P9 PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2011-07-03 VH2GINIA: At the adjourned meeting of the Pittsylvania County Board of Supervisors held on Tuesday, July 19, 2011, the following resolution was presented and adopted congratulating the Tunstall Lady Trojans 2011 High School Soccer Team on its winning season and the winning of the Piedmont District Soccer Championship. At that time, the Board requested that payment to Regional One be approved on a monthly basis. A total of $70,000 has been appropriated for Regional One in the 2012 Budget, which will cover Regional One's monthly cost for the entire budget year. DISCUSSION: It is time to approve payment for Regional One for the month of August. The amount due to Regional One is $5,833.33 per month. This amount has already been appropriated in the FY2012 budget. RECOMMENDATION: Staff recommends that the Board of Supervisors approve $5,833.33 for payment to Regional One for August 2011. This is a local only cost not supported by the State for the cost of housing the prisoners in otherjurisdictions or facilities. DISCUSSION: In order to insure a long term contract at a fixed price, the Sheriff s Department has signed a contract with the Blue Ridge Regional Jail Authority for $30.00 a day per prisoner housed in their facility. This is a very good price compared to $36-$47 per day charged by a number of other facilities. This is on the agenda for the Board of Supervisors to review and approve because it is a long term contract that needs to be funded annually in the Sheriff's Department Budget. RECOMMENDATION: Staff recommends that the Board of Supervisors approve the contract signed by the Pittsylvania County Sheriff s Department for long term inmate housing to Blue Ridge Regional Jail. This approval by the Board of Supervisors will be recorded in their minutes to insure that we properly fund inmate housing cost each year to cover the cost of housing of inmates in otherjurisdictions' facilities. P33 AGREEMENT THIS AGREEMENT is made this/S day of ~4 ~ 2011 between the Blue Ridge Regional Jail Authority (the "Authority"J and the Sheri of Pittsylvania County, Virginia (the "Sheriff'). WHEREAS, the Pittsylvania County Jail is not able to hold all of the inmates currently under the responsibility of the Sheriff; and WHEREAS, the Authority currently has, and should continue to have, excess bed capacity in its facilities which it would like to offer to relieve the capacity issues at the Pittsylvania County Jail; and WHEREAS, the Blue Ridge Regiona( Jail is, in the opinion of the Sheriff, the regionaljail which is best situated to hold Pittsylvania County inmates. NOW THEREFORE, IT IS AGREED by the parties as follows: 1. Housing of Inmates. The Authority agrees to hold all Pittsylvania inmates designated by the Sheriff above the capacity of the Pittsylvania County Jail, which the parties agree is 121, at, one of the Authority facilities. The Sheriff agrees, for the term of this Agreement, to send all inmates over 121 to the Authority, and not to contract with any other correctional facility for the housing of inmates. 2. Cost of Housing. The Authority agrees to charge the Sheriff thirty dollars ($30.00) per day for the housing of each inmate assigned to the Authority for the term of this Agreement. The Sheriff agrees to pay for all medical services provided outside the Authority facilities and to reimburse the Authority for security staff time accrued while guarding hospitalized inmates. All medical services provided within an Authority facility including medicines will be covered by this Agreement. Atl Pittsylvania County inmates will be subject to pay any housing fees or copayments as required by Authority policy, and these funds will be retained by the Authority. The per diem rate may be adjusted for the next fiscal year by agreement of the parties and the amendment of this Agreement. 3. Transportation. The Sheriff shall be responsible for the initial transportation of all Pittsylvania County inmates to the Authority facility in Lynchburg, and to provide transportation for such inmates to and from scheduled court appearances. The Authority agrees to transport the inmates for emergency medical services. 4. Payment. Payment under this Agreement shall be due within thirty days of the receipt of an invoice from the Authority, which invoices will be sent at the end of each month. This Agreement shall begin as of the date stated above, and shall continue for a period of five (5) yeazs. The Agreement may be terminated at any time by either party by giving sixty {60) days' written notice to the other party. 6. Non-Appropriation Provision. Notwithstanding any other provision in this Agreement to the contrary, if the Boazd of Supervisors of Pittsylvania County, Virginia, fails during any fiscal yeaz to appropriate or allocate sufficient funds to the Sheriff to pay the amounts to be paid by the Sheriff pursuant to the provisions of this Agreement, which become due or payable during such fiscal year, then this Agreement and al[ the obligations of the Sheriff hereunder shall automatically terminate at the end of the fiscal year in which such non-appropriation occurs. The Sheriff agrees to use reasonable efforts to obtain any necessary funding contemplated by this Agreement, on an annual basis. Governing Law, Venue, Mediation, Legal Fees/Costs. A. