David M. Smitherman, County Administrator, called the meeting to order at 5:00 p.m. The following members were present: Tim R. Barber Joe B. Davis Ronald S. Scearce Charles H. Miller, Jr. Ben L. After a Moment of Silence, Mr. Smitherman led the Pledge of Allegiance. Approval of Agenda Motion was made by Mr. Blackstock, seconded by Mr. Barber, to approve the agenda which was unanimously approved by the Board. Re -Organization of the Board: Election of Chairman Mr. Smitherman explained that under the By-laws adopted at the January 2017 Re - organizational Meeting, nominations for Chairman and Vice -Chairman required both a nomination and a second; that votes will be taken in the order the nominations were made; and that it takes four votes, the majority of the board, in order to select a Chairman. He further read the responsibilities of the Chairman, as per named in the Board's By-laws. Mr. Smitherman opened the floor for nominations for Chairman of the Board of Supervisors for 2018. Nomination was made by Mr. Barber, seconded by Mr. Davis, for Mr. Robert W. "Bob" Warren as Chairman. No other nominations were made. Motion was then made by Mr. Barber, seconded by Mr. Davis, to close the nominations for Chairman, which was unanimously approved by the Board. The Board then voted unanimously to elect Robert W. "Bob" Warren as Chairman of the Board of Supervisors for 2018. Mr. Smitherman then turned the meeting over to Mr. Warren as the newly elected Chairman for the Board. Packet Pg. 5 Re -Organization Meeting January 4, 2018 Election of Vice -Chairman Nomination was made by Mr. Davis, seconded by Mr. Barber, for Ronald S. Scearce as Vice -Chairman. No other nominations were made. Motion was then made by Mr. Barber, seconded by Mr. Davis, to close the nominations for Chairman, which was unanimously approved by the Board. The Board voted on Mr. Davis' nomination of Ronald Scearce for Vice - Chairman, which was approved unanimously by the Board. Ronald S. Scearce was elected as Vice -Chair of the Board of Supervisors for 2018 By Laws and Rules of Order Motion was made by Mr. Blackstock seconded by Mr. Davis, to approve the Board of Supervisors' By -Laws, which was unanimously approved by the Board. Smitherman, Clerk Pittsylvania County Board of Supervisors Packet Pg. 12 8.a.c Board of Supervisors Work Session January 16, 2018 Pittsylvania County Board of Supervisors Work Session January 16, 2018 VIRGINIA: The Work Session of the Pittsylvania County Board of Supervisors began at 4:30 PM on Monday, January 16, 2018 in the Main Conference Room of the County Administration Building located at 1 Center Street in Chatham, Virginia. The following members were present: Tim R. Barber Tunstall District Joe B. Davis Dan River District Ronald S. Scearce Westover District Charles H. Miller, Jr. Banister District Ben L. Farmer Callands-Gretna District Elton W. Blackstock, Jr. Staunton River District Robert W. Warren Chatham -Blairs District Mr. David M. Smitherman, County Administrator and Clerk of the Board; Mr. J. Vaden Hunt, County Attorney; Mr. Greg L. Sides, Assistant County Administrator for Planning & Administration, Mr. Richard Hicks, Assistant County Administrator for Operations, Ms. Kim Van Der Hyde, Director of Finance, and Ms. Rebecca Flippen, Deputy Clerk were also present. Approval of Agenda Motion was made by Mr. Blackstock, seconded by Mr. Barber to approve the agenda with the added item, which was unanimously approved by the Board. News Business The Board concluded the discussion began during the Finance Committee with Christopher Kulp, Financial Counsel with Hunton & Williams, LLP, discussed the Lease revenue Bond Financing Approval Resolution 2018-01-02, which approved a plan to finance certain County projects through the issuance of lease revenue bonds by the Industrial Development Authority. The Honorable Vincent Shorter, Treasurer for Pittsylvania County, met with the Board of Supervisors to discuss a proposed change to permanently move the tax due dates from June 5'k and December 5' to June 10' and December 10`k. The reason Mr. Shorter asked the Board to consider this was due to the high volume of work activities in his office at the first and ends of the month, one being DMV stops. Compounded on the work related to the DMV stops is the end -of -month balances. Mr. Shorter felt it would not only help him but also help the citizens. After discussion, the Board asked Mr. Shorter if it would be beneficial to his office to move the bi-annual tax due dates even further, to June 20' and December 201. Mr. Shorter agreed those dates would be good for the citizens, and his office as well. The consensus of the Board would