -Nursing Home Emergency Response Policy
Mark Moss, Captain of the Altavista EMS, addressed the Board with issues that had
arisen since the priority dispatch protocol, particularly in the problem of lack of rapid response
time noted by Dr. Elliot of the Staunton River Medical Center by having to wait on Regional
One due to the priority dispatch change, when other squads were already in the area of the
center. Motion was made by Mr. Ecker, seconded by Mr. Ingram, for the E911 Director to
propose changes in protocol of priority dispatch to Dr. Delera at Danville Regional Medical
Center for a change more advantageous to the Staunton River Medical Center and/or other rescue
squads that may be able to respond faster to medical centers in their respective areas, which was
unanimously approved by the Board.

Unfinished Business
At the 09-06-2011 meeting of the Board of Supevisors, Mr. Davis made a motion,
seconded by Mr. Ecker to amend the Pittsylvania County By-Laws under Article II; Section 2.6
to remove the word invocation from that section. This has met the 10-day layover requirements
of notice and the Board may vote to remove this item under Section 2.6. This will required a
Roll Call vote that had now been met. Mr. Ecker stated he would like to see Resolution 2011-
09-06, Policy Regarding Open Invocations Before Meetings of the Board of Supervisors of

would follow the policy. Mr. Davis stated that the adopted resolution was as much a policy as

recorded: Mr. Harville-Yes; Mr. Ecker-Yes; Mr. Davis-Yes; Mr. Snead-Yes; Mr. Pritchett-Yes;

Sheriff-Labor (100-4-031200-6031), $242.56 to Jai]-Professional Health Services (100-4-
033100-3110), $1,037.19 to Extradition (100-4-033100-5550), $10.44 to Jail-Medical Supplies
(100-4-033100-6004), $35.00 to Animal Control-Donations (100-4-035100-5883), $364.42 to

required a 10-day layover that had now been met. The following Roll Call Vote was recorded:

Motion was made by Mr. Snead, seconded by Mr. Pritchett, to approve an amendment to
the Pittsylvania County Engineering Services Agreement dated January 1999 with Dewberry in
the amount of $2,500 for the Operations Manual revisions and certifications and authorize the
County Administrator to sign all necessary documentation, which was unanimously approved by
the Board.
Motion was made by Mr. Pritchett, seconded by Mr. Snead, to approve the Joint Use
Agreement between the Pittsylvania County Board of Supervisors and the Pittsylvania County
Schools placing a date on this agreement of September 20, 2011 and note that this agreement is
for fiscal year 2011 and 2012 only. Without revisions, the agreement should be automatically
renewed annually, and authorize the Chairman to sign on the behalf of Pittsylvania County. Mr.
Pritchett's motion was unanimously approved by the Board.
Added Items
Motion was made by Mr. Harville, seconded by Mr. Ingram, to authorize the County
Administrator to negotiate, close and purchase a one acre site adjacent to the Callahan's Hill
Compactor site for $10,000 and authorize the Chairman of the Board to sign to receive this
property following final approval of legal counsel. Mr. Harville's motion was unanimously
approved by the Board.
Motion was made by Mr. Harville, seconded by Mr. Ecker, to authorize the County
Administrator to set a public hearing concerning a proposed change in the Pittsylvania County
ordinance for Chapter 31 in reference to Section 31-3.1; Subsection 16-8; Change in Definition,
which was unanimously approved by the Board.
Motion was made by Mr. Pritchett, seconded by Mr. Davis, to approve Out of State
Travel for a trip to Washington. DC where Mr. Barber, Mr. Snead and Mr. Sleeper will be
meeting with Congressman Robert Hurt and Senator Mark Warner. Mr. Pritchett's motion was
unanimously approved by the Board.