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. B. Venue: If legal action by either party is necessary for or with respect to the enforcement of any or all of the terms and conditions hereof, then exclusive venue therefore shalt lie in the City of Lynchburg, Virginia, C. Mediation: 1. Good faith mediation shall be a condition precedent to the filing of any litigation in law or equity by either Party against the other Party relating to this Agreement. Before the remedies provided for in this Section maybe exercised by either Party, such Party shall give written notice to the other Party that such Party believes that an event of default or impasse under this Agreement may have occurred, specifying the circumstances constituting the event of default or impasse in sufficient detail that the other Party will be fully advised of the nature of the event of default or impasse. The responding Party shall prepaze and serve a written response thereto within ten (10) business days of receipt of such notice. A meeting shall be held within ten (lp) business days after the response between the Parties to attempt in good faith to negotiate a resolution of the dispute. 2. If the Parties are unable to resolve the dispute through the above- process, the Parties shall attempt to resolve the controversy by engaging a single mediator, experienced in the subject matter, to mediate the dispute. The Page 2 of 3 P35 mediator shall be mutually selected by the Parties, to the controversy and conduct mediation at a location to be agreed upon by the Parties or absent agreement, by the mediator. Within two (2) business days of selection, the mediator shall be famished copies of the notice, this Agreement, response, and any other documents exchanged by the Parties. If the Parties and the mediator are unable to settle the same within thirty (30) days from selection, or such other time as the Parties agree, the mediator shall make a written recommendation as to the resolution of the dispute. Each Party, in its sole discretion, shall accept or reject such recommendation in writing within ten (10) days. Should the Parties be unable to agree upon a single mediator within five (5) business days of the written response of the responding Party, the Parties jointly, shall agree upon the selection of a neutral third-party agreed upon by the Parties, to appoint a mediator, experienced and knowledgeable in the matters which aze the subject of the dispute. The costs of the Mediator and the mediation shall be shazed equally by the Parties to the dispute. 3. Notwithstanding the preceding pazagraphs, the Parties reserve the right to file suit or pursue litigation. The Pazties consent to selection of a mediator by any Court shall not constitute consent to jurisdiction of such court or waiver of defenses as to venue or jurisdiction. D. The County recently received renewal rates from Delta Dental. DISCUSSION: The renewal rates from Delta Dental include a 2% increase over the rates used for FY2011. These new rates will be effiective for two years. Currently, the Board of Supervisors pays $12 toward dental coverage for full-time employees and retirees. "Phis equates to $144.00 annually per employee and retiree. The Insurance Committee recently met and agreed to allow the Employee Health Fund to absorb the cost of this increase for FY2012. The cost of the increase for the year equates to approximately $15,000. The Employee Health Fund currently has a balance of $3,358,738.22. This Fund can only be used to support health and dental benefits for the County. RECOMMENDATION: This summary is provided to notify the Board of Supervisors of the Insurance Committee's intention to allow the Employee Health Fund [o absorb approximately $15,000, the cost of the 2% dental insurance premium increase for FY2012. The waiver of these fees is a payment made to the Pittsylvania County Service Authority (PCSA) by the County to waive the cost of the fees to the individual businesses or industries connecting to these utilities. DISCUSSION: In order to establish some criteria concerning a relationship with private businesses, the Board of Supervisors agreed to adopt a policy which would require a Performance Agreement for the waiver of water & sewer fees for the creation oftwenty-five (25)jobs within athirty-six (36) month period and a Performance Agreement indicating re-payment of the required water & sewer fees if the intuitives have not been met. Attached hereto, is a draft Performance Agreement for the Brosville Industrial Park requiring approval of the Board of Supervisors to waive $7,500.00 in water and sewer fees. In addition, this requires the Board of Supervisors to approve $7,500.00 from unappropriated surplus to pay the water and sewer tees to the PCSA in accordance with the attached agreement. RECOMMENDATION: Staff recommends that the Board of Supervisors approve the attached Performance Agreement and authorize the County Administrator to sign on behalf of Pittsylvania County concerning the required Performance Agreement at Brosville Industrial Park. P46 PERFORMANCE AGREEMENT This Performance Agreement made