Packet Pg. 13 Board of Supervisors Work Session January 16, 2018 be, at their Business Meeting following this Work Session, to authorize staff to advertise the required public hearing to make this proposed amendment to the County Code. At 5:00 PM, the Board was scheduled to begin training on new software for conducting electronic board meetings. However, due to unforeseen problems that could not be resolved by the host company within the allotted training time, the training had to be re -scheduled for a future date. Shields Courthouse Addition, the following Resolution was presented and adopted: WHEREAS, Robert Mills, Jr. is a Pittsylvania County resident and owner of Briar View Fane, a 2,244 acre fanning operation based in Callands, Virginia. Robert and his wife, Cynthia, are the proud parents of two sons, Logan and Holden Mills, both accomplished in agriculture and actively involved in the fanning business; and WHEREAS, on July 31, 2017 Robert Mills, Jr. was named the Sunbelt Ag Expo Virginia Farmer of the Year. News Business Lease Revenue Bond Financing Approval Resolution 2018-01-02 8.a.d Packet Pg. 18 Board of Supervisors Busiaess Meting January 16, 2018 S.a.d Ms. Van Der Hyde, Finance Director for Pittsylvania County, explained Pittsylvania County Board of Supervisors approved the award of the Master Lease Financing Program Proposal to BB&T, as well as a Reimbursement Resolution at their December 19, 2017 Board meeting. Ms. Van Der Hyde said the Board would need to consider approving the attached Resolution (Resolution #2018-01-02) to continue to proceed with closing on the Master Lease Financing Program. Attached are the documents from last month's meeting explaining this financing. Closing is scheduled to occur on/or before January 30, 2018. Since this financing requires approval from the Industrial Development Authority, they will pass a similar Resolution at their meeting that will be held on Thursday, January 18, 2018 at 6 pm. Chris Kulp, Bond Counsel with Hunton and Williams, was at the Finance Committee meeting/Work Session earlier answer any legal questions the Board had concerning this financing. Ms. Van Der Hyde said the bonds would be used for financing (A) the acquisition and installation of landfill equipment, (B) the acquisition and installation of a centrifugal water-cooled chiller for the courthouse building and (C) the acquisition, renovation and equipping of an existing building to convert it for public =' library purposes (collectively, the "2018A Project") and (ii) the acquisition and upfit of an industrial facility in the Ringgold area. Their would be a changing in wording, at the Board's o request, on "(A)", to say Solid Waste improvements. Mr. Blackstock's motion was unanimously 77 .. approved by the Board. m RESOLTUION #2018-01-02 RESOLUTION APPROVING A PLAN TO FINANCE CERTAIN COUNTY PROJECTS THROUGH THE ISSUANCE OF LEASE REVENUE BONDS BY THE INDUSTRIAL DEVELOPMENT AUTHORITY OF PITTSYLVANIA COUNTY, VIRGINIA WHEREAS, the Industrial Development Authority of Pittsylvania County, Virginia (the "Authority"), was created under and is authorized to exercise all the powers set forth in the Industrial Development and Revenue Bond Act, Title 15.2, Chapter 49, Code of Virginia of 1950, as amended (the "Act"), which include, among other things, the powers (a) to make loans to, among others, a county in furtherance of the Act, (b) to finance facilities and lease facilities for use by, among others, a county, (c) to issue its revenue bonds, notes and other obligations from time to time for such purposes and (d) to pledge all or any part of its revenues and receipts derived from payments received by the Authority in connection with its loans or from the leasing by the Authority of such facilities or from any source as security for the payment of principal of and interest on any such obligations; WHEREAS, the Authority previously issued and sold its $2,900,000 Lease Revenue and Refunding Bond (County Government Project), Series 2006 (the "2006 Bond"), to Branch Banking and Trust Company (the "Bank") and loaned the proceeds thereof to Pittsylvania County, Virginia (the "County"), to (a) refinance the construction of a health department and social services building (the "Original Project"), and (b) finance the expansion of and improvements to the Original Project (as expanded and improved, the "Project"); WHEREAS, as security for the repayment of the 2006 Bond, the Authority entered into (a) a Ground Lease dated as of April 1, 2006 (the "Original Ground Lease"), with the County, Packet Pg. 19 Board of supervisors Business Meeting January 16, 2018 pursuant to which the County leased to the Authority the