06/01/2010 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING June 1, 2010 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, June 1, 2010, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m.. Mr. Stowe gave the invocation. Mr. Stowe called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Ms. Mease, and by a unanimous vote the May 4, 2010, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m. Case 1, William Harper, R-10-021. Mr. Stowe opened the public hearing at 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported that William Harper had petitioned to rezone a total of 1.73 acres, two parcels, located on U. S. Highway 41/Franklin Turnpike, in the Westover Election District from B-1, Business District, Limited and R-1, Residential Suburban Subdivision District to B-2, Business District, General (for future commercial development). Mr. Harper was not present to represent the petition. Mr. Shelton stated he would answer any questions. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:02 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors Planning Commission Page 2 June 1, 2010 rezone these properties from B-1, Business District, Limited and R-1, Residential Suburban Subdivision District to B-2, Business District, General. Motion passed unanimous. Case 2, Dennis Irby and Cheryl Jacobs, R-10-022. Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code Compliance, reported that Dennis Irby and Cheryl Jacobs had petitioned to rezone the R-1, Residential Suburban Subdivision District portion of 50.69 acres to A-l, Agricultural District (to make the zoning consistent with the remaining 44.69 acres and to construct a shop building). The R-1 portion is 6.00 acres, located off Highway 29 Business/Main Street, Hurt, VA, in the Staunton River Election District. Joel Keith was present to represent the petition. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:04 p.m. A motion was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone the R-1, Residential Suburban Subdivision District portion of this property to A-1, Agricultural District. Motion passed unanimous. Case 3, Linda R. Witcher and Others, R-10-023. Mr. Stowe opened the public hearing at 7:05 p.m. Mr. Shelton, Director of Code Compliance, reported that Linda R. Witcher and Others had petitioned to rezone 9.00 acres, located off State Road 841/Stillmeadow Road, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (to survey off a lot for a family member). Viola Martin was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:06 p.m. A motion was made by Mr. Motley, seconded by Mr. Weatherford, that the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. Case 4, Estelle Chaney, R-10-024. Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Estelle Chaney had petitioned to rezone a total of 17.62 acres, two parcels, located on Coy Creek Lane, in the Dan River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (for future subdivision of property for family). She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:08 p.m. A motion was made by Mr. Welborn, seconded by Mr. Arthur, that the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. Case 5, Clara Vaden, R-10-025. Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Clara Vaden had petitioned to rezone 2.00 acres, located on State Road 640/Spring Garden Road, in the Banister Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (to allow for placement of a second dwelling to be used for her daughter’s residence). Clara and Lyenal Vaden were present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:10 p.m. During the discussion it was stated this parcel was surrounded by A-1 property. A motion was made by Mr. Motley, seconded by Mr. Weatherford, that the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. Case 6, James & Cynthia Holmes, R-10-026. Mr. Stowe opened the public hearing at 7:11 p.m. Mr. Shelton, Director of Code Compliance, reported that James and Cynthia Holmes had petitioned to rezone a total of 31.15 acres, two parcels, located on State Road 1154/Grubb Road, in the Callands-Gretna Election District from R-1 Residential Suburban Subdivision District to A-1, Agricultural District (to allow for placement of a second dwelling (single-wide mobile home) on one parcel for the care of a family member, to make the zoning consistent with their adjoining parcels of land and for agricultural use – cattle). James Holmes was present to represent the petition. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:12 p.m. A motion was made by Ms. Mease, seconded by Mr. Weatherford, that the Board of Supervisors rezone Planning Commission Page 3 June 1, 2010 this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. Case 7, Leon & Shirley Rowland, R-10-027. Mr. Stowe opened the public hearing at 7:13 p.m. Mr. Shelton, Director of Code Compliance, reported that Leon and Shirley Rowland had petitioned to rezone 1.19 acres, located on U. S. Highway 29 North, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General (for a lawn mower, tractor and car repair business). Robert Rowland was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:16 p.m. During the discussion it was stated that several calls had been received from neighbors regarding this petition. It was further stated they were not opposed to the petition, and that Mr. Rowland was hard working and did excellent work, but they would like to see the parcel cleaned up. The issue of safety regarding entering and exiting the property was also mentioned. It was stated Mr. Rowland might want to consider a proffer regarding the property. A motion was made by Mr. Motley, seconded by Ms. Mease, that this case be continued for thirty (30) days. Motion passed unanimous. This concludes the Rezoning Cases. Case S-1, Mary Ann Jones, S-10-006. Mr. Stowe opened the public hearing at 7:17 p.m. Mr. Shelton, Director of Code Compliance, reported that Mary Ann Jones had petitioned for a Special Use Permit on 1.00 acre, located on Highway 29 Business/North Main Street, Chatham, VA, in the Banister Election District (for emergency services, rescue and medical transport). Mary Ann Jones was present to represent the peitition. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:18 p.m. A motion was made by Mr. Motley, seconded by Mr. Weatherford, that the Board of Zoning Appeals grant this Special Use request. Motion passed unanimous. This concludes the Special Use Cases. OLD BUSINESS Mr. Sides stated a memo had been sent to the Board regarding the Board of Supervisors accepting the Comprehensive Plan.
