Mr. Stowe, Chairman, called the meeting to order at approxixnately 7:00 p.m. Mr. Stowe called the roll. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at appro�mately 7:01 p.m. Case 8, Smith Mountain Dock & Lodge, LLC, R-14-011 (Conrinued From February 4 2014� — Mr. Stowe opened the public hearing at 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported that Smith Mountain Dock & Lodge, LLC, had petitioned to rezone a total of 8.82 acres, three parcels of land, located on State Road 626/Smith Mountain Road, in the Callands-Gretna Elecrion District from RPD, Residential Planned Unit Development District to A-1, Agricultural District for a future campground. Mr. Shelton also reported the Planning Coininission, with opposition, recommended the case be conrinued until more information regarding the case was received. Mr. Shelton then reported according to the Pittsylvania County Zoning Ordinance, Section 35-807, Subsection 2, after 60 davs, the Planning Commission shall be deemed to a��rove the amendment with a recommendation to the Board of Supervisors. Dean Hawkins was present to represent the petition. He stated this case was continued from last month and he had prepared some plans and notes so everyone would be familiar with the petitioner's request He then introduced Dennis Sparks, one of the members of the LLC and Todd and Donna Holcomb, on-site managers of the facility, to the Board members. Mr. Hawkins stated the properties were purchased in August, 2013. He then stated the mobile homes had been removed from the premises, Planning Coininission March 4, 2014 Page 2 and there was potential for a total of 39 recrearional vehicle (motor home) campground sites available. A total of 15 proposed proffers were presented to the Board members for their review. Mr. Hawkins also stated there would be field located septic boxes, paved roads, curbs and gutters on the premises. One of the Board members quesrioned Mr. Hawkins regarding the recreational chemical toilets. Mr. Hawkins explained the motor homes have chemical toilets and the on-site septic tanks would allow for emptying of the tanks. Ronald Stokes, James Lockerman, Harold Arthur, Mollie Holmes, Marsha Mutch, Ken Joyce, Julie Joyce, and Warren Price spoke in opposition to the peririon. Their concerns included, but were not limited to, the following: This campground site would be competition to the Smith Mountain Campground that is located nearby; high property taxes; spot zoning; negative impact on community; downgrade property quality; negative impact on future sales of property and county tax revenues; if the properties are rezoned to A-1, Agricultural District, the sites could be used for anything; high traffic; noise, pollution and debris. One of the individuals who spoke in opposition to the rezoning presented a petition containing 37 signatures and six (6) letters from individuals opposing the rezoning to the Board members for their review. Mr. Hawkins offered a rebuttal and addressed the concerns of each individual who spoke in opposition to the peririon, which included, but were not limited to, the following: if the site is never developed into a campground, the proffer states the peririoned parcels will be used for a campground alone and will not be conveyed to any other use allowed in an A-1, Agricultural District zoning designation; the proposed layout of the roads in the campground would provide for one-way roads, fifteen feet wide with a thirty degree angle, which would supply ample space for the motor homes; an entrance to the properties must be approved by Virginia Department of Transportation (VD01�; this is not spot zoning; a mobile home park is located across the highway. Mr. Stowe closed the public hearing at 8:04 p.m. During the discussion, it was stated this would be an enhancement to the area. It was also stated in the A-1 zoning designation, a campground is allowed with a Special Use Permit approved by the Board of Zoning Appeals. A morion was made by Mr. Hagerman, seconded by Ms. Mease, to recommend the Board of Supervisors deny the rezoning request; however, the motion failed with a tie vote. Those voting to deny the rezoning request were as follows: Mr. Hagerman, Ms. Mease, Mr. Arthur and Mr. Weatherford. Those voting to grant the rezoning request were as follows: Dr. Miller, Mr. Motley, Mr. Welborn and Mr. Stowe. Case 1, Kav Suzanne Geyer, R-14-013 — Mr. Stowe opened the public hearing at 8:17 