PC Minutes 08 07 2018 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING August 7, 2018 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, August 7, 2018, in the General District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Motley called the roll. APPROVAL OF THE AGENDA A motion was made by Mr. Stowe, seconded by Mrs. Mease, and by a unanimous vote, the agenda was approved as presented. APPROVAL OF THE MINUTES A motion was made by Mr. Stowe, seconded by Mr. Dudley, and by a unanimous vote, the July 3, 2018, minutes were approved as presented. CHAIRMAN’S REPORT Mr. Motley welcomed Mr. Greg Sides, Assistant County Administrator, and Mr. J. Vaden Hunt, County Attorney, to the meeting. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately 7:02 p.m. Planning Commission August 7, 2018 Page 2 Case R-18-013, Walter V. Coles & Alice Clement Coles – Mr. Motley opened the public hearing at 7:02 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Walter and Alice Coles had petitioned to rezone 24.13 acres, located on State Road 683/South Meadows Road, in the Banister Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjacent parcels of land zoned A-1. Mrs. Hayes also stated once the property is rezoned to A-1, all uses listed under Section 35-178 are permitted. Mr. Rich Armstrong was present to represent the petition. He stated he had nothing to add. Karen Maute, Will Cleveland, Susan Stilwell, Beth Robertson, Mike Sexton, and Sarah Dunavant spoke in opposition to the petition. Mrs. Maute also presented a letter to the Board members requesting the case be denied due to the negative impacts of uranium mining. Their concerns included, but were not limited to, the following: if the property was rezoned to A-1 and if the ban on uranium mining was lifted, mining would be allowed on the property and a Special Use Permit would be required; protection is needed from uranium mining and radon gas; this is not about agricultural use, this is about uranium mining; real estate values will plummet should uranium mining be allowed; numerous risks to the environment, etc. Mr. Armstrong offered a rebuttal and stated Mr. and Mrs. Coles had been waiting to rezone their property for over a year, and they desired to reduce their taxes and put the property into land use. He also stated Mr. and Mrs. Coles had never mentioned uranium mining during the entire time he was dealing with them. Several of the Board members spoke on the dangers of uranium mining, and it was also stated this property had been zoned R-1 since 1991. Mr. Motley closed the public hearing at 7:23 p.m. A motion was made by Dr. Miller, seconded by Mr. Davis, to recommend the Board of Supervisors deny the rezoning request. Motion passed unanimously. Case R-18-015, Pamela J. Manning – Mr. Motley opened the public hearing at 7:32 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Pamela Manning had petitioned to rezone 0.69 acre, located on State Road 745/Mount View Road, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to be combined with the adjacent parcels zoned A-1. Mrs. Hayes also stated once the property is rezoned to A-1, all uses listed under Section 35-178 are permitted. Ms. Pamela Manning was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:34 p.m. A motion was made by Mr. Dudley, seconded by Mr. Haymore, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously. Case R-18-016, Norma Totten Lee & Rodney Jay Lee – Mr. Motley opened the public hearing at 7:35 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Norma and Rodney Lee had petitioned to rezone 0.93 acre, located on State Road 745/Mount View Road, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to be combined with the A-1 property to the rear for a total of 2.558 acres. Mrs. Hayes also stated once the property is rezoned to A-1, all uses listed under Section 35-178 are permitted. Ms. Pamela Manning was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:37 p.m. A motion was made by Mr. Stowe, seconded by Mr. Horne, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously. Case R-18-017, Jessica Lynn Abbott – Mr. Motley opened the public hearing at 7:38 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Jessica Lynn Abbott had petitioned to rezone 1.07 acres, located on State Road 659/Laurel Grove Road, in the Dan River Election District from B-2, Business District, General to R-1, Residential Suburban Subdivision District to make the zoning consistent with the current residential use. Mrs. Hayes also stated once the property is rezoned to R-1, all uses listed under Section 35-222 are permitted. Mr. Chuck Eskey was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:39 p.m. A motion was made by Mr. Planning Commission August 7, 2018 Page 3 Horne, seconded by Mr. Stowe, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously. This concludes the Rezoning cases. Case S-18-007, James E. Keatts – Mr. Motley opened the public hearing at 7:40 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that James Keatts had petitioned for a Special Use Permit on 2.29 acres, located on State Road 855/Martin Drive, in the Tunstall Election District to allow for placement of a single-wide mobile home for his personal residence. Mr. James Keatts was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:41 p.m. Mr. Stowe stated he had talked to the community and they had no problem with a single-wide mobile home on the property; however, the motion to grant the request must have a condition attached stating the home must be removed within a certain period of time. Mr. Keatts then questioned the Board members as to the amount of time he would be given to remove the old mobile home. Mr. Motley reopened the public hearing at 7:46 p.m. The Board members then discussed the terms of the condition to be attached to the motion. Mr. Motley closed the public hearing at 7:48 p.m. A motion was made by Mr. Stowe, seconded by Mr. Dudley, to recommend the Board of Zoning Appeals grant the Special Use Permit request with the following condition: The old mobile home must be removed from the premises within forty-five (45) days. Motion passed unanimously. Case S-18-008, Charlene Karen Grant – Mr. Motley opened the public hearing at 7:50 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Charlene Karen Grant had petitioned for a Special Use Permit on 1.18 acres, more or less, located on State Road 750/Strawberry Road, in the Callands-Gretna Election District to allow for placement of a 2018 single-wide mobile home for her personal residence. Mrs. Hayes then stated the mobile home will replace the existing home on the property that will be demolished. Ms. Karen Grant was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:51 p.m. A motion was made by Mrs. Mease, seconded by Mr. Haymore, to recommend the Board of Zoning Appeals grant the Special Use Permit request. Motion passed unanimously. This concludes the Special Use Permit cases. OLD BUSINESS There was no old business. NEW BUSINESS Mrs. Hayes reported on the cases for the September, 2018, cycle, which include two (2) rezoning cases; one (1) in the Callands-Gretna Election District and one (1) in the Tunstall Election District. She then stated there is one (1) special use permit case for a campground and one (1) sign permit case for an on-site 3 ½’ x 5’ (17.5 square feet) heliport donor sign. Mr. Greg Sides presented information he had received from the Virginia Outdoors Foundation concerning a proposed Conservation Easement on properties owned by Jerry L. Martin for the Board’s review. The 315+/- acres of land are zoned A-1, Agricultural District and are located on the North Carolina border, a few miles southwest of Danville. Mr. Sides stated the Virginia Outdoors Foundation had requested a review by the Planning Commission and a determination that the easement is supported by the County’s Comprehensive Plan. Planning Commission August 7, 2018 Page 4 A motion was made by Mr. Horne, seconded by Mr. Stowe, that these properties are consistent with the Comprehensive Plan. Motion passed unanimously.
