03-12-2010 BOS Special Call MeetingSpecial Call Meeting Mazch 12, 2010 Pittsylvania County Board of Supervisors Friday, March 12, 2010 Special Call Meeting VIRGINIA: The Special Call Meeting of the Pittsylvania County Board of Supervisors was held at 5:00 PM on Friday, March 12, 2010 in the County Administration Conference Room in the Moses Building in Chatham, Virginia. Mr. Henry A. Davis, Chairman of the Board called the meeting to order at 5:00 P.M. The following members were present: James Snead Dan River District William H. Pritchett Banister District Tim R. Barber Tunstall District Marshall Ecker Staunton River District Fred Ingram Callands-Gretna District Coy E. Harville Westover District Henry A. Davis, Jr. Chatham-Blairs District Also present were Mr. William D. Sleeper, County Administrator, Mr. John P. Light, Legal Counsel and Ms. Rebecca D. Flippen, Deputy Clerk to the Board. Motion was made by Mr. Harville, seconded by Mr. Barber, to approve the agenda with the addition of: Closed Session: Discussion, consideration, or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of any public body. Authority: §2.2-3711(A)(1), Code of Virginia, 1950, as amended. Mr. Harville's motion was unanimously approved by the Board. Upon a motion of Mr. Harville, seconded by Mr. Ingram, the board voted to go into closed session at 5:03 p. m. for the specific purpose o£ Consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the public body; and consultation with legal counsel employed or retained by a public body regarding specific legal matters requiring the provision of legal advise by such counsel. Authority: Section 2.2-3711 - (A) (7) of the Code of Virginia, 1950, as amended. And for: Closed Session: Discussion, consideration, or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of any public body. Authority: §2.2-3711(A)(1), Code of Virginia, 1950, as amended. The board reconvened at 5:45 p. m. The following certification resolution was read and approved by the following roll call vote: PITTSYLVANIA COUNTY BOARD OF SUPERVISORS CERTIFY CLOSED MEETING BE IT RESOLVED that at the Special Call Meeting of the Pittsylvania County Board of Supervisors on March 12, 2010, the board hereby certifies by a recorded vote that to the best of each board member's knowledge only public business matters lawfully exempted from the open meeting requirements of the Virginia Freedom of Information Act and identified in the motion authorizing the closed meeting were heard, discussed or considered in the closed meeting. If any member believes that there was a departure from the requirements of the Code, he shall so state prior to the vote indicating the substance of the departure. Motion was made by Mr. Barber, seconded by Mr. Harville, to authorize Legal Counsel and the County Administrator to seek counsel with one or more secondary attorneys for pending matters filed by Barbara Hudson. Mr. Barber's motion was unanimously approved by the Board. Mr. Davis directed Mr. Light to be the spokesman to the media, on the behalf of the Board, in all matters concerning the lawsuits filed by Barbara Hudson.