(FFA) and the Center for Technology and Education (CTE).
The Honorable Mazshall Ecker has requested these letters to be sent on the behalf of the Pittsylvania County Boazd
of Supervisors for recognition to students that received State and National Awards in these azeas. Attached hereto,
you will find a sample letter of recognition that will be prepared for these students.
RECOMMENDATION:
Staff recommends the Board of Supervisors authorize the County Administrator to send letters of recognition to the

At an adjourned meeting, December 22, 2008, the Board of Supervisors approved to begin paying Regional One
for back-up ambulance service to the County. At that time, the Board requested that payment to Regional One be
approved on a monthly basis. A total of $70,000 has been appropriated for Regional One in the 2012 Budget,
which will cover Regional One's monthly cost for the entire budget year.
DISCUSSION:
It is time to approve payment for Regional One for the month of October. The amount due to Regional One
is $5,833.33 per month. This amount has already been appropriated in the FY2012 budget.
RECOMMENDATION:
Staff recommends that the Board of Supervisors approve $5,833.33 for payment to Regional One for October

historic monument for Pittsylvania County. In order to protect these historic grounds, the Board of Supervisors
restricts utilization of the property except as approved by the Board of Supervisors.
DISCUSSION:
Attached hereto, you will find a letter from Jessica Broskie, the President of the Chatham Garden Club, requesting
the Board of Supervisors approval to showcase the Callands Clerks Office at the Callands Historic Park on Sunday

The Chatham Garden Club appreciates your permission to showcase the Clerk's Office and historic Gaol
located in Callands for the Chatham Garden Tour, Sunday afternoon, April 22, 2012, from 1:00 until 5:00.
Club members will serve as docents and provide parking assistance during the hours this historic court
site is open to the public. Historic Garden Week has been a statewide event in April for 75 years by
member clubs of The Garden Club of Virginia, with proceeds benefiting restoration and preservation of
historic properties throughout Virginia.
Also in the Callands area, Chatham Garden Club will be opening two private homes for next spring's tour
and is honored to have our counts first Clerks Office as a focal point. This landmark was restored by
our club to preserve local history for our community and we greatly appreciate your ongoing

The State Water Control Board's regulation 9 VAC 25-780 requires that local governments conduct a
comprehensive water supply planning process and develop a Water Supply Plan. Pittsylvania County notified
the Virginia Department of Environmental Quality in 2008 that we would participate in a regional water
supply plan coordinated by the West Piedmont Planning District Commission. Our partners in this plan are:
Henry County, Patrick County, City of Danville, City of Martinsville, Town of Stuart, Town of Ridgeway,
Town of Chatham, Town of Gretna, and Town of Hurt.
DISCUSSION:
There were a number of participant meetings and public meetings during the plan development process.
There is now a draft plan available. All participating localities must hold a public hearing to adopt the water
supply plan and to adopt a drought ordinance. The drought ordinance is a standardized document that
implements the Drought Response and Contingency Plan, which is part of the overall water supply plan. The
public hearing has been properly advertised and copies of the plan and drought ordinance have been available
for public review.
Staff recommends that the Board conduct the public hearing and following the hearing, adopt the West
Piedmont Planning District Commission Regional Water Supply Plan and the Pittsylvania County Drought
Ordinance. This action requires a Roll Call Vote.

restrictions referenced in this Ordinance are presented~in greater: detail in the County-'s Drought

Pursuant to authority granted in §§ 15;2-923 and 15.2-924of,)he Code of Virginia, 1950, as
amended, the County Administrator°'of':~Pittsylvania County, Virginia (the "County

water in any area of the County. The County Administrator will work closely with the

written notice of the emergency at t}ie~front door of the County Administration Building and
shall place a~rotice in a newspaper of'general circulation in the azea in which such emergency
has been declared.- '~
SEC. 21-24. WATERUSE:CONSIDERATIONS.
Upon the declaration of a water shortage or emergency, the County Administrator is authorized
and directed to implement conservation measures by ordering the restricted use, or absolute
curtailment, of the use of water for certain nonessential purposes for the duration of the water
shortage or emergency in the manner hereinafter set forth. In exercising this discretionary
authority, and making the determinations set forth herein, the County Administrator shall give
due consideration to streamflow conditions, water levels, avaiJableJusable storage on hand, draw
down rates, and the projected supply capability in the County; system purification and pumping
capacity; daily wafer consumption and consumption projections of the system's customers;