and entered into this day of July 2011 by and between Wilkins Realty, LLC., hereinafter referred to as the Company, and the Board of Supervisors of Pittsylvania County, Virginia, a political subdivision of the Commonwealth of Virginia hereinafter referred to as the County. WITNESSETH WHEREAS, The County, in order to stimulate economic growth and development of the community be creating jobs and new infrastructure has agreed to provide incentives to new and expanding businesses and industries; and WHEREAS, The Company has determined that it is in The Company's best interest to locate a business in Brosville Industrial Park, creating new investment and new jobs; and WHEREAS, The County is desirous of assisting The Company to create newjobs and to expand the tax base of the county; and WHEREAS, The County and The Company desire to set forth their understanding and agreement as to the receipt of, and use of incentive funds and the obligations regazding capital investment and job creation of The Company or its lessees as a result of the receipt of the incentive funds, as well as the payment format by the County of those funds. NOW, THEREFORE, in consideration of the foregoing, the mutual benefits, promises and understanding of the Company and the County, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties do hereby covenant and agree as follows: 1. The County will provide a Utility Investment Grant of $7,500 within thirty days of the approval and execution of this PERFORMANCE AGREEMENT by the parties with the understanding that the following two conditions are met within the stated time-frame: (a) The Company or its lessees shall create a total of twenty-five (25) full- time jobs at the Brosville facility within thirty (30) months from the date of this agreement. For purpose of this agreement, full-time jobs shall mean jobs which would ordinarily be scheduled to work a minimum of thirty- five (35) hours per week on a year-round basis, normal vacation and holiday excepted. The full-time jobs shall continue at the Brosville facility for a minimum time period of thirty-six (36) months, normal turnover, rehire and training time excepted. For the twenty-five (25) jobs created, The Company shall receive up to $7,500 in incentives paid to the Pittsylvania County Service Authority (PCSA). (b) The Company agrees, with thirty (30) months from the date of this agreement, to create and complete the location of a facility at the Brosville Industrial Park to house a medical service operation supported by the Danville Regional Hospital. 1 P47 2. The Company shall provide to The County detailed verification of The Company's fulfi]Iment of its obligation to provide twenty-five (25) full-time jobs and to maintain the jobs, including the production of such documentation as may be requested The County for verification thereof. Said verification shall be provided upon receipt of the Job Incentive Grant such that a base amount of full- timejobs can be documented, and further such verification shall be provided at twelve (12) months following the receipt of the Utility Incentive Grant from The County. 3. "Phis position is funded by the General Fund. DISCUSSION: The E-911 Center is authorized 4 employees to a shifr and One Operations Supervisor. In 2010 the 911 Center processed over 193,000 incoming-outgoing phone calls per year which generated over 47,067 calls For service to be dispatched to Police, Fire, EMS and Animal Control calls within the County. Our 911 Center handles 1,298,618 tasks (See Attachment) each year with 17 Authorized Dispatchers. Whenever a vacancy occurs it typically takes at least three months to fill the vacancy and at least six additional months to train the new employee. This dramatically increases the work load during the vacancy and while the employee is in training. Furthermore, during this time other dispatchers maybe on vacation, Holiday, Comp-time off, or sick leave. Our 911 Center is below the average employees with a County our size handling the call volume that we do. RECOMMENDATION: Staff recommends the Board of Supervisors waive the hiring freeze for the position of E-911 Telecommunicator. Salary: $25,374.00. At the last meeting of the Board of Supervisors we approved a contract for VJCCCA services for Pittsylvania County Community Services Board providing drug screening and other counseling for the J & D Court. It is the intent to help get offenders back in line with their required responsibility as citizens. P57 CONTRACT FOR SERVICES FISCAL YEAR 2012 Purchase of service agreement between the parties as listed, utilizing Virginia Juvenile Community Crime Control Act Funds as provided for such purposes. A. SCOPE OF SERVICES: Wentz Enterprises, Inc. agrees to provide Law and Community Awareness (LACA) services. A program designed to provide education regazding law, the juvenile justice system and juvenile's rights and responsibilities as a citizen, to provide opportunities for positive interaction with legal authorities and other community representatives, to encourage juveniles to examine their own values and attitudes towards the law and community, and to improve juveniles' skill in the azeas of communication, problem-solving and responsible decision making for juveniles from 10-17 years of age. Wentz Enterprises utilizes staff of the Court Service Unit, Juvenile and Domestic Relations Court, and other local community agencies as resources. Eligible Juveniles must meet one of the following criteria: (1) a traffic offender (2) in the diversion program (3) a first time offender (4) on probation. Wentz Enterprises, Inc further agrees to: 1. Receive appropriate referrals for LACA from the 22"d District Court Service Unit in the County of Pittsylvania. 