Project and the related real estate (collectively, the "Leased Property"), and (b) a Lease Agreement dated as of April 1, 2006 (the "Original Lease Agreement"), with the County, pursuant to which the Authority leased back to the County the Leased Property in exchange for which the County undertook to make rental payments sufficient to cover the annual debt service on the 2006 Bond and other related financing costs; WHEREAS, the County will request the Authority to issue two series of lease revenue bonds (as hereinafter described, the "2018A Bond" and the "2018B Bond") and use the proceeds thereof to (a) finance (i)(A) the acquisition and installation of landfill equipment, (B) the acquisition and installation of a centrifugal water-cooled chiller for the courthouse building and (C) the acquisition, renovation and equipping of an existing building to convert it for public library purposes (collectively, the "2018A Project") and (ii) the acquisition and upfit of an industrial facility in the Ringgold area (the "2018B Project" and, together with the 2018A Project, the "2018 Projects") and (b) pay the related costs of issuance; WHEREAS, the County proposes that the Authority issue and sell the 2018A Bond and the 2018B Bond (together, the "2018 Bonds") to the Bank pursuant to a Bond Purchase Agreement between the Authority, the County and the Bank (the "2018 Purchase Agreement") and secure the 2018 Bonds on a parity basis with the 2006 Bond by amending the various lease financing documents described below; WHEREAS, there have been made available prior to this meeting drafts of the following documents (collectively, the "Documents") providing for the issuance and sale of the 2018 Bonds, copies of which shall be filed with the records of the County: (a) 2018 Purchase Agreement providing for the sale of the 2018 Bonds and including the forms of the 2018 Bonds; (b) First Amendment to Ground Lease (the "First Amendment to Ground Lease"), amending the Original Ground Lease (as amended, the "Amended Ground Lease"), between the Authority and the County, conveying to the Authority a leasehold interest in the Leased Property; (c) First Amendment to Lease Agreement (the "First Amendment to Lease S.a.d Agreement"), amending the Original Lease Agreement (as amended, the o "Amended Lease Agreement"), between the Authority and the County, leasing the Leased Property back to the County in exchange for certain rental payments; 0 (d) First Amendment to Assignment of Rents and Leases (the "First Amendment to d Assignment"), amending the Assignment of Rents and Leases dated as of April 1, s 2006, each made by the Authority for the benefit of the Bank and consented to by the County, assigning to the Bank certain rights of the Authority under the Amended Ground Lease and the Amended Lease Agreement; and (e) First Amendment to Deed of Trust and Security Agreement (the "First Amendment to Deed of Trust"), amending the Deed of Trust and Security Agreement dated as of April 1, 2006, each made by the Authority for the benefit of BB&T-VA Collateral Service (the "Deed of Trust Trustee"), granting the Deed of Trust Trustee a lien on the Authority's leasehold rights in the Leased Property; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF PITTSYLVANIA, VIRGINIA: Packet Pg. 20 Board of Supervisors Business Meeting January 16, 2018 The County Board of Supervisors (the "County Board") hereby approves, and requests that the Authority approve, the following plan of finance for the 2018 Projects: (a) the Authority shall (i) issue the 2018A Bond in a principal amount not to exceed $1,850,000 and loan the proceeds thereof to the County to finance the 2018A Project and (ii) issue the 2018B Bond in a principal amount not to exceed $1,100,000 and use the proceeds thereof to the County to finance the 2018B Project, (b) the County will lease the Leased Property to the Authority pursuant to the terms of the Amended Ground Lease, with an expiration not later than December 31, 2029, and (c) the Authority will lease the Leased Property back to the County pursuant to the terms of the Amended Lease Agreement, with an expiration not later than December 31, 2029. Pursuant to the Amended Lease Agreement, the County will undertake to make certain payments of Basic Rent and Additional Rent (each term as defined in the Amended Lease Agreement) to the Authority in amounts sufficient to amortize the 2018 Bonds and the outstanding portion of the 2006 Bond, to pay the fees and expenses of the Authority and to pay certain other related costs. The obligation of the Authority to pay principal of and premium, if any, and interest on the 2018 Bonds will be limited to payments of Basic