Shields Courthouse Addition, Chatham, Virginia. Mr. Easley called the meeting to order at approximately 6:48 p.m. Mr. Merricks gave the invocation. Mr. Shelton called the roll. PRESENT R. Board of Zoning Appeals December 14, 2010 Page 2 Case S-2, Betty Davis Huppert, S-10-014 - Mr. Easley opened the public hearing at approximately 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported Betty Ruppert had petitioned for a Special Use Permit on 1.18 acres, located on State Road 875/Horseshoe Road in the Westover Election District for placement of a single-wide mobile home for her son's residence. James Huppert was present to represent the petition. He stated that he just needed a place to live. The Board mentioned they had received a letter of opposition. Mr. Easley closed the public hearing at approximately 7:02 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Estes, seconded by Mr. Merricks, the following motion was adopted: Whereas, Betty Davis Huppert has petitioned the Board of Zoning Appeals for a Special Use Permit for asingle-wide mobile home for her son's residence and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted with the following condition: The applicant must follow the ordinance in placing the mobile home. Motion passed unanunous. Case S-3, William Simms, S-10-015 - Mr. Easley opened the public hearing at approximately 7:03 p.m. Mr. Shelton, Director of Code Compliance, reported William Simms had petitioned for a Special Use Permit on 8.85 acres, located on Ponderosa Drive in the Dan River Election District for an automobile graveyard. William Simms was present to represent the petition. He stated that he was not a junk dealer but a collector of old farm equipment and mentioned he also liked old cars. He also stated he had plans to fence the property and build a barn. Mr. Easley closed the public hearing at approximately 7:35 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Some of the issues discussed were that that the Special Use Permit is only for the petitioned parcel, Mr. Simms will not be selling parts and he had presented a proffer. Upon motion of Mr. Merricks, seconded by Ms. Glass, the following motion was adopted: Whereas, William Simms has petitioned the Board of Zoning Appeals for a Special Use Permit for an automobile graveyard and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted with the following conditions: 1. When William Simms no longer resides on the property the Special Use Permit will expire and all inoperable vehicles will be removed within 90 days. 2. Inoperable vehicles and parts will be located at least 100 feet from the front of the property line. Motion passed unanimous. This concludes the Special Use Permit case. In accomplishing this important task we are charged with promoting the health, safety, and general welfare of the citizens of Pittsylvania County. We must insure that all our decisions and recommendations be directed to these goals and that each be consistent with the environment, the comprehensive plan and in the best interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the board regarding zoning cases will be limited to (3) three minutes. PUBLIC HEARING PROCEDURE A. R-1, Residential Suburban Subdivision District -Residential lots fox affordable housing including single-family, modular and double-wide mobile homes; plus accessory buildings. RC-1, Residential Combined Subdivision District -Residential lots for affordable housing including single-family dwellings and mobile homes; plus accessory buildings. RMF, Residential Multi-Family District -Residential locations for apartments, townhouses, garden style, condominiums, and variety of multi-family dwellings; plus accessory buildings.
