09-09-2014PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING September 9, 2014 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, September 9, 2014, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 7:00 p.m. The Board observed a few moments of silence. Mr. Shelton called the roll. PRESENT Kenneth Talbott Helen Glass Joseph “Jay” Craddock Larry Estes Carroll Yeaman R. Allan Easley Ronald Merricks Odie H. Shelton, Jr. APPROVAL OF THE MINUTES By motion of Mr. Yeaman, seconded by Mr. Estes, and by a unanimous vote, the Minutes of the August 12, 2014, meeting were approved as presented. Old Business There was no old business. New Business Mr. Shelton reported on the case for the October 2014 Cycle. CHAIRMAN’S REPORT There was no Chairman’s report. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:01 p.m. Case S-1, Fred and Sylvia Curl, S-14-010 – Mr. Talbott opened the public hearing at approximately 7:02 p.m. Mr. Shelton, Director of Code Compliance/Zoning Administrator, reported Fred and Sylvia Curl had petitioned for a Special Use Permit on 2.34 acres, located on State Road 751/Grassland Drive, in the Callands-Gretna Election District for a dance hall. He further reported the Planning Commission, with no opposition, recommended granting the petitioners’ request. Mr. Curl stated this location was the Sandy Level Community Center and activities had been taking place there for the last couple of years. He stated there had been birthday parties, weddings and dances at this location and that the nature of the activities would not change. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:04 p.m. The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects. During the discussion, the Board stated there would be no change in the activities taking place at this location, the facility had been at this location for a long time, there were no issues with the facility and no complaints regarding noise. Upon motion of Mr. Easley, seconded by Mr. Merricks, the following motion was adopted: Whereas, Fred and Sylvia Curl, have petitioned the Board of Zoning Appeals for Board of Zoning Appeals September 9, 2015 Page 2 a Special Use Permit for a dance hall and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and, that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Vote was unanimous. Case S-2, Barbara Ann Warren, S-14-011 – Mr. Talbott opened the public hearing at approximately 7:05 p.m. Mr. Shelton, Director of Code Compliance/Zoning Administrator, reported Barbara Ann Warren had petitioned for a Special Use permit on 1.53 acres, located on State Road 726/Ringgold Depot Road, in the Dan River Election District to allow placement of a single-wide mobile home for her personal residence. He further reported the Planning Commission, with opposition, recommended denying the petitioner’s request. Barbara Ann Warren was present to represent the petition. Ms. Warren came forward and spoke regarding the petition. She stated she was not aware that she could not place a single wide home on the property when she purchased it and that she owned the home and that this home was all she could afford. She further stated she had talked to neighbors across the street and behind that street and they were not opposed to her placing the home on the property. (Ms. Warren had sent a petition signed by approximately 17 residents in support of her petition to the Code Compliance office prior to the meeting. This petition was distributed to the Board members at the meeting.) Ronald Ransom, Linda Preston and Tamara Poindexter spoke in opposition to the petition. Some of their concerns were: negative impact on property values and no single wide mobile homes in the immediate area. It was further stated they would like for this to be a homogenous area. Ms. Warren offered a rebuttal stating what she had stated previously regarding the property and the placement of the home. Mr. Talbott closed the public hearing at approximately 7:18 p.m. The Chairman explained the Special Use Permit process. The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects. During the discussion, the Board discussed the housing in the vicinity and immediate area. They further discussed the lot size under petition and that this was a rural area. The Board further stated they understood the concerns of the neighbors but that this was a 1.53 acre lot, a rural area, the home would not be crowded against another home and that people needed affordable housing. Upon motion of Mr. Merricks, seconded by Ms. Glass, the following motion was adopted: Whereas, Barbara Ann Warren, has petitioned the Board of Zoning Appeals for a Special Use Permit to allow placement of a single-wide mobile home for her personal residence and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and, that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Vote was unanimous. This concludes the Special Use Permit cases.