2. Provide component program activities as described under the section "program type" in the current FY2011-2012 VJCCCA local plan for Pittsylvania County. 3. Maintain a responsive and supportive liaison with the Juvenile and Domestic Relations Court and Service Unit of Pittsylvania County. P58 4. Create and maintain appropriate case records, relevant data and evaluation materials for all juveniles and families referred to and receiving LACA services. Submit all reports to include: Program Acceptance Letter to clienUparent (copy to CSU), Law and Community Awareness Group Rules, Law and Community Awareness Participant Progress Form (submitted with monthly invoice), pre-post test results and any other correspondence as required by the Juvenile and Domestic Relations Court Service Unit for referred cases in a timely manner. 5. Comply with all requirements of the Virginia Juvenile Community Crime Control Act as directed by the Virginia Department of Juvenile Justice and the County of Pittsylvania as implemented through the current VJCCCA Local Plan for FY 2011-2012. The Contractor will also be familiar with and accountable for the compliance with the Virginia Department of Juvenile Justice document titled "Standards for Non-Residential Services Available to Juvenile and Domestic Relations District Courts," Sections 6VAC35-150-425 through 6 VAC35-150- 600 and be prepared to implement all applicable sections in their program operations and service delivery to clients. A copy of the relevant sections of the Code of Virginia, the Local VJCCCA Plan for FY 2011-2012 and the Department of Juvenile Justice Standards for Non-Residential Services (required sections) are available with this contract for review by the Contractor and the Purchasing Agency. Said documents are available at the offices of the 22"d District Court Services Unit in Chatham, Virginia. 6. The Contractor should provide services designed specifically to address the assessed needs of referred juveniles and prevent and discourage youth from involvement with the Juvenile Justice and Correctional systems in the State of Virginia, and will be prepared to provide evidence that these programs and services are effective and supportive in achieving this goal. The 22nd District Court Services Unit will maintain responsibility for the development and submittal to the Virginia Department of Juvenile Justice of the local VJCCCA plan when requested and as required. This plan as approved will include the funding determination for all programs and services approved for participation in the Virginia Juvenile Community Crime Control Act as implemented within the County of Pittsylvania. All decisions regarding the amount and disbursement of VJCCCA funding as provided through the Virginia Department of Juvenile Justice to the County of Pittsylvania will be at the sole discretion and prerogative of the entities. All disbursements of VJCCCA funds must be made in accordance with the current (FY 2011-2012) Pittsylvania County VJCCCA plan as approved by the State Board of Juvenile Justice. P59 B. METHOD OF COMPENSATION- Monthly on a reimbursement basis, upon receipt of invoice from Contractor for services rendered in the period named on the invoice. All monthly billings submitted will note specific services provided as described under the section "program type" within the FY2011-2012 VJCCCA local plan for Pittsylvania County. Each monthly billing will include, as attachments, "Billing/JTS Reporting Form(s)" which provide the following information: Participant name, DJJ#, Pre/Post, PO Name, Referral Date, Service Dates, Completion or Release Date and code, Total Units for billing period, Unit Cost, and Total Costs. Only those referrals who aze participants for that billing period will be included in that month's billing. All monthly billings by the Contractor will be submitted to the Secretary in the Chatham office of the 22nd District Court Service Unit. Afrer review by other appropriate CSU staff, they will be submitted to the Probation Supervisor in the 22" District for review and approval and then submitted to the Director of Finance in Pittsylvania County for processing; all of this is to be done within ten (10) working days of their receipt. Payment to Wentz Enterprises, Inc shall be made within 30 days of receipt of a complete invoice at the CSU office and documentation that the latest Clinical Summary documenting progress toward goals and objectives has been received. The Purchasing Agency will pay $28.00 per child per group session for up to eight (8) sessions not to exceed $3,808.00. The total of juveniles served will not exceed 12 individuals per group for up to 2 groups or 17 total youth from the ages of 10-17. Reporting Requirements