The provisions of this Article shall not apply to any governmental activity, institution, business,
or industry which shall be declared by the County Administrator, upon;a proper showing, to be
necessary for the public health, safety, and welfare, or the prevention of severe economic

SEC. Z1-27: PENALTY AN16'ENFORCEMENT.
(a) Any person who'violates any provision of this article shall be subject to the following civil
penalties:
(1} For the first offense, violators shall receive a written warning delivered in person or posted
by a representative of the County.
(2) F'or the second offense, violators shall be fined fifty dollars ($50.00}, the fine to be imposed
on the violator's next water bill, or in the case of violators not on the public water system, in a
written notice.

(3) For the third and each subsequent offense, violators shall be fined one hundred dollars
($100.00) for each offense, the fine to be imposed on the violator's next water bill, or in the case
of violators not on the public water system, in a written notice.
(4) Each violation by a person shall be counted as a sepazate violation by that. person,
irrespective of the location at which the violation occurs.
(b) Persons who have been assessed a penalty shall have the right. to challenge the assessment by
providing a written notice to the County Administrator within ten: (1.0). days of the date of the
assessment of the penalty. The County Administrator, or his/hec;designe'e, shall determine that
the penalty was properly assessed and notify the complairiirig;.person in writing of his
determination.
(c) The County Administrator, or his/her designee, may waive the penalry,:if he/she determines
that the violation occurred due to no fault of the person. ,
SEC. 21-28. NOTIFICATION OF END OF WATER EMERGENCY.
The County Administrator, following discussions with the, `Authority, shall notify the Board of

Supervisors when, in his/her opinion, the water emergency~sttuation no longer exists. Upon
concurrence of the Board of Supervisors;=the water emergency shall be declared to have ended.

Shelton in the Staunton River District since 1974.
DISCUSSION:
As Mr. Herman Shelton has passed away, members of his estate are requesting the Board of Supervisors to
purchase the long serving Brights Road and Summerset Road Solid Waste dumpster site in order to ensure the
environmental protection and services to that community. Attached hereto, is a letter for Kent & Kent, P.C.
Attorneys of Law, offering the property for $3,000.00, containing slightly over 0.5 acre.
RECOMMENDATION:
It is the recommendation of Staff that the Board of Supervisors authorize Staff to purchase this property for no
more than $3,000.00, close on the necessary property and remove the older buildings to ensure environmental
protection of the site. Funds are available in the current budget.

BACKGROUND:
The Board of Supervisors has discussed an Enterprise Fund for Solid Waste on several occasions and determined
not to operate the fund due to the impact on towns and other users having to ensure that payment is made into the
fund for the utilization of the landfill.
However, due to the requirements for funding of the Virginia Resource Authority as a Lease Agreement, a revenue
source must be established through a Solid Waste Enterprise Fund to ensure that funds are available to pay the
necessary bond debt of the landfill expansion. The Finance Committee and Board of Supervisors can set criteria
concerning this fund; however, to ensure the issuance of necessary bonds, the Board of Supervisors must set up a
Solid Waste Enterprise Fund. Attached hereto, is a copy of the existing fund that currently has no funding. The
Board will transfer funds from Solid Waste to the Solid Waste Enterprise Fund by this action and will establish the
necessary fund for issuing the required bonds.
RECOMMENDATION:
Staff highly recommends the Board of Supervisors transfer existing Solid Waste revenues and expenditures to the
Solid Waste Enterprise Fund. This requires a Roll Call Vote as it is a transfer. No additional funds are required to
operate this fiord by this action.

