Press 05.11 PUBLIC HEARING NOTICE PITTSYLVANIA COUNTY REZONINGS & VARIANCE CYCLE 243 Public hearings will be held on Tuesday, May 3, 2011, at 7:00 p.m. in the General District Courtroom, second floor, Edwin R. Shields Courthouse Addition, Chatham, Virginia. After the public hearings, the Planning Commission will make recommendations to the Board of Supervisors and the Board of Zoning Appeals. The schedule contains (8) Rezoning Applications and (1) Variance Application. The Board of Supervisors will hold a public hearing and rule on (8) Rezoning Applications on Tuesday, May 17, 2011, at 7:00 p.m. in the General District Courtroom, second floor, Edwin R. Shields Courthouse Addition, Chatham, Virginia. The Board of Zoning Appeals will hold a public hearing and rule on (1) Variance Application on Tuesday, May 10, 2011, at 7:00 p.m. in the General District Courtroom, second floor, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Copies of the proposed Rezoning and Variance Applications are available for public review in the Office of Code Compliance, 53 North Main Street, Chatham, Virginia, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Case 1 Roland H. Worley, R-11-013 – The properties are a total of 76.65 acres, two parcels, located off State Road 996/Covington Road, in the Staunton River Election District and shown on the Pittsylvania County Tax Maps as GPIN#s 2566-11-5156/8-A-85A (5.45 acres) and 2566-21-0242/8-A-85B (71.20 acres). The applicant is requesting to rezone the R-1, Residential Suburban Subdivision District portions (a total of 38.51 acres) to A-1, Agricultural District to make the zoning consistent with the remaining 38.14 acres and to construct an addition to his home. The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District, A-1, Agricultural District and MHP, Residential Manufactured Housing Park District uses. Case 2 Donald Wayne Deboe & Kim Louise Gillespie Deboe, R-11-014 – The property is 16.75 acres, located on State Road 836/White Oak Circle, in the Tunstall Election District and shown on the Pittsylvania County Tax Maps as GPIN # 2403-87-5033/110-A-30D. The applicants are requesting to rezone from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for placement of a second dwelling, a single-wide mobile home, for their daughter’s residence. The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District and A-1, Agricultural District uses. Douglas Dalton, Jr., R-11-015 – The property is 49.36 acres, located on U.S. Highway 29 North, in the Banister Election District and shown on the Pittsylvania County Tax Maps as part of GPIN # 2417-84-3141. The applicant is requesting to rezone one portion of the petitioned parcel (0.218 acre, per plat) from A-1, Agricultural District to M-2, Industrial District, Heavy Industry to be combined with GPIN # 2417-85-6421 that is zoned M-2. The Comprehensive Plan indicates the area is suitable for A-1, Agricultural District, R-1, Residential Suburban Subdivision District, B-2, Business District, General, M-1, Industrial District, Light Industry, M-2, Industrial District, Heavy Industry and MHP, Residential Manufactured Housing Park District uses. The applicants are requesting to rezone from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjacent parcel of land zoned A-1. The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District and A-1, Agricultural District uses. Hyler, R-11-017 – The property is 5.92 acres, located on State Road 876/Mangrums Road, in the Tunstall Election District and shown on the Pittsylvania County Tax Maps as GPIN # 1368-85-5348/160C-1-16A. The applicant is requesting to rezone from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for future subdivision of the property for family members. The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District, A-1, Agricultural District and B-2, Business District, General uses. Zoning conditions and ordinance standards shall control the density of allowable development. Case 6 JAD Builders, Inc., & Linda T. Marshall, R-11-018 – The property is 9.25 acres, located on State Road 853/Inman Road, in the Tunstall Election District and shown on the Pittsylvania County Tax Maps as GPIN # 1369-13-4075/146-A-73H. The applicants are requesting to rezone the R-1, Residential Suburban Subdivision District portion (approximately 3.88 acres) to A-1, Agricultural District to make the zoning consistent with the remaining 5.37 acres zoned A-1. The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District and A-1, Agricultural District uses. Motley, Life Tenant & Ann Hamner Doss, Remainderman, R-11-019 – The properties are a total of 46.11 acres, three parcels, located on State Road 821/Cheyenne Lane, in the Banister and Callands-Gretna Election Districts and shown on the Pittsylvania County Tax Maps as GPIN #s 2406-42-3366/97-4-C (40.15 acres), 2406-31-7318/97-4-A (2.88 acres) and 2406-31-7851/97-4- (3.08 acres). The applicants are requesting to rezone the R-1, Residential Suburban Subdivision District portions (a total of 9.38 acres) to A-1, Agricultural District to make the zoning consistent with the remaining 36.73 acres and for future sale of portions of the property to adjacent property owners. The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District and A-1, Agricultural District uses. Whitt, R-11-020 – The property is 1.04 acres, located on State Road 856/Cobbs Knob Road, in the Tunstall Election District and shown on the Pittsylvania County Tax Maps as GPIN # 1336-20-7909/171-A-99A. The applicant is requesting to rezone from M-2, Industrial District, Heavy Industry to A-1, Agricultural District to allow for placement of a single-wide mobile home for his personal residence. The Comprehensive Plan indicates the area is suitable for A-1, Agricultural District and M-2, Industrial District, Heavy Industry uses. Zoning conditions and ordinance standards shall control the density of allowable development. Case V-1, Carol Hines Wilson, Et Als, Alan Raymond Hines, Et Als & Cynthia Hines Hyler, Et Als, V-11-001 – The property is 1.24 acre, located on State Road 844/Mount Cross Road, in the Tunstall Election District and shown on the Pittsylvania County Tax Maps as GPIN # 1470-14-4862/134-9-1. The applicants are requesting a Variance to Section 35-272, Minimum Yard Dimensions, A. Front Setback and C. Rear Setback and Section 35-269, Area Regulations, Subsection 4, Required State-Maintained Road Frontage of the Pittsylvania County Zoning Ordinance. A Variance of eight (8) feet is needed to the rear setback of the house. The house is setting 32 feet from the rear property line and needs to be setting 40 feet from the rear property line. A Variance of three (3) feet is needed to meet the front setback to edge of right-of-way requirements of the mobile home. The mobile home is setting 32 feet from the edge of the right-of-way and needs to be 35 feet from the right-of-way. This will allow for division of the property (to subdivide the house from the mobile home). The Comprehensive Plan indicates the area is suitable for R-1, Residential Suburban Subdivision District, A-1, Agricultural District and RC-1, Residential Combined Subdivision District uses.