established within this contract may not be changed during the contract year. C. TIME OF PERFORMANCE- Services will commence on July 1, 201 ]and end on June 30, 2012. D. GENERAL PROVISIONS- Nothing in this agreement shall be construed as authority For either party to make commitments which will bind the other party beyond the scope of services contained herein, Furthermore, the Contractor shall not assign ,sublet or subcontract any work related to this agreement or any interest he/it may have herein, without the prior written consent of the Agency. This contract is subject to appropriations by the Virginia General Assembly. E. CONDITIONS OF PAYMENT- All services provided by Contractor pursuant to this agreement shall be performed to the satisfaction of the Agency, and in accord with all applicable federal, state and local law, ordinances, rules and regulations. Contractor shall not receive payment for work found by the Agency to be unsatisfactory, or performed in violation of federal, state or local law, ordinance, rule or regulation. P60 F. LIABILITY- The Contractor shall indemnify and hold harmless Wentz Enterprises, Inc and its employees and designated representatives, from any and all claims, suits, actions, liabilities of any kind, caused by the performance/actions of Speakers not employed by Wentz Enterprises that volunteer to speak for or on behalf of the LACA program. These individuals are not employed by Wentz Enterprises, Inc. G. TERMINATION- Wentz Enterprises, Inc may terminate this agreement for its convenience upon 30 days written notice to the other party. Upon termination for convenience, the Contractor shall be paid only for those additional expenses incurred between notification of termination and the effective date of termination that are necessary for curtailment of his/its work under this agreement. In the event of breach by the Contractor of this agreement, Wentz Enterprises, Inc shall have the right to immediately rescind, revoke or terminate the agreement. In the alternative, Wentz Enterprises, Inc. may give written notice to the Contractor specifying the manner in which the agreement has been breached. If notice of breach is given and the Contractor has not substantially corrected the breach within 15 days of receipt of the written notice, Wentz Enterprises shall have the right to terminate the agreement. In the event of rescission, revocation or termination, all documents and other materials related to the performance of this agreement shall become the property of the Purchasing Agency, named here as the County of Pittsylvania. H. INTEGRATION AND MODIFICATIONS- This contract constitutes the entire agreement between the Contractor and the Agency. No alteration, amendment or modification to the provisions of this agreement shall be effective unless reduced to writing, signed by the parties and attached hereto. L COLLATERAL CONTRACTS- Where there exists any inconsistency between this agreement and other provisions of collateral, contractual agreements which are made a part of this agreement by reference or otherwise, the provisions of this agreement shall control. NON-DISCRIMINATION- In his/its performance of this agreement, the Contractor warrants that he/it will not discriminate against any employee, or other person, on account of race, color, sex religious creed, ancestry, age, or national origin. P61 K. SEVERABILITY- Each paragraph and provision of this agreement is severable from the entire agreement, and if any provision is declared invalid, the remaining provisions shall nevertheless remain in effect. L. OWNERSHIP OF DOCUMENTS -Any reports, studies, photographs, negatives, or other documents prepared by Contractor in the performance of its obligations under this contract shall be the exclusive property of the Agency, and all such materials shall be remitted to the Agency by Contractor upon completion, termination or cancellation of this contract. Contractor shall not use, willingly allow or cause to have such materials used for any purpose other than performance of Contractor's obligations under this contract without the prior written consent of the Agency. M. APPLICABLE LAWS- This agreement shall be governed in all respects whether as to validity, construction, capacity, performance or otherwise, by the laws of the Commonwealth of Virginia. N. FINANCIAL RECORDS AVAILABILITY: Wentz Enterprises, Inc. agrees to retain all books, records, and other documents relative to this agreement for three (3) years. Since the Pittsylvania County Department of Parks and Recreation is a County department, it requires an ordinance that authorizes the collection of gate fees for recreational activities in Pittsylvania County. Attached hereto, for Chapter 36, is an amendment relating to the recreational gate fees authorizing gate fees for the entry and attendance of any County Parks and Recreation run or sponsored event. It is necessary for this to be established in order to have authority for gate fees and recreational activities. RECOMMENDATION: Staff recommends the Board of Supervisors set the required public hearing for amendments to Chapter 36 of the Pittsylvania County Code, to allow for recreational gate fees for the Department of Parks and Recreation.
