BZA Minutes 11 12 2019 PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING November 12, 2019 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, November 12, 2019, in the General District Courtroom, Chatham, Virginia. Mr. Talbott, Chairman, called the meeting to order at approximately 7:00 p.m. Mrs. Hayes called the roll. PRESENT Kenneth Talbott R. Allan Easley Leon Griffith Helen Glass Joseph “Jay” Craddock Ronald Merricks Carroll Yeaman Karen N. Hayes Christopher Dadak, Attorney APPROVAL OF THE AGENDA Prior to the approval of the agenda, Mr. Talbott stated since there will be no December meeting, he needed to appoint a Nominating Committee and he made a request for volunteers who would be willing to serve on this committee so new officers could be selected in January. Mr. Merricks and Mr. Yeaman volunteered to serve on the committee. Upon motion of Mr. Yeaman, seconded by Mr. Griffith, and by a unanimous, the agenda was approved as presented. APPROVAL OF THE MINUTES Upon motion of Mr. Easley, seconded by Mr. Craddock, and by a unanimous vote, the October 8, 2019, minutes were approved as presented. OLD BUSINESS There was no old business. NEW BUSINESS Mrs. Hayes reported there are no cases for the month of December, 2019. She then stated there will be one (1) Special Use Permit in January for a campground. THE ZONING PRECEPTS WERE READ by Mr. Talbott TO OPEN THE PUBLIC HEARING at approximately 7:04 p.m. Case S-19-013, Roger M. Winn, Jr., George Taylor Winn, III, & David T. Patterson – Mr. Talbott opened the public hearing at 7:04 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Caden Energix Axton, LLC, had petitioned for a Special Use Permit on a total of 365.31 acres (approximately 130 acres will be used), located on Centerville Road, in the Tunstall Election District for a large-scale solar energy facility. She then stated the Planning Commission recommended by a unanimous vote, with no opposition, that the petitioner’s request be granted with the 17 Special Use Permit conditions provided in the Board Packet. John Ragone was present to represent the petition. He provided a brief summary of the solar facility and answered questions from the Board members. There was no opposition to the petition. Mr. Talbott closed the public hearing at 7:10 p.m. The Board discussed the petition as the Committee of the Whole. Upon motion of Mr. Griffith, seconded by Mr. Yeaman, the following motion was adopted: Whereas, Caden Energix Axton, LLC, has petitioned the Board of Zoning Appeals for a Special Use Permit for a utility-scale solar energy facility, and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted with the 17 Special Use Permit conditions provided in the Board Packet. Motion passed unanimously. Case S-19-014, Whitehorn Solar, LLC – Mr. Talbott opened the public hearing at 7:13 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Whitehorn Solar, LLC, had petitioned for an addendum to their existing Special Use Permit to add two (2) parcels totaling 9.75 acres, located on and off Taylors Mill Road and East Gretna Road in the Banister and Callands-Gretna Election Districts to meet the required setbacks. She then stated the Planning Commission recommended by a unanimous vote, with no opposition, that the petitioner’s request be granted with the 17 Special Use Permit conditions provided in the Board Packet. Ben Lindermeier was present to represent the petition. He gave a brief overview of the proposed addendum to the existing Special Use Permit for the utility-scale solar energy project. There was no opposition to the petition. Mr. Talbott closed the public hearing at 7:16 p.m. The Board discussed the petition as the Committee of the Whole. Upon motion of Mr. Easley, seconded by Mr. Merricks, the following motion was adopted: Whereas, Whitehorn Solar, LLC, has petitioned the Board of Zoning Appeals for a Special Use Permit for a utility-scale solar energy facility addendum, and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted with the 17 Special Use Permit conditions provided in the Board Packet.