Rent and certain Additional Rent received from the County. The 2018 Bonds will be secured on a parity with the outstanding portion of the 2006 Bond by an assignment of the payments of Basic Rent and certain Additional Rent due under the Amended Lease Agreement, all for the benefit of the holders of the 2018 Bonds and the 2006 Bond. The undertaking by the County to make payments of Basic Rent and Additional Rent will be subject to the appropriation by the County Board from time to time of sufficient amounts for such purposes. Upon an event of default or an event of non -appropriation by the County Board under the Amended Lease Agreement, the Authority shall have the right to exercise any remedies provided in the Amended Lease Agreement, including the right to terminate the Amended Lease Agreement and exclude the County from possession of the Leased Property for the remainder of the term of the Amended Ground Lease. This plan of finance shall contain such additional requirements and provisions as the County Administrator (which term for purposes of this Resolution includes any Assistant County Administrator) and the Chairman or Vice Chairman of the Authority may approve and determine to be in the best interests of the County and the Authority. The County Board believes that funds sufficient to make payment of all amounts payable under the Amended Lease Agreement can be obtained. The County Board, while recognizing that it is not empowered to make any binding commitment to make appropriations beyond the current fiscal year, hereby states its intent to make appropriations in future fiscal years in amounts sufficient to make all payments due under the Amended Lease Agreement and hereby recommends that future County Boards do likewise during the term of the Amended Lease Agreement. The County Administrator is hereby authorized and directed to execute the Documents to which the County is a signatory, which shall be in substantially the forms made available prior to this meeting, which are hereby approved, with such completions, omissions, insertions and changes not inconsistent with this Resolution as may be approved by the County Administrator, the execution and delivery thereof to constitute conclusive evidence of his approval of any such completions, omissions, insertions and changes. The County Attorney is hereby authorized to cause the First Amendment to Ground Lease, the First Amendment to Lease Agreement, the First Amendment to Assignment, the First Amendment to Deed of Trust and any other documents as are necessary to be recorded in the Clerk's Office of the Circuit Court of Pittsylvania County. In making completions to the Amended Lease Agreement, the County Administrator, in collaboration with PFM Financial Advisors LLC, the County's financial advisor (the "Financial 8.a.d Packet Pg. 21 Board of Supervisors Business Meeting January 16, 2018 Advisor"), and the Authority, shall provide for payments of Basic Rent in amounts equivalent to the payments due on the outstanding portion of the 2006 Bond and the 2018 Bonds, which shall be sold to the Bank pursuant to the terms and conditions of the 2018 Purchase Agreement; provided that (a) the payments of Basic Rent allocable to the 2018A Bond shall be equivalent thereto and shall (i) mature in installments ending not later than December 31, 2028, (ii) bear interest at an annual rate not to exceed 3.59% (subject to adjustment as provided in the 2018 Purchase Agreement), (iii) be subject to optional prepayment at a premium not to exceed 1.00% of the principal amount to be prepaid and (iv) be sold to the Bank at a price not less than 100% of the principal amount thereof (without taking into account any original issue discount or premium) and (b) the payments of Basic Rent allocable to the 2018B Bond shall be equivalent thereto and shall (i) mature in installments ending not later than December 31, 2029, (ii) bear interest at an annual rate not to exceed 4.39%, (iii) be subject to optional prepayment at a premium not to exceed 1.00% of the principal amount to be prepaid and (iv) be sold to the Bank at a price not less than 100% of the principal amount thereof (without taking into account any original issue discount or premium). The County Administrator is also authorized to approve maturity schedules for the 2018 Bonds. The County covenants that it shall not take or omit to take any action the taking or omission of which shall cause the 2018A Bond to be an "arbitrage bond" within the meaning of Section 148 of the Internal Revenue Code of 1986, as amended (the "Code"), and regulations thereunder, or otherwise cause interest on the 2018A Bond to be includable in the gross income