RESOLUTION AUTHORIZING THE UNDERTAHING
OF CERTAIN PRELIMINARY ACTIONS
WITH RESPECT TO THE FINANCING OF LANDFILL IMPROVEMENTS
BY PITTSYLVANIA COUNTY, VIRGINIA
2011-09-06
WHEREAS, the Board of Supervisors of Pittsylvania County, Virginia (the
"Board") has determined that Pittsylvania County, Virginia (the "County") has an immediate
need for certain capital improvements to the County's landfill, including the construction of a
new cell (the "Project");
WHEREAS, the Board is seeking to obtain financing for the Project from the
Virginia Resources Authority (the "VRA");
WHEREAS, the County has submitted an application (the "Application") to the
VRA to participate in the VRA's Virginia Pooled Financing Program for the Fall of 2011 (the
"Pool Program");
WHEREAS, VRA requires that prospective participants ~n the Pool Program
make a final decision to participate by September 16, 2011 or be liable for any costs incurred in
withdrawing from the Pool Program after such date up to the date of the execution of a local
bond sale agreement or local lease acquisition agreement, after which no withdrawal is
permitted;
WHEREAS, the Pool Program offers two financing structure options that aze
applicable to the financing of the Project, one in the form of a revenue bond issued by the
County (the "Revenue Bond Option") secured by a pledge of Project revenues set aside in a
specially-created enterprise fund and further secured by a moral obligation or support agreement
from the County to VRA to fund any deficits in the debt service payments due to VRA and any
shortfall in the payment of the Project's operating expenses, and the second in the form of a lease
obligation (the "Lease Option") secured by a pledge by the County of collateral having an

assessed value and other particulars acceptable to VRA and with the payments under the lease
being subject to annual appropriation; and
WHEREAS, the VRA desires that the Board select either the Revenue Bond
Option or the Lease Option so that the necessary documents can be drafted and due diligence
conducted;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
SUPERVISORS OF PITTSYLVANIA COUNTY, VIRGINIA:
It is hereby determined to be in the best interests of the County to
undertake the financing of the Project with VRA.
2. The Board hereby ratifies, approves and confirms the filing of the
Application with VRA for participation by the County in the VRA's Pool Program.
3. The Board acknowledges that the County will not be able to withdraw its
Application after September 16, 2011 without being liable for costs incurred by VRA and VRA's
counsel, including without limitation the drafting of documents and the conducting of due
diligence.
4. The County Administrator and his staff are authorized to work with VRA
in connection with the financing of the Project, including the provision of such financial and
other information as maybe necessary for VRA to approve the Application and the financing of
the Project contemplated thereby.
5. The Board hereby selects the Lease Option as the financing structure for
the Project and authorizes the County Administrator and his staff to take such actions in
connection therewith as may be deemed necessary or desirable, it being understood that all
documents to be executed by the County in connection with the Lease Option shall be subject to
approval by the Board by resolution adopted at a subsequent meeting.

6. The County Administrator, his staff and other officers of the County are
further authorized to take any other actions that they may feel are necessary or desirable in
connection with the matters set forth herein.
7. This Resolution shall take effect immediately upon its adoption.

The Pittsylvania County Board of Supervisors has held one public hearing for the New Chapel Church in Gretna,
Virginia, for the placement of a cemetery for their church. However; due to complications the property was not
closed on.
Attached hereto, you will find a new site being proposed for public hearing on SR 763/Weatherford Road, in the
Staunton River District of Pittsylvania County. The proposed cemetery site encompasses approximately 1 acre.
This property meets the criteria established in §57-26 of the Code of Virginia, 1950, as amended, in relation to the
location of cemeteries on private property.
RECOMMENDATION:
Staff recommends the Board of Supervisors set a public hearing for 7 ucsday, October 18, 2011 at 7:OOpm in the
General District Courtroom of the Edwin R. Shields Courthouse Addition and authorize the County Administrator

