05-05-2015 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING May 5, 2015 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, May 5, 2015, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Stowe called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Weatherford, seconded by Mr. Arthur, and by a 5 to 0 vote (3 members were absent), the April 7, 2015, minutes were approved as presented. CHAIRMAN ’S REPORT There was no Chairman’s report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:02 p.m. Case 1, Brenda T. Hudgins , R-15-011 – Mr. Stowe opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that Brenda Hudgins had petitioned to rezone 1.26 acres, located on State Road 848/Riley Farm Road, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to RC-1, Residential Combined Subdivision District to allow for placement of a second dwelling, a 1995 single-wide mobile home, on the property for her personal residence. Ms. Hudgins’ son, Greg Hudgins, was present to represent the petition. He stated he had nothing to add. Following questioning from one of the Board members, Mr. Hudgins stated his mother’s single-wide mobile home would be placed at the other end of the parcel and a driveway would be located in the middle of the parcel, allowing access to both dwellings. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:03 p.m. During the discussion, it was stated this parcel is consistent, there are more mobile homes in the area than houses, Planning Commission May 5, 2015 Page 2 and this is a rural area. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to RC-1, Residential Combined Subdivision District. Motion passed by a 5 to 0 vote (3 members were absent). Case 2, Arlene D. Cundiff , R-15-012 – Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that Arlene Cundiff had petitioned to rezone 3.15 acres, located on State Road 903/Galveston Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to B-1, Business District, Limited to allow for restoration of a second dwelling, an old farmhouse, located on the property. Arlene Cundiff was present to represent the petition. She stated she wanted to resurrect an old farmhouse on the property and be allowed to have a total of two (2) houses on the same parcel of land. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:05 p.m. During the discussion, it was stated this parcel is surrounded by properties zoned A-1, Agricultural District. A motion was made by Ms. Mease, seconded by Mr. Hagerman, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed by a 5 to 0 vote (3 members were absent). Case 3, Clifton W. Parrish & Jean L. Parrish , R-15-013 – Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that Clifton and Jean Parrish had petitioned to rezone a parcel of land with no size on file in the Commissioner of Revenue’s office, located on U.S. Highway 58/Martinsville Highway, in the Westover Election District from A-1, Agricultural District to B-2, Business District to make the zoning consistent with the adjacent parcels of land zoned B-2 and to bring the property into compliance with its current use, a flea market. Henry Sasser was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:07 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from A-1, Agricultural District to B-2, Business District, General. Motion passed by a 5 to 0 vote (3 members were absent). Case 4, Betty D. Dudley Estate, C. Melvin Dudley, Executor , R-15-014 – Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that Betty D. Dudley Estate, C. Melvin Dudley, Executor, had petitioned to rezone the A-1, Agricultural District portion of 1.13 acres (0.22 acre), located on State Road 638/Roark Mill Road, in the Staunton River Election District to R-1, Residential Suburban Subdivision District to make the zoning consistent and to combine with the adjacent parcels of land zoned R-1. Melvin Dudley was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m. A motion was made by Mr. Arthur, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the A-1, Agricultural District portion of the property to R-1, Residential Suburban Subdivision District. Motion passed by a 5 to 0 vote (3 members were absent). Case 5, Ted A. Waller & Doris B. Waller , R-15-015 – Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported that Ted and Doris Waller had petitioned to rezone 10.22 acres, located on State Road 940/Owens Mill Road, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to allow for subdivision of the property. Ted Waller was present to represent the petition. He stated he had nothing to add. Following questioning from one of the Board members, Mr. Waller stated his plans were to sell the home located on the property in the future. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:12 p.m. A motion was made by Mr. Arthur, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed by a 5 to 0 vote (3 members were absent). This concludes the Rezoning cases. OLD BUSINESS There was no old business. Planning Commission May 5, 2015 Page 3 NEW BUSINESS Mr. Shelton presented the Board members with a letter from Jeffrey Scott Crider, requesting permission to resubmit applications for a Special Use Permit and a Variance for a dog kennel to be heard in the July Cycle. Mr. Shelton further explained both cases (Case S-15-002 and V-15-001) were denied by the Board of Zoning Appeals in March, 2015, and Mr. Crider desired to be relieved of the 12 month penalty required before resubmitting his applications. A motion was made by Mr. Weatherford, seconded by Mr. Hagerman, that the petitioner’s request be granted. Motion passed by a 5 to 0 vote (3 members were absent). Mr. Shelton reminded the Board members that the Joint Setback Meeting for the Board of Supervisors and Planning Commission will be held on Monday, June 1, 2015, at 5:00 p.m. in the General District Courtroom regarding setback issues. He also stated the meeting will last approximately 40-45 minutes. Mr. Shelton provided an update on Mr. Richard Motley and Mr. Larry Welborn’s health conditions, and he informed the Board members a card was sent to both gentlemen on behalf of the Planning Commission.
