RESOLUTION
2007-02-16
WHEREAS, HB-3202 and SB-1101 are current bills before the General
Assembly of the Commonwealth of Virginia, proposing to transfer the responsibility for
new subdivision street maintenance to Counties or Homeowners Associations; and
WHEREAS,.. Pittsylvania County supports the provision for requiring growing
Counties to identify urban development areas requiring restriction and planning toward
the necessary public infrastructure saving both state and local funds; and
WHEREAS, the current proposals for both the House and the Senate will place a
potential of new cost on Local Governments, by referencing that all new subdivision
streets will become the maintenance responsibility of Counties or Homeowners
Associations; and
NOW, THEREFORE, BE IT RESOLVED, that the Pittsylvania County Board
of Supervisors vigorously opposes the unfunded mandate of forcing Counties to accept
maintenance on new subdivision streets, and providing an avenue for the establishment of
private roads in localities to be maintained by Homeowner Associations which present
long term problems for both the Citizens and the County; and
BE IT FURTHER RESOLVED, that the Board of Supervisors requires a copy
of this resolution to be forwarded to the Conferees of the General Assembly concerning
the bills referenced herein.
