04-08-2014PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING April 8, 2014 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, April 8, 2014, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 7:00 p.m. The Board observed a few moments of silence. Mr. Shelton called the roll. PRESENT Kenneth Talbott Helen Glass Ronald Merricks Joseph "Jay" Craddock Carroll Yeaman Larry Estes R. Allan Easley Odie H. Shelton, Jr. APPROVAL OF THE MINUTES By motion of Mr. Merricks, seconded by Mr. Estes, and by unanimous vote the Minutes of the March 11, 2014, meeting were approved as presented. Old Business Mr. Shelton and the Board discussed private easements and right of ways and setbacks off of these easements and rights of way. After some discussion it was determined that private easement and rights of way would be treated as a property line and the applicable setbacks for front, side and rear property lines would apply. New Business Mr. Shelton reported on the case for the May 2014 Cycle. CHAIRMAN'S REPORT There was no Chairman's report. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:08 p.m. Case S -1. Earlie Boles and Cody Coxworth S- 14- 004 — Mr. Talbott opened the public hearing at approximately 7:10 p.m. Mr. Shelton, Director of Code Compliance /Zoning Administrator, reported Earlie Boles and Cody Coxworth had petitioned for a Special Use Permit on .53 of an acre, located on State Road 729 /Mount Tabor Road, in the Dan River Election District to allow for placement of a single -wide mobile home for a family member. He further stated the Planning Commission, with no opposition, recommended granting the petitioner's request. Christina Gibson was present to represent the petition and explained the reason for petition. No one was present to oppose or spoke in opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:12 p.m. The Board discussed Board of Zoning Appeals April 8, 2014 Page 2 the petition as the Committee of the Whole and determined there were no adverse effects. Upon motion of Mr. Merricks, seconded by Mr. Easley, the following motion was adopted: Whereas, Earlie Alexander Boles and Cody Lee Coxworth have petitioned the Board of Zoning Appeals for a Special Use Permit for placement of a single -wide mobile home for a family member and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted.
