05-06-2014 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING May 6, 2014 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, May 6, 2014, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Stowe called the roll. Miller, Jr. Banister District David Weatherford Westover District HEARING OF THE CITIZENS No citizens came forward to speak. APPROVAL OF THE MINUTES A motion was made by Mr. Arthur, seconded by Mr. Motley, and by a 6 to 2 vote (2 members were absent), the April 1, 2014, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m. Case 1, Guy L. Ferguson & Layne C. Ferguson, R-14-017 – Mr. Stowe opened the public hearing at 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported that Guy and Layne Ferguson had petitioned to rezone 70.25 acres, located off State Road 935/Farmers Mountain Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use – horses and a stable/barn. Guy Ferguson was present to represent the petition. He stated the property is 70.25 acres is landlocked with no road frontage and there are two (2) adjacent properties that have cattle and horses. He also stated the prospective buyer of this property desires to build a fence and a barn for her three (3) horses and there would be no mobile homes on the property. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:06 p.m. A motion was made by Ms. Mease, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed by a 6 to 0 vote (2 members were absent). Planning Commission May 6, 2014 Page 2 Case 2, Adam A. Cobb & April B. Cobb, R-14-018 – Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Adam and April Cobb had petitioned to rezone a total of 15.00 acres, two (2) parcels of land, located on State Road 686/Markham Road, in the Banister Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use – chickens, goats, and honeybees. Adam Cobb was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:08 p.m. During the discussion, it was stated the petitioned parcels are completely surrounded by A-1, Agricultural District properties. A motion was made by Mr. Motley, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone the properties from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed by a 6 to 0 vote (2 members were absent). This concludes the Rezoning cases. Case S-1, Smith Mountain Dock & Lodge, LLC, S-14-005 – Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Smith Mountain Dock & Lodge, LLC, had petitioned for a Special Use Permit on a total of 8.82 acres, three (3) parcels of land, located on State Road 626/Smith Mountain Road, in the Callands-Gretna Election District for a campground. Mr. Shelton also stated a site development plan was mailed to the Board members. Dean Hawkins was present to represent the petition. He stated that the wording of proffered condition #18 was changed slightly since the Board of Supervisors meeting held on March 18, 2014, and this change was approved by the County Attorney. He also stated he would answer any questions from the Board members. Mollie Holmes spoke in opposition to the petition. She stated it was her understanding at the Board of Supervisors meeting the proffer was changed so that in the event the campground ceases and desists operation, the zoning would automatically revert back to the zoning prior to the rezoning process (RPD, Residential Planned Unit Development District). Mr. Hawkins then stated the zoning would not automatically be reversed, but the owner would be required to apply for a reversion of the then current zoning back to RPD, Residential Planned Unit Development District. Mr. Shelton stated he had the wording of proffer condition #18 changed - the intent was the same, and only the wording was changed. Ms. Holmes then voiced her concerns as to how she and her neighbors could be reassured the properties would not be sold for another use such as an automobile graveyard. Mr. Hawkins offered a rebuttal and stated as written in proffered condition #1, the only use for the petitioned parcels of land would be for a campground (private), and if another use was desired for the parcels, the owner would then have to repetition and go through another public hearing. Mr. Stowe closed the public hearing at 7:21 p.m. A motion was made by Ms. Mease, seconded by Mr. Motley, to recommend the Board of Zoning Appeals grant this Special Use Permit request. Motion passed by a 6 to 0 vote (2 members were absent). This concludes the Special Use Permit case. OLD BUSINESS There was no old business. NEW BUSINESS Mr. Sides distributed a memorandum from Mr. Otis Hawker, Interim County Administrator, stating the Board of Supervisors, at their meeting held on May 5, 2014, voted to send attached recommendations from the Joint Setback Study Subcommittee to the Pittsylvania County Planning Commission for a comprehensive review and once they were reviewed, the Planning Commission was instructed to forward the recommendations back to the Board of Supervisors. Mr. Sides then recommended the Planning Commission members look over and read the attachments and state their Planning Commission May 6, 2014 Page 3 issues, concerns and questions for discussion. He then stated the Planning Commission could have work study sessions or discuss the issues following the monthly Planning Commission meetings. Mr. Sides also stated once a recommendation is made by the Planning Commission, it will be reviewed by the County Attorney. Mr. Sides also stated the proposal is from the Agricultural Development Board and is not a staff recommendation.
