PC Minutes 11 07 2019 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING Thursday, November 7, 2019 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Thursday, November 7, 2019, in the General District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Motley called the roll. Hayes Deputy Director of Community Development Greg Sides Assistant County Administrator J. Vaden Hunt County Attorney MOMENT OF SILENCE The Board observed a moment of silence. PLEDGE OF ALLEGIANCE The Board recited the Pledge of Allegiance. HEARING OF THE CITIZENS No citizens came forward to speak. APPROVAL OF THE AGENDA A motion was made by Mr. Haymore, seconded by Mr. Stowe, and by a unanimous vote, the agenda was approved as presented. APPROVAL OF THE MINUTES A motion was made by Mr. Dudley, seconded by Mr. Horne, and by a unanimous vote, the October 1, 2019, minutes were approved as presented. CHAIRMAN’S REPORT Mr. Motley congratulated Mr. Dudley on his victory in the recent election to serve as representative of the Staunton River Election District on the Pittsylvania County Board of Supervisors. Mr. Motley also welcomed Mr. Haymore’s wife and Mr. Nathan Harper, who will serve as Mr. Dudley’s replacement as representative of the Staunton River Election District on the Planning Commission, to the meeting. . THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately 7:04 p.m. Case R-19-032, Sarah Wilson Smith – Mr. Motley opened the public hearing at 7:04 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Sarah Smith had petitioned to rezone 0.213 of an acre, located on Cascade Road in the Tunstall Election District from A-1, Agricultural District, to R-1, Residential Suburban Subdivision District, to combine with the adjacent parcel of land zoned R-1. She then Planning Commission November 7, 2019 Page 2 stated once the property is rezoned to R-1, all uses listed under Section 35-222 are permitted. Mrs. Smith was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:05 p.m. A motion was made by Mr. Stowe, seconded by Mr. Haymore, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously. This concludes the Rezoning case. Case S-19-013, Caden Energix Axton, LLC – Mr. Motley opened the public hearing at 7:06 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Caden Energix Axton, LLC, had petitioned for a Special Use Permit on 365.31 acres (130 acres will be used), located on Centerville Road in the Tunstall Election District for a utility-scale solar energy facility. John Ragone was present to represent the petition. Ms. Ragone provided a brief overview of the proposed solar project and answered questions from the Board members. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:12 p.m. A motion was made by Mr. Stowe, seconded by Mr. Horne, to recommend to the Board of Zoning Appeals that the Special Use Permit request be granted with the 17 Special Use Permit conditions provided in the Board Packet. Motion passed unanimously. Case S-19-014, Whitehorn Solar, LLC – Mr. Motley opened the public hearing at 7:14 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Whitehorn Solar, LLC, had petitioned for an addendum to their existing Special Use Permit to add two (2) parcels totaling 9.75 acres, located on and off Taylors Mill Road and East Gretna Road, in the Banister and Callands-Gretna Election Districts to meet the required setbacks. Ben Lindermeier was present to represent the petition. Mr. Lindermeier provided a brief overview of the proposed addendum to the existing solar project. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:15 p.m. A motion was made by Dr. Miller, seconded by Mrs. Mease, to recommend to the Board of Zoning Appeals that the Special Use Permit request be granted with the 17 Special Use Permit conditions provided in the Board Packet. Motion passed unanimously. This concludes the Special Use Permit cases. OLD BUSINESS Mr. Sides reported that he had contacted TPE Kentuck Solar regarding their failure to meet the screening requirements for the solar facility. He then stated they had agreed in writing to replant with staggered rows using a different variety of trees, and the trees would be 4-6 feet in height at the time of planting. NEW BUSINESS Mrs. Hayes reported there are two (2) rezoning cases for the month of December, both located in the Dan River Election District. Mr. Sides congratulated Mrs. Hayes on her recent completion of training and certification as a Virginia Certified Zoning Administrator. Mr. Motley wished everyone a Happy Thanksgiving. The meeting was adjourned at approximately 7:20 p.m.
