02/02/2010 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING February 2, 2010 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, February 2, 2010, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Dr. Miller gave the invocation. Mr. Stowe called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Ms. Mease, and by a unanimous vote the January 5, 2010, minutes were approved as presented. REVISED AGENDA Mr. Shelton explained that the Public Hearing – Amendments to the Pittsylvania County Zoning Ordinance as Advertised needed to be added to the Agenda. Upon motion of Dr. Miller, seconded by Mr. Motley, and by unanimous vote the agenda was revised. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m. PUBLIC HEARING – AMENDMENTS TO THE PITTSYLVANIA COUNTY ZONING ORDINANCE Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton explained the revisions to the Pittsylvania County Zoning Ordinance, Chapter 35-Zoning, Supplementary Definitions for the addition of the following definitions: Raceway, Private Recreational Facilities and Public Recreational Facilities and to remove Raceway listed under Industrial District (M-2) – Heavy Industry, Sec. 35-402, Permitted Uses, and to add Raceway under Industrial District (M-2) – Heavy Industry, Sec. 35-403, Special Use Permits. Mr. Shelton then read the Supplementary Definitions for Raceway - A commercial enterprise, open to the public, whereby a fee is charged for admission or a fee is charged to participate, where competitions are conducted on privately owned land involving mechanical or motorized vehicles. Private Recreational Planning Commission February 2, 2010 Page 2 Facilities – A commercial enterprise, open to the public, whereby a fee is charged for admission or a fee is charged to participate, where recreational activity is conducted on privately owned land. Public Recreational Facilities – A location where recreational activity is made available to the general public on publicly owned land. Mr. Stowe closed the public hearing at 7:05 p.m. Upon motion of Mr. Motley, seconded by Mr. Arthur, and by unanimous vote, it was recommended to the Board of Supervisors to amend the Ordinance to reflect the changes as read. Case 1, Brad Michael Compton, R-10-004. Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that Brad Michael Compton had petitioned to rezone 3.98 acres, located off Hollyberry Drive, in the Callands-Gretna Election District from C-1, Conservation District to R-1, Residential Suburban Subdivision District (to combine with adjacent properties zoned R-1). Brad Compton was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:07 p.m. A motion was made by Ms. Mease, seconded by Mr. Ingram, to recommend the Board of Supervisors rezone this property from C-1, Conservation District to R-1, Residential Suburban Subdivision District. Motion carried by unanimous vote. Case 2, Brenda Marshall White & Others, R-10-005. Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that Brenda Marshall White and Others had petitioned to rezone 33.79 acres, located off State Road 360/Old Richmond Road and Chickadee Road, in the Dan River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (for future subdivision of property for family members). Ms. Elizabeth Marshall was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m. A motion was made by Mr. Welborn, seconded by Mr. Arthur, that the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. . This concludes the Rezoning Cases. Case S-1, Gerald & Darlene Doss, S-10-001. – Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported that Gerald and Darlene Doss had petitioned for a Special Use Permit on 5.37 acres, zoned A-1, located on State Road 629/Piney Grove Road, in the Staunton River Election District (for emergency services, rescue and medical transport). Mr. Shelton also reported he had received a call of opposition to this case citing traffic and noise. Mr. and Mrs. Doss were not present to represent the petition. There was no opposition to the petition. Mr. Stowe closed the public hearing at approximately 7:11 p.m. During the discussion it was stated this is a rural area and noise should not be a problem. A motion was made by Mr. Arthur, seconded by Mr. Motley, that the Board of Zoning Appeals grant this Special Use request. Motion passed unanimous. Case S-2, Janice Lee Way LLC, S-10-002. – Mr. Stowe opened the public hearing at 7:12 p.m. Mr. Shelton, Director of Code Compliance, reported that Janice Lee Way LLC had petitioned for a Special Use Permit on 94.3 acres (per plat), zoned A-1, located on State Road 832/Halifax Road, in the Banister Election District (for an indoor shooting range). Tim Reynolds with Reynolds and Clark, was present to represent the petition. Mr. Reynolds discussed the details regarding the application and the facility. He stated the facility would be used for police training and public NRA certification training. The building would not be sitting near the road and there would be no outside activity. There would be no noise outside the building. There was no opposition to the petition. Mr. Stowe closed the public hearing at approximately 7:20 p.m. During the discussion it was stated this facility would be good for hunter safety classes. A motion was made by Dr. Miller, seconded by Mr. Arthur, that the Board of Zoning Appeals grant this Special Use request. Motion passed unanimous. This concludes the Special Use Cases. Case Z-1, Edge Hill Church Parsonage, Z-10-003. Mr. Stowe opened the public hearing at 7:21 p.m. Mr. Shelton, Director of Code Compliance, reported that Eagle Hill Church Parsonage had petitioned for a Sign Permit on 3.54 acres, located on State Road 668/Level Run Road, in the Staunton River District (for a second on-site church sign). Mr. Edward Moon, Jr., was present to represent the petition. He stated he had nothing to add except the church had not decided what kind of sign would be placed on the property, whether it would be a digital sign or not. Mr. Stowe closed the public hearing at approximately 7:22 p.m. A motion was made by Mr. Arthur, seconded by Mr. Welborn, that the Board of Zoning Appeals grant this Sign Permit request. Motion passed unanimous. This concludes the Sign Cases. Planning Commission February 2, 2010 Page 3 OLD BUSINESS The Board discussed the Comprehensive Plan draft they had been given at the January 5, 2010 meeting. Mr. Sides was not present due to a death in his family. A motion was made by Dr. Miller, seconded by Mr. Welborn, that a public hearing be scheduled for the March meeting.