for federal income tax purposes of the registered owner thereof under existing law. Without limiting the generality of the foregoing, the County shall comply with any provision of law that may require the County at any time to rebate to the United States of America any part of the earnings derived from the investment of the gross proceeds of the 2018A Bond. The County shall pay from its legally available general funds any amount required to be rebated to the United States of America pursuant to the Code. The County covenants that during the term of the Amended Lease Agreement it shall not permit the proceeds of the 2018A Bond or the facilities financed therewith to be used in any manner that would result in (a) 10% or more of such proceeds or facilities being used in a trade or business carried on by any person other than a governmental unit, as provided in Section 141(b) of the Code, provided that no more than 5% of such proceeds may be used in a trade or business unrelated to the County's use of such facilities, (b) 5% or more of such proceeds or facilities being used with respect to any "output facility" (other than a facility for the furnishing of water), within the meaning of Section 141(b)(4) of the Code, or (c) 5% or more of such proceeds being used directly or indirectly to make or finance loans to any persons other than a governmental unit, as provided in Section 141(c) of the Code; provided, however, that if the County receives an opinion of nationally recognized bond counsel that any such covenants need not be complied with to prevent the interest on the 2018A Bond from being includable in the gross income for federal income tax purposes of the holder thereof under existing law, the County need not comply with such covenants. Such officers of the County as may be requested by bond counsel for the County are authorized and directed to execute an appropriate certificate setting forth (a) the expected use and investment of the proceeds of the Amended Lease Agreement allocable to the 2018A Bond in order to show that such expected use and investment will not violate the provisions of Section 148 of the Code and (b) any elections such officers deem desirable regarding rebate of earnings to the United States for purposes of complying with Section 148 of the Code. The County having not previously issued in calendar year 2018 any federally tax-exempt obligations (excluding for this purpose "private activity bonds," within the meaning of Section 141 of the Code, other than "qualified 501(c)(3) bonds," within the meaning of Section 145 of the Code) that are required to be aggregated with any federally tax-exempt obligations issued by the Authority for purposes of Section 265(b)(3) of the Code, and the County and all its subordinate issuing entities or authorities (including the Authority) not reasonably expecting to issue in calendar year 2018 any other such obligations that, when aggregated with the 2018A Bond, will be in excess of $10,000,000, the County hereby requests the Authority designate the 2018A Bond as a "qualified tax-exempt obligation" under Section 265(b)(3) of the Code. All costs and expenses in connection with the financing of the 2018 Projects and the issuance of the 2018 Bonds, including the Authority's fees and expenses and the fees and expenses of bond counsel and the Financial Advisor in connection with the sale of the 2018 Bonds, shall be paid from the proceeds of the 2018 Bonds or other legally available funds of the County. The Sheriffs Department has collected a total of $7,090.00 for this year's Trunk or Treat Event. MATTERS FROM WORK SESSION At the Board's Work Session held earlier this same date, the Honorable Vincent Shorter, Treasurer for Pittsylvania County, met with the Board of Supervisors to discuss a proposed change to permanently move the tax due dates from June 5' and December 5d' to June 10's and December 10`s. The reason Mr. Shorter asked the Board to consider this was due to the high volume of work activities in his office at the first and ends of the month, one being DMV stops. Compounded on the work related to the DMV stops is the end -of -month balances. Mr. Shorter felt it would not only help him but also help the citizens. After discussion, the Board asked Mr. Shorter if it would be beneficial to his office to move the bi-annual tax due dates even further, to June 20s' and December 20'. Mr. Shorter agreed those dates would be good for the citizens, and his office as well. The consensus of the Board would be, at their Business Meeting following this Work Session, to authorize staff to advertise the required public hearing to make this proposed amendment to the County