Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Stowe gave the invocation. Mr. Stowe called the roll. Mr. Stowe opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that John & Janet Wood had petitioned to rezone 19.02 acres, located on State Road 612/Union Hall School Road, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (to put the property into land use). Mr. and Mrs. Wood were present to represent the petition. Mr. Wood stated that he had nothing to add. There was no opposition to the petition. Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that James Bowman had petitioned to rezone 1.80 acres, located on U.S. Highway 58 West/Martinsville Highway, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General (to sell or lease the property for future commercial development). Mr. Bowman was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mx. Motion passed unanimous Planning Commission December 1, 2009 Page 2 Case 3, Montle & Deborah Heath, R-09-048. Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that Montle and Deborah Heath had petitioned to rezone a total of 51.13 acres, three parcels, located on/off State Road 703/Irish Road, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (to bring the properties into compliance for their current agricultural use). Mr. Heath was present to represent the petition and stated this property had been used for agricultural purposes for years. Mr. Stowe closed the public hearing at 7:07 p.m. During the discussion, it was stated that this property had been used for agricultural purposes for years. A motion was made by Mr. Motley, seconded by Mx. Snead, that the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous. This concludes the Rezoning Cases. Case S-1, AT & T , S-09-016. Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that AT & T petitioned for a Special Use Permit on 1.80 acres, located on State Road 360/Old Richmond Road, in the Dan River Election District (to bring the existing AT & T tower building and related equipment into compliance and to add an addition to the existing equipment building). Mr. Erickson was present to represent the petition. He stated this was an existing building and AT & T needed to expand the building for additional equipment. It was further stated AT & T would not be touching the tower and they would only add additional length to the building for equipment. The building would have the same look and would be the same color. There was no opposition to the petition. Mr. Stowe closed the public hearing at approximately 7:10 p.m. A motion was made by Mr. Wellborn, seconded by Mr. Arthur, that the Board of Zoning Appeals grant this Special Use request. Motion passed unanimous. OLD BUSINESS Mr. Stowe appointed Mr. Welborn, Mr. Arthur and Ms. Mease to the nominating committee for the Chairman and Vice Chairman fox 2010. NEW BUSINESS Mr. Shelton stated Dr. Miller was out of town and that was the reason for his absence. Mr. Shelton further stated the Plannuig Commission and Board of Zoning Appeals membership and agendas would be listed on the county's website. Mr. Sides then discussed the updates to the Comprehensive Plan. He gave a brief overview of the information that would be included in each chapter. The date for the public hearing was then discussed. It was decided that Mr. Sides would have copies of the updated plan for the January 5, 2010, Planning Commission meeting and possibly the plan could be placed on the website prior to the February 2010 advertisement. Mr. Snead made a motion that Mr. Sides have the update of the Comprehensive Plan ready and to the Plamung Commission after the first of the year.
