10/01/2013PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING October 1, 2013 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, Octobex 1, 2013, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approxirnately 7:00 p.m. MY. Stowe called the roll. PRESENT Morxis Stowe Richard Motley Janet Mease Dr. Charles H. APPROVAL OF THE MINUTES Tunstall District Chatham-Blairs District Callands-Gretna District Banister District Staunton River District WestoveY District Dan River District Board of Supervisors Representative Director of Code Compliance/Zoning Admuustrator Assistant County Adininistrator/Director of Planning A motion was made by Mr. Modey, seconded by Mr. Arthur, and by a unanixnous (8 to 0) vote, the September 5, 2013, minutes were approved as presented. CHAIRMAN'S REPORT There was no Chairman's Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approxirriately 7:01 p.m. Planning Commission October 1, 2013 Page 2 Case 1, Timber Creek Properties, LLC, R-13-052 — Mr. Stowe opened the public hearing at 7:01 p.m. Mr. Shelton, Director of Code Compliance, repoYted that Timber Creek Propexties, LLC, had petitioned to rezone 2.45 acres and 0.75 acre, to make the zoning consistent with the adjacent parcel of land zoned A-1. He also stated both parcels axe located on State Road 1526/Astin Lane, in the Westover Election District. Donald Merricks was present to represent the petirion. He stated he had nothing to add except that one parcel had no road frontage, the other parcel was double-zoned and he just wanted to make the zoning consistent. TheYe was no opposirion to the perition. Mr. Stowe closed the public hearing at 7:02 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from R-1, Residenrial Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously by an 8 to 0 vote. Case 2,Jovice B. Wilson, R-13-053 — Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code Compliance, Yeported that Joyce B. Wilson had petitioned to Yezone 6.81 acres, located on State Road 841 /Whispering Pines Road, in the Tunstall Election District from R-1, Residenrial Suburban Subdivision District to A-1, AgricultuYal District to allow for placement of a second dwelling, a single-wide mobile home, for her grandson's residence. Joyce Wilson was present to represent the petirion. She stated she had nothing to add. Warxen Mustain spoke in opposirion to the perition. His concerns included, but were not limited to, the following: He stated one mobile home on the property was switched out, was left in the field, and it was an eyesore; he did not want a third mobile home on the property because it would look like a mobile home paxk; he was also upset about all the noise in the aYea due to the dogs barking, etc., and he just wanted peace and quiet. MYS. Wilson offexed a rebuttal and stated that one of the mobile homes had been replaced and had been removed from the propeYry. She also stated that only one mobile home is cuxrently located on the petirioned paxcel of land. Mr. Stowe closed the public hearing at 7:11 p.m. During the discussion, it was stated this is consistent with the area. A morion was made by Mr. Modey, seconded by Ms. Mease, to recommend the BoaYd of SupervisoYS rezone the property from R-1, Residenrial Suburban Subdivision District to A-1, Agricultural District. Morion passed unanimously by an 8 to 0 vote. Case 3, Ralph D. Echols, R-13-054 — Mr. Stowe opened the public hearing at 7:13 p.m. Mr. Shelton, Director of Code Compliance, reported that Ralph Echols had petitioned to rezone 23.74 acres, located on State Road 872/Vandola Church Road, in the Westover Election District fxom R-1, Residential Suburban Subdivision District to A-1, Agricultural District to subdivide the paYCel for family members. Mr. Shelton also stated that Mr. Echols had proffered that all deeds pertaining to the petitioned parcel would have a xestriction prohibiting placement of single-wide mobile homes, to satisfy the concerns of adjacent property owners and neighbors. Mr. Shelton then stated that should the Board decide to grant the rezoning, he requested that the BoaYd member making the morion include the proffer. Caroline Echols was present to represent the petirion. She stated she had nothing to add. There was no opposirion to the petition. Mr. Stowe closed the public hearing at 7:14 p.m. During the discussion, it was stated the property is a well-kept, very nice area. A motion was made by Mr. Weatherford, seconded by Mr. Motley, to xecommend the Board of Supervisors rezone the pxoperty from R-1, Residential Suburban Subdivision District to A-1, Agricultural District with proffer as submitted. Motion passed unanimously by an 8 to 0 vote. Case 4, Larry Thomas Burnett, �, R-13-055 - Mr. Stowe opened the public hearing at 7:15 p.m. Mr. Shelton, Director of Code Compliance, reported that Larry Thomas Burnett, Jr., had petirioned to rezone 2.06 acres, located on Cavalier Road, in the Dan River Elecrion District from R-1, Residential Suburban Subdivision District to A-1, Agxicultural District to make the zoning consistent with the adjacent parcel of land zoned A-1. No one was present to represent the petition, and Mx. Shelton stated he would answer any questions from the Board members. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:16 p.m. A motion was made by Mr. Welborn, seconded by Mr. ArthuY, to recommend the Board of Supervisors rezone the Planning Commission October 1, 2013 Page 3 property fYOm R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously by an 8 to 0 vote. Case 5,�Teffre� B. Hill & Kathy_Jo Hill, R-13-056 - Mx. Stowe opened the public hearing at 7:17 p.m. Mr. Shelton, Director of Code Compliance, reported that Jeffrey and Kathy Hill had peririoned to xezone 14.41 acres, located on State Road 629/Piney GYOVe Road, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, AgricultuYal Disttict to allow for placement of a second dwelling, a single-wide mobile home, for his mother's residence. Jeffrey Hill was present to represent the peririon. There was no opposirion to the peririon. Mr. Stowe closed the public hearing at 7:18 p.m. A motion was made by Mr. Arthur, seconded by Mx. Welborn, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District Motion passed unanimously by an 8 to 0 vote.
