Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Dr. Miller gave the invocation. Mr. Stowe called the roll. PRESENT Morris Stowe Richard Motley Janet Mease Dr. Charles H. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:04 p.m. Planning Commission March 1, 2011 Page 2 Public Hearing -Amendment to the Pittsylvania County Zoning Ordinance as Advertised Mr. Stowe opened the public hearing at approximately 7:05 p.m. Mr. Shelton reported on the advertised amendment. Barbara Hudson and Karen Maute spoke in opposition to the advertised amendment and Ms. Maute presented handouts to the Board members. Mr. Stowe closed the public hearing at approximately 7:16 p.m. Upon motion of Mr. Motley, seconded by Mr. Arthur and by a 7 to 1 vote (Mr. Welborn opposed), it was recommended that the Board of Supervisors approve this change to the Pittsylvania County Zoning Ordinance. Case 1~,Terry Lee Heath, R-11-007. Mr. Stowe opened the public hearing at 7:18 p.m. Mr. Shelton, Director of Code Compliance, reported that Jerry Heath had petitioned to rezone a total of 27.15 acres, three parcels, located on State Road 612/Banister Road, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (to make the zoning consistent with the adjoining farm and for future subdivision of the properties for family members). Jerry Heath was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:19 p.m. During the discussion, it was stated that the petitioned parcels of land are surrounded by agricultural zoned properties. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. Case 2, Donald R. Fritz & Linda W. Fritz, R-11-008. Mr. Stowe opened the public hearing at 7:20 p.m. Mr. Shelton, Director of Code Compliance, reported that Donald and Linda Fritz had petitioned to rezone 0.40 acre, located off State Road 978/Lakeside Road, in the Callands-Gretna Election District from MHP, Residential Manufactured Housing Park District to A-1, Agricultural District (for a single family dwelling for their permanent residence). Donald Fritz was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:21 p.m. During the discussion, it was stated there are two (2) double-wide mobile homes next door to the petitioned property. A motion was made by Ms. Mease, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone this property from MHP, Residential Manufactured Housing Park District to A-1, Agricultural District. Motion passed unanimous. Case 3, Coy E. Harville & Jean D. Harville, R-11-009. Mr. Stowe opened the public hearing at 7:22 p.m. Mr. Shelton, Director of Code Compliance, reported that Coy and Jean Harville had petitioned to rezone a total of 21.80 acres, three parcels, located off State Road 870/Vandola Road, in the Westover Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (for agricultural use -timber harvesting). Mr. Shelton represented Mr. Harville and stated he would try to answer any questions the Board might have regarding the petition. Mr. Shelton also stated that to address the concerns of the neighbors, Mr. Harville had submitted a proffer to not allow any single-wide mobile homes on the petitioned parcels of land. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:23 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District with proffer. Mr. Stowe opened the public hearing at 7:24 p.m. Mr. Shelton, Director of Code Compliance, reported that Richard L. Sowers, Jr., had petitioned for a Special Use Permit on 1.11 acres, located on State Road 730/Countryside Drive, in the Dan River Election District (for a vehicle demolisher). Richard Sowers was present to represent the petition. He stated he was requesting the Special Use Permit in order to obtain a vehicle demolisher license, which would allow him to purchase recreational vehicles from salvage dealers, remove any usable parts and take what is left to salvage dealers. He also stated his home is located next to his business and he would not have a junkyard. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:26 p.m. During the discussion, it was stated the area is nice and clean. A motion was made by Mr. Welborn, seconded by Mr. Motley, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimous. Case S-2, David Calloway, S-11-005. Mr. Stowe opened the public hearing at 7:27 p.m. Mr. Shelton, Director of Code Compliance, reported that David Calloway had petitioned for a Special Use Permit on 0.65 acre, located on State Road 832/Halifax Road in the Banister Election District (for placement of a single-wide mobile home for his personal residence). David Calloway was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. A motion was made by Dr. Miller, seconded by Mr. Harville, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimous. Case S-3, Samuel Tarpley Adams,Jr., Trustee, S-11-006 - Mr. Stowe opened the public hearing at 7:29 p.m. Mr. Shelton, Director of Code Compliance, reported that Samuel Tarpley Adams, Jr., Trustee, had petitioned for a Special Use Permit on 3.284 acres, located on State Road 1044/Beechnut Road, in the Tunstall Election District (for a salvage yard). Robert Adams was present to represent the petition. He stated he wanted to obtain a salvage dealer license which would allow him to purchase wrecked motorcycles and ATVs from insurance auctions to rebuild and sell parts on the Internet. He also stated he would have a 40 x 40 foot building in which to store the parts and there would be no outside storage on the property. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:30 p.m. A motion was made by Mr. Motley, seconded by Mr. Harville, to recommend the Board of Zoning Appeals grant this Special Use Permit. NEW BUSINESS Mr. Shelton reported on regulations on single-wide mobile homes and concerns regarding minimum dwelling size, especially on lean-to buildings that are stick-built like a mobile home and storage buildings converted into dwellings. A motion was made by Mr. Harville, seconded by Mr. Motley, that this be referred to the County Planner, Mr. Sides, as requested by Mr. Shelton and the Planning Commission conduct a public hearing on regulations regarding Minimum Dwelling Size on stick-built dwellings. RMF, Residential Multi-Family District -Residential locations for apartments, townhouses, garden style, condominiums, and variety of multi-family dwellings; plus accessory buildings. RPD Residential Planned Unit Development -Residential locations encouraging a variety of housing with community facilities. Integrated into the area plus accessory commercial uses possibly included. MHP, Residential Manufactured Housing Park District -Residential locations to accommodate manufactured/mobile homes where the land is owned by the park and rented/leased to the home owners.