p.m. Mr. Shelton, Director of Code Compliance, reported that Kay Suzanne Geyer had petitioned to rezone 4.981 acres, located on U.S. Highway 29 North, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General for a store for sale of hunting and fishing goods, pet supplies, etc. Kay Geyer and John Hunt were present to represent the petition. They stated they had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 8:18 p.m. A motion was made by Mr. Motley, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Morion passed unanimously. Case 2, JRa lY /Rayl Properties, R-14-014 — Mr. Stowe opened the public hearing at 8:20 p.m. Mr. Shelton, Director of Code Compliance, reported that JRayl/Rayl Properties had petitioned to rezone a total of 9.34 acres, three parcels of land, located on State Road 1140/Princeton Road, in the Westover Election District from R-1, Residential Suburban Subdivision District and B-2, Business District, General to M-2, Industrial District, Heavy Industry for a trucking terniinal. Mr. Shelton also reported the peritioner had submitted a proffer stating the 9.34 acres will not be used for any permitted uses, listed by right, under Secrion 35-402 that are not solely related to the trucking business. He also stated the petitioner had proffered any other uses, other than the uses permitted in M-2, Industrial District, Heavy Industry use will require a new perition with a Public Hearing and approval by the Board of Supervisors. In addirion, he stated the peritioner had also proffered should the trucking terminal cease operation, the peritioner would re-petition the Pittsylvania County Board of Supervisors to rezone the properties back to B-2, Business District, General. Rodney Poole was present to represent the petition. He stated he had nothing to add except the business had grown and was expanding its operations, which would lead to more jobs. Alfrieta Bennett and James Price, Jr., spoke in opposition to the petition. Their concerns included, but were not limited to, the following: Narrow roads in the neighborhood; concerns regarding ingress and egress of the properties; noise, traffic, and decrease in property values. Mr. Stowe closed the public hearing at 8:31 p.m. A motion was made by Mr. Weatherford, seconded by Mr. Hagerman, to recommend the Board of Supervisors deny the rezoning request due to lack of information regarding ingress and egress of the petitioned parcels. Motion passed unanimously. Planning Coininission March 4, 2014 Page 3 Case 3, Peek-A-View Farm, LLC, R-14-015 — Mr. Stowe opened the public hearing at 8:33 p.m. Mr. Shelton, Director of Code Compliance, reparted that Peek-A-View Farm, LLC, had petitioned to rezone 56.35 acres, located on State Road 634/Blue Ridge Drive, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use. Marion Reth was present to represent the petition. She stated she had nothing to add except that she owns cows. William E. Davis and Martel Talley? spoke regarding the petition. They were not in opposition to the rezoning, but stated their concerns were regarding Ms. Reth's chickens that were destroying their gardens. Ms. Reth stated she would take care of the problem with her chickens and move them to another spot. Mr. Stowe closed the public hearing at 8:36 p.m. A motion was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Case S-1, Shannon Renee Brooks, S-14-003 — Mr. Motley opened the public hearing at 8:37 p.m. Mr. Shelton, Director of Code Compliance, reported that Shannon Renee Brooks had peritioned for a Special Use Permit on 5.10 acres, located on State Road 1129/Cedar Ridge Road, in the Tunstall Election District for a commercial garage. Blount, V-14-001- Mr. Stowe opened the public hearing at 8:40 p.m. Mr. Shelton, Director of Code Compliance, repoxted that Edward and Leigh Blount had petitioned foY a Variance on 10.09 acYes, located on State Road 796/Steam Way, in the Chatham-Blairs Election District to Section 35-182. Minimum Yard Dimensions. (B.) Side Setback, of the Pittsylvania County Zoning Oxdinance requesting a variance of 25 feet to allow for construcrion of a pole barn within ten feet of the road right-of-way. Edward Blount was present to xepresent the peririon. He stated he had nothing to add except due to the rolling topography of the land, he needed more room for the pole barn. He also stated the pole barn would be located beside the barn located on the property. There was no opposition to the petition.