Code. Mr. Blackstock also reminded everyone to keep the Lois Byrd family in their prayers. Ms. Byrd, wife of Chatham Town Mayor, Roy Byrd, perished in a house fire. Mr. Scearced reminded everyone the Friends of the National Rifle Association's annual banquet was coming up and tickets were still available. Funds collected from this event helped sponsor the Boys and Girls Club. Mr. Farmer thanked Mr. Hagerman, his predecessor, for all his contributions and efforts on the Board. A brief synopsis of HB 222 is the intent is to establish an income tax modification for companies that, from 2018 through 2028, either (i) invest at least $5 million in new capital investment in a qualified locality and create at least 10 jobs in a qualified locality or (ii) create at least 50 jobs in a qualified locality. Such companies are exempt from withholding for their employees that reside in a qualified locality. The bill defines qualified locality to include (i) the Counties of Bland, Buchanan, Dickenson, Lee, Russell, Scott, Smyth, Tazewell, and Wise or the Cities of Bristol and Norton, (ii) the Counties of Grayson, Henry, Halifax, or Pittsylvania or the Cities of Danville, Galax, or Martinsville, and (iii) the City of Petersburg. Rezoning from A-1 to M-1 in Case R-18-003 does not conform to the County Comprehensive Plan and would result in spot zoning. The A-1 property was originally used as a residence. A detached structure was built for business purposes and used as a ']tonic business" out of compliance with the Zoning Ordinance as it never met the criteria for classification as a home business. The business grew and became industrial in nature. Rather than move the industry. which does not conform to the Comprehensive Plan and has existed out of compliance with the Zoning_Ordinancc , the Property owners are seeking a rezoning to remedy the existing violation. Zoning, a method of implementing the goals of the Comprehensive Plan, was not designed to be a tool used to circumvent the Ordinance. The Zoning Ordinance unmistakable states of M-1: "This district is limited to commercial establishments, retail and wholesale, and light manufacturing on and off the premises all of which may have outside storage of materials and outside displays of product for sale Use of an M -I property as a residence rohibited by the ZoningOrdinance , It is unclear why the property owners chose a rezoning rather than seek a variance through the Board of Zoning Appeals. What is clear is that a recommendation for M-1 for Case R-18-003_would not conform with the Comprehensive Plan and would subiect t neighboring orooert owners to excessive traffic noise And environmental health risks. For each calendar year, the tax levied on Tax Levy as identified in Section 6.1.1 situated in the County shall be due and payable in two (2) equal installments, the first (1 st) installment being due and payable on June 205th of each calendar year, except the Year 2012 which has a due date of July 16, 2012 for the 2012 year only, and the second (2m) instalhnent being due and payable on December 205th of each calendar year. The owner of any real estate meeting the criteria set forth in §58.1-3229 through 58.1-3244 of the Code of Virginia may, on or before November one prior to the year for which such taxation is sought, apply to the Commissioner of the Revenue for the classification, assessment and taxation of such property for the next succeeding tax year on the basis of its use, under the procedures set forth in § 58.1-3229 through 58.1-3244 of the Code of Virginia. Such application shall be on forms provided by the State Department of Taxation and supplied by the Commissioner of Revenue and shall include such additional schedules, photographs, and drawings as may be required by the Commissioner of Revenue. An individual who is the owner of an undivided interest in a parcel may apply on behalf of himself and the other owners of such parcel upon submitting an affidavit that such other owners are minors or cannot be located. A separate application shall be filed for each parcel on the land book. Any person wishing to voluntarily remove their land from land use taxation is hereby permitted to so do without assessment of roll -back taxes as long as the use or acreage does not change such to preclude qualification for land use taxation, or the zoning of the real estate is not changed to a more intensive use at the request of the owner or his agent, for the next five (5) years following the withdrawal of the property from land use taxation and the reimposition of fair market taxation. However, if within the five (5) year following the withdrawal of the real property from land use taxation