03-07-2023 Legislative Committee Meeting - FINAL PITTSYLVANIA COUNTY BOARD OF SUPERVISORS LEGISLATIVE COMMITTEE March 7, 2023 VIRGINIA: The Pittsylvania County Board of Supervisors' Legislative Committee Meeting was held on March 7, 2023, in the Board Meeting Room, 39 Bank Street, SE, Chatham, Virginia 24531. CALL TO ORDER (5:00 PM) Chesher called the Meeting to Order at 5:00 PM ROLL CALL The following Committee Members were present: • Timothy W. Chesher - Dan River District; • Robert M. Tucker, Jr. - Banister District; and • Robert (“Bob”) W. Warren - Chatham-Blairs District. The following Board Members were also present: • Darrell W. Dalton - Chairman, Callands-Gretna District; • Timothy W. Dudley - Vice-Chairman, Staunton River District; • William V. ("Vic") Ingram - Tunstall District; and • Ronald S. Scearce - Westover District. APPROVAL OF AGENDA Motion to approve Agenda. RESULT: APPROVE MOVER: Tucker SECONDER: Warren AYES: Chesher, Tucker, Warren NAYS: None ABSTAIN: None OLD BUSINESS a. Solar Ordinance Revisions Review Ragsdale discussed the proposed Solar Ordinance Revisions with the Committee. Revisions include Utility-Scale Solar Energy Facilities shall not be located less than five (5) miles from any other Utility Scale Solar Energy Facility, no more than two percent (2%) of the total acreage within a single zoning district shall be approved for use as a Utility Scale Solar Energy Facility, and Utility Scale Solar Energy Facilities shall be exempt from Sec. 35-141(C)(1) and (2), if the proposed Project has entered into a Power Purchase Agreement (“PPA”), or similar agreement, with a tenant company located within the defined boundaries of the Southern Virginia Megasite at Berry Hill, which also has an approved Local Performance Agreement with the Board. Motion to recommend the revisions be forwarded to the full Board, and following the conducting of the legally required Public Hearing at its March Business Meeting, the revisions to PCC § 35-141 be approved as presented. Temporary Residential Occupancy of Campers Ordinance Review Ragsdale presented additions/revisions to PCC § 35-87, Temporary Camping. Her presentation can be found on the County's website at www.pittsylvaniacountyva.gov. Ragsdale stated when these emergency situations arise, her Staff would make these applications priority and would guarantee an inspection the day after the application is filed, if not the same day. Motion to recommend the full Board authorize County Staff to advertise the legally required Public Hearing to potentially amend PCC § 35-87, Temporary Camping, at the Board’s April Business Meeting. BOS' Planning Commission Member Voting Status Change Discussion Ingram stated the Planning Commission (“PC”) is the only Board left that has the BOS Representative as a voting member, and to support consistency, to make the BOS Representative on the PC a non-voting member. Warren and Tucker stated they agree with consistency and support this change. Motion to send this item to the full Board for approval, and make the BOS Representative on the PC a liaison member.