§ 57-24.1. Trustee for purpose of suit. - In the case of any private or
family graveyard, where no trustees have been designated, and it appears that
the interest of justice maybe served by the appointment of a trustee or trustees
for the purpose o£ suing or being sued, on the petition of any interested party,
the court of record wherein deeds are recorded of the county or city in which
such cemetery is located, may appoint a trustee or trustees for the purpose of
suing or being sued. The petitioner shall bear the expense of such proceedings,
provided that in the event a recovery is effected on behalf of such trustee or
trustees, costs shall be taxed as provided by law. (1970, c. 94.)
§ 57-25. Condemnation of land for cemeteries. - If it is desired at any
time to establish a cemetery for the use of a city, town, county or magisterial
district, or to enlarge any such cemetery already established, and the title to
land needed cannot be otherwise acquired, land sufficient for the purpose may
be condemned. Application for the condemnation shall be made by the
governing body of the city or town, the attorney for the Commonwealth of the
county, or any ten citizens of the magisterial district, as the case maybe, to the
circuit court of the county or city in which the land lies, and the proceedings ,.
shall be according to the provisions of Title 25.1 for condemnation of land
thereunder, so far as they can be applied to the case. The title to any land
acquired under the proceedings, if for the enlargement of an existing cemetery,e.
shall vest in the county, city or town, or in the trustees of such cemetery, as,;'
appropriate; and if for the establishment of a new cemetery, the title shall vest,a:
in the county, city or town, or in the trustees to be appointed under § 57-23, as<;;
appropriate. The land shall be held as provided by § 57-22. (Code 1919, § 53;
1997, c. 132.) ,

"Establish" and "enlarge" are not used
interchangeably. -The language of this sec-
tion completely demonstrates that the legisla-
ture did not intend the worde~"establish" and
`enlazge' to be used interchangeably, but that
the use of one excluded any idea that it em-

hereafter established, and no burial made in any part of any cemetery, other
than a municipal or city cemetery, located within 300 yards of any property
owned by any city, town or water company, upon which or a portion of which
are now located driven wells from which water is pumped or drawn from the
ground in connection with the public water supply.
(2) Qu¢ntity of l¢nd. -Nothing contained in §§ 57-22 to 57-25 shall be so
construed as to authorize a conveyance of more than 300 acres or the
condemnation of more than 2 acres of land for the use of a cemetery.
(3) Action for d¢m¢ges. -When damage is done to adjacent land by the
establishment of such cemetery, whether established by purchase or condem-
nation, the owners whose lands have been damaged shall have a right to action
for such damage against any person, firm, corporation, or municipality,
establishing the cemetery; provided such action be instituted within one year
from such establishment.
(4) Exceptions. -The prohibitions and restrictions as to the location or
establishment of cemeteries shall not apply to the town of Stuart, in Patrick
'County, to the town of Gretna, in Pittsylvania County, to the town of
Shenandoah in Page County, or to the Woodbine Cemetery in the city of
Harrisonburg, Rockingham County. And if the location for the proposed
cemetery be in Norfolk County it maybe established on such location if consent
thereto be given by the owners of every residence within 250' thereof at its
nearest point to any such residence, or if the location for the proposed cemetery
'is separated from any such residence by a state highway it may be established
:upon such location without the consent of the owner of such residence if it be

chasers and thereby render the property less
desirable and even less salable, does not consti-
tute damage within the meaning of the statute.

DISCUSSION:
In order to ensure the legality of the items identified in the policy, the Honorable Marshall Ecker is requesting the
Board of Supervisors to place Items I-11 identified in that resolution into the Bylaws of the Board of Supervisors.