and the initiation of fair market taxation, if said parcel of land is altered to nonqualifying use or the acreage is reduced such to make the property nonqualifying or the property is rezoned to a more intensive use at the request of the land owner or his agent, the property shall then be assessed the appropriate roll -back taxes from the date of nonqualifying. If the property voluntarily withdrawn from land use taxation is subject to an acreage change by the owner, then only that portion which no longer would qualify had the property remained in land use taxation be subject to roll -back taxes and interest as provided in this Chapter. The taking of real estate which is being valued, assessed and taxed under this ordinance by right of eminent domain shall not subject the real estate so taken to the roll -back taxes herein opposed. This Oerdinance shall become effective immediately upon adoption. SEC. 36-2. ASSESSMENT FOR LAW LIBRARY AS PART OF COSTS IN CIVIL ACTIONS A. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF PITTSYLVANIA COUNTY, IN REGULAR SESSION AND ACTING PURSUANT TO SECTION 42.1-70 OF THE CODE OF VIRGINIA, 1950, AS AMENDED, that there shall be a fee of four ($4.00) assessed as part of the cost incident to each civil action filed in the General District Court of Pittsylvania County and the Circuit Court of Pittsylvania County. On civil appeals from General District Court to the Circuit Court an additional filing fee shall be taxed as part of the cost for the appeal. B. The fee herein established shall be collected by the Clerk of the Court in which the action is filed and remitted to the Treasurer of Pittsylvania County, Virginia, and held by such Treasurer, subject to disbursement by the Board of Supervisors of Pittsylvania County, for the acquisition of law books, periodicals, computer research services and equipment for the Law Library. C. This ordinance shall become effective September 8, 1992, for each civil case filed then or thereafter. SEC. 36-3. COURTHOUSE SECURITY FEES. A. In accordance with the 2007 Session of the General Assembly of Virginia Senate enacted Bill 693 as Chapter 756 of the Acts of Assembly, which is codified as an amendment to Section 53.1- 120 of the Code of Virginia, 1950 as amended. This Act provides that any County may assess a sum not in excess of ten (10) dollars as a part of the costs in each criminal or traffic case in its Juvenile & Domestic Relations Court, General District Court or Circuit Court in which the defendant is convicted of a violation of any statute or ordinance, to fund its courthouse security personnel. B. NOW THEREFORE, it is hereby ordained that in this County of Pittsylvania on and after July 1, 2007 a fee of ten (10) dollars is hereby and shall be assessed as part of the cost against each defendant for each conviction or violation of a statute or ordinance which shall be collected Packet Pg. 130 9.A.4.a by the Clerk of the Court with other cost. The Clerk shall remit the fees to the Treasurer of this County. The Treasurer shall hold such funds subject to appropriation by this board in a special fund for courthouse security personnel. In accordance with the 2002 session of the General Assembly enacted Senate Bill 406 as Chapter 840 of the Acts of Assembly which is codified as Section 15.2-1613.1 of the Code of Virginia, 1950, as amended which provides that any County by ordinance may authorize a processing fee, not to exceed twenty-five ($25.00) dollars, on any individual admitted to County, city or regional jail following conviction. The fund so collected shall be used by the County sheriffs office to defray the costs of processing arrested persons into local or regional jails. B. NOW THEREFORE, be it ordained that on and after July 1, 2002 a processing fee of twenty five ($25.00) dollars is hereby assessed and imposed upon any individual admitted to a County, city or regional jail following conviction within the County of Pittsylvania of a crime, misdemeanor or violation of a local ordinance of the County of Pittsylvania or any town located within this County. Said fees shall be assessed by the Clerk of the Court of the Court in which the conviction occurred, with the other cost of the court proceedings and deposited with the Treasurer of this County and shall be used by the sheriff of this County to defray the cost of processing the convicted arrested persons into the local or regional jail. The Board of Supervisors shall be expressly authorized, via resolution, to establish recreation a gate fees for entry and attendance of any and all County Parks and Recreation run, sponsored, or affiliated recreation games and contests within the County's