Opposed Abusive Driver Fees
PITTSYLVANIA COUNTY BOARD OF SUPERVISORS
RESOLUTION
2007-07-58
WHEREAS, the 200'1 session of the :Virginia General Assembly passed House
Bi113202 entitled Funding of Transportation Programs in the Commonwealth of Virginia;
and
WHEREAS, this House: bill established new transportation funds for the
Commonwealth of Virginia and.specifically for several authorities in Northern Virginia
and Tidewater through a series of fees and taxes applicable to transportation; and
WHEREAS, House Bi11 3202 and Senate Bill 708 incorporated and created a
new series. of .fees entitled "Abusive Driver Fees" issued against traffic violations based
on accumulated driver°demerit points; and
WHEREAS, these abusive driver fees appear to be' creating significant problems
among low and moderate income pedple; and
WHEREAS, the final version of the act imposes these fees only on residents of
Virginia; and
WHEREAS, Pittsylvania County borders North Carolina receiving a significant
number of out of state drivers in and through our region and County on a daily basis; and
WHEREAS, these increased fees differ from penalties and traffic fines which do
apply to out of state drivers; then
BE IT HEREBY RESOLVED, that the Pittsylvania County Board of
Supervisors requests the Virginia General Assembly to call a special session to consider
rescinding the special fees on abusive drivers in that the application to Virginia residents
only appears to be an unconstitutional act wherein a number of other states that have
abusive driving laws have these civil fines applying both to instate and out of state
drivers; and

BE IT FUTHER RESOLVED, that the Board of Supervisors request a copy of
this resolution be forwarded to the delegates representing Pittsylvania County, the
Speaker of the House, and the Governor of the Commonwealth of Virginia.