BEFORE MEETINGS OF THE BOARD OF SUPERVISORS OF
PITTSYLVANIA COUNTY, VIRGINIA
RESOLUTION
#2011-09-OS
WHEREAS, the Board of Supervisors of Pittsylvania County, Virginia ("Board of
Supervisors"), is an elected legislative and deliberative public body, serving the citizens of Pittsylvania
County, Virginia; and
WHERF,AS, legislative bodies in America have long maintained a tradition of solemnizing
proceedings by allowing for an opening prayer before cash meeting, for the benefit and blessing of the
Board of Supervisors; and
WHEREAS, the Soard of Supervisors now desires to adopt this formal, written policy to
clarify and codify its invocation practices; and
WHEREAS, such prayer before deliberative public bodies has been consistently upheld as
constitutional by American courts, including the United States Supreme Court; and
WHEREAS, in cf/nrsh.v.,Chambers, a63 U.S. 783 (1983), the United States Supreme Court
rejected a challenge to the Nebraska Legislature's practice of opening each day of its sessions with a
prayer by a chaplain paid with taxpayer dollars, and specifically concluded, "The opening of sessions
of legislative and ocher deliberative public bodies with prayer is deeply embedded in the history and
tradition of this country. From colonial times through the Founding of the Republic and ever since, the
practice of legislative prayer has coexisted with the principles of disestablishment and religious
freedom." l~L, at 786; and
WHEREAS, the Supreme Court further held, "To invoke divine guidance on a public body.. .
is not, in these circumstances, an `establishment of religion or a step toward establishment it is
simply a tolerable acknowledgment of beliefs widely held among the people of this country." Id. at
792; and
WHEREAS, the Supreme Court affirmed in Lynch v. Donnelly. 4G5 U.S. 668 (1984), "Our
history is replete with official references to the value and invocation of Divine guidance in
deliberations and pronouncements of the Founding Palhers and contemporary leaders." /d, at 675; and
WHEREAS, the Supreme Court further stated, `"Chose government acknowledgments of
religion serve, in the only ways reasonably possible in our culture, the legitimate secullr purposes of
solemnizing public occasions, expressing confidence in the future, and encouraging the recognition of
what is worthy of appreciation in society. For that reason, and because of their history and ubiquity,
those practices arc not understood as conveying government approval of particular religious beliefs."

WHEREAS, the Supreme Court also famously observed in Zorach v. Clunson, 343 U.S. 306,
(1952), "We are a religious people whose institutions presuppose a Supreme Being." /d, at 313-14;
and

WHEREAS, the Supreme Court acknowledged in Holy %1•iniry Church v. Uirilerl Scares, 143
U.S. 457 (1892), that the American people have long followed a "custom of opening sessions of all
deliberative bodies and most conventions with prayer...," /d., at 471; and
WHEREAS, the Supreme Court has determined, `°fhe content of such] prayer is not of
concern to judges where ...there is no indication that the prayer opportunity has been exploited to
proselytize or advance any one, or to disparage any other, faith or belief" A~farsh, 463 U.S. at 794-795;
and
WHEREAS, the Supreme Court also proclaimed that it should not be the job of the courts or
deliberative public bodies "to embark on a sensitive evaluation or to parse the content of a particular
prayer" offered before a deliberative public body. h1; and
WHEREAS, the Supreme Court has counseled against [he efforts of government officials to
affirmatively screen, censor, prescribe and/or proscribe the specific content of public prayers offered
by private speakers, as such government efforts would violate the First Amendment rights of those
speakers. See, e g.. /.ee v. Weismnn, 505 U.S. 577, 588-589 (1992); and
WHEREAS, the Board of Supervisors intends to adopt a policy that does not proselytize or
advance any particular faith, or show any purposeful preference of one religious view to the exclusion
of others; and
WHEREAS, the Board of Supervisors recognizes its constitutional duty to interpret, construe,
and amend its policies and ordinances to comply with constitutional requirements as they are
announced; and
WHEREAS, the Board of Supervisors accepts as binding the applicability of general
principles of law and all the rights and obligations afforded under the United States and Virginia
statutes.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Pittsylvania
County, Virginia, that it hereby adopts the following written policy regarding opening invocations
before meetings of the Board oPSupervisors to wit:
1. In order to solemnize proceedings of the Board of Supervisors it is the policy of the
Board of Supervisors to allow for an invocation or prayer to be offered before its meetings for the
benefit of the Board of Supervisors.
2. "fhe prayer shall not be listed or recognized as an agenda item for the meeting or as part
of the public business.
3. No member or employee of Pittsylvania County or the Board of Supervisors or any
other person in attendance at the meeting shall be required to participate in any prayer that is offered.
4. "fhe prayer shall be voluntarily delivered by a single member of the Board of
Supervisors, scheduled on a rotating basis among all Board of Supervisors members who voluntarily
choose to participate in the rotational list.
5. "fhe designated member of the Board of Supervisors shall deliver the prayer or
invocation in his or her capacity as a private citizen, and according to the dictates of his or her own
conscience.