jurisdiction. A copy of the adopted o fee schedule shall be posted in or at the recreational facility at points where such fees are to be collected. ; B. The primary goal is to reduce injury and prevent death among high-risk populations. In 2005, Congress reauthorized funding for FP&S and expanded the eligible uses of funds to include Firefighter Safety Research and Development. The Fire Marshal's Office is requesting to apply to this grant in order to hire two Deputy Fire Marshals. These positions will be funded for a one year period with the option to request an extension. This grant will pay for the hiring and training costs associated for two (2) positions. Grant application period is 02/12/2018 and closes on March 16, 2018. FINANCIAL IMPACT AND FUNDING SOURCE: The grant requests will be in the amount of $269,322.00. Of this amount a local match of 5% (13,466.10) will be required in total for two years or $6,733.05 per year. This is a non-binding grant, however, one year renewal extension is allowed however not guaranteed. If awarded, grant program will not start until FYI 8/19. These funds will support local emergency,management programs with an emphasis Mass casualty equipment or supplies. However, any such amendment which exceeds one percent of the total expenditures shown in the currently adopted budget must be accomplished by publishing a notice of a meeting and a public hearing once in a newspaper having general circulation in that locality at least seven days prior to the meeting date." This public hearing will be advertised in the Star Tribune on March 7, 2018, which will satisfy the 7 - day requirement in order to have this public hearing on March 20, 2018. FINANCIAL IMPACT AND FUNDING SOURCE: The Board of Supervisors approved a resolution to secure financing through a Master Lease Financing Program at their January 16, 2018 meeting. The County successfully closed on this financing in the total amount of $2,883,000 on January 30, 2018. This refinancing is to cover tax-exempt projects totaling $1,755,000 and a taxable project totaling $1,050,000. Closing costs have also been included in the financing. As such, these funds need to be appropriated to the FY 2018 budget in order to cover the costs outlined in the financing. A copy of the public hearing advertisement is attached for your review. Milling has accepted a position as Executive Director for The Arc of Virginia and will begin her new duties on Jan. 1. "We are grateful for Tonya's service to The Arc of Southside and are sad to see her go;" Dan Hayes, chair of The Arc's Board, said. "We are, however, excited that she will now be leading The Arc's efforts at the statewide level. This appointment is a testament to Tonya's leadership and passion for creating 'A Life Like Yours' for people with developmental disabilities" Thanks to Milling's leadership The Arc of Southside is recognized as one of the state's most progressive in its service to people with developmental disabilities. Under Milling's direction The Arc of Southside moved from a centralized campus in Blairs to a service model that allows the community to benefit from the many skills and gifts that people with developmental disabilities have to offer. It also allows people with developmental disabilities to have more choice and control in shaping their lives. This evolution began in 2011 and positioned The Arc of Southside ahead of the wave of change that was to come in Virginia's disability service system. Southside residents, who previously were only given the option of sheltered employment in a program designed only for people with developmental disabilities, are now able to obtain work in the community. People who previously lived in a group home operated by The Arc of Southside continue to be supported by staff of The Arc but now each have their own homes. Students in The Arc of Southside's White Oak School are prepared to enter the public school system. Finally, area residents who had limited access to a full social life are now becoming fully engaged within their community in the ways that they choose. As a result of the success of these new programs, agencies from across the Commonwealth continue to seek consultation with The Arc of Southside to learn how to offer individualized supports in innovative ways that give people a real life. "I'm grateful to The Arc of Southside and this community for embracing these changes, and I look forward to supporting The Arc at the statewide level," Milling said. "I know this region will continue to be innovative and continue to be a leader in helping people create lives filled with meaningful work, a comfortable home and friends to share it with."