6. No guidelines or limitations shall be issued regarding an invocation's content, except
that the Board of Supervisors shall request by the language of this policy that no prayer should
proselytize or advance any faith, or disparage the religious faith ornon-religious views of others.
7. No member of the Board of Supervisors shall receive supplemental compensation of
any kind for providing the prayer or invocation.
8. No member of the Board of Stipcrvisors shall be scheduled to offer a prayer at
consecutive meetings of the Board of Supervisors or at more than four (4) Board of Supervisors
meetings in any calendar year.
9. No other member(s) of the Board of Supervisors shall engage in any prior inquiry,
review of, or involvement in, the content of any prayer to be offered by the scheduled member of the
Board of Supervisors.
10. Shortly before the opening gavel that officially begins the meeting and the
agenda/busincss of the public, the Chairperson of the Board of Supervisors shall introduce the
invocational speaker, and invite only those who wish to do so to stand for those observances of and for
the Board of Supervisors.
l 1. This policy in nqt intended, and shall not be implemented or construed in any way, to
affiliate the Board of Supervisors with, nor express the Board of Supervisors' preference for, any faith
or religious denomination. Rather, this policy is intended to acknowledge and express the Board of
Supervisors' respect for the diversity of religious denominations and faiths represented and practiced
among the citizens of Pittsylvania County, Virginia.

As the Pittsylvania County Board of Supervisors has adopted a policy regarding opening invocations before
meetings of the Board of Supervisors, and it appears that the American Civil Liberties Union (ACLU) has filed a
complaint in the United States District Court of the Western District of Virginia in Danville Division opposing the
Pittsylvania County Board of Supervisors policy on prayer.
DISCUSSION:
Therefore, it would seem appropriate that the Board of Supervisors of Pittsylvania County may establish a special
legal defense fund and request donations to the legal defense fund in order for the Board of Supervisors to be
prepared to fight the necessary legal battle concerning prayer before the Pittsylvania County Board of Supervisors
meetings. "this legal defense fund would be a special fund setup with the Treasurer of Pittsylvania County. Funds
would be donated and held separately as all other special accounts are relating to donations to Pittsylvania County.
RECOMMENDATION:

In the last cycle for Tobacco Commission applications, the Board approved submittal of an application for
Development Ready Sites in the Ringgold East Industrial Park to include the required engineering and
construction of industrial pad sites, with full utility service. There was only sufficient funding available at
that time for one industrial park project, and the Brosville project had to be postponed. With the new cycle of
funding, it is proposed that the next location for creating Development Ready Sites be the Brosville Industrial
Park.
The application for the Brosville Industrial Park to be submitted to the Virginia Tobacco Commission
requires a Resolution from the governing body authorizing the application and authorizing the signature of
documents.
RECOMMENDATION:
Staff submits the required resolution authorizing a Tobacco Commission application to develop industrial
sites in the Brosville Industrial Park.

WHEREAS, Pittsylvania County has been impacted by the decline of the tobacco
industry causing a negative impact on economic development and growth throughout the
County, and
WHEREAS, the Tobacco Indemnification and Community Revitalization
Commission has developed an economic development program to help tobacco related
localities to change and revitalize their economy, and
WHEREAS, grants from the Tobacco Indemnification and Community
Revitalization Commission will assist Pittsylvania County in transforming its economy to
replace the decline in the tobacco agro-business community, then
BE IT HEREBY RESOLVED, that the Board of Supervisors of Pittsylvania
County authorizes the submission of this grant for the Brosville Industrial Park -
Development Ready Sites, and authorizes the County Administrator to file this
application and all necessazy correspondence relating to the Tobacco Indemnification and
Community Revitalization Commission required by this grant and to be responsible for
the accuracy of the application and for the appropriate use of funds, should they be
granted.
