09/05/2013PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING Thursday, September 5, 2013 MINUTES VIRGINIA: The Pittsylvania County Planning Cominission met on Thursday, September 5, 2013, in the General District Courtroom, Chatham, Virginia. Mx. Stowe, Chairman, called the meeting to order at approxunately 7:00 p.m. Mx. Stowe called the roll. PRESENT Morris Stowe RichaYd Motley Janet Mease Dr. Charles H. APPROVAL OF THE MINUTES Westover District Dan River District A motion was made by Mr. Modey, seconded by Mr. Arthur, and by a 6 to 0 vote (two members were absent), the August 8, 2013, minutes were approved as presented. A morion was then made by Mr. Motley, seconded by Ms. Mease, and by a 6 to 0 vote (two members wexe absent), the revised minutes of the July 2, 2013, meeting were approved as presented. CHAIRMAN'S REPORT There was no Chairman's Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approxixriately 7:03 p.m. Planning Commission September 5, 2013 Page 2 Case 1, Horace B. Dykes, R-13-048 — Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Directox of Code Compliance, reported that Horace Dykes had petitioned to xezone 8.85 acres, located on Highway 40/W. Gxetna Road, in the Callands-Gretna Elecrion District fxom R-1, Residenrial Suburban Subdivision District to A-1, Agricultural District for agricultural use (horses). Horace Dykes was present to represent the petirion. He stated he had nothing to add except he felt that he had lost a sale for his property because the prospecrive buyex could not have a horse. There was no opposirion to the petirion. Mr. Stowe closed the public heaxing at 7:05 p.m. During the discussion, it was stated the parcel of land is adjacent to agricultural properries and there was no opposirion to the petition. A motion was made by Ms. Mease, seconded by Mr. Modey, to recommend the Board of Supervisors rezone the properry from R-1, Residential Suburban Subdivision District to A-1, Agxicultural District. Morion passed by a 6 to 0 vote (two members were absent). Case 2 Spencer W. Walker & Angela W. Walker, R-13-049 — Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Directox of Code Compliance, reported that Spencer and Angela Walker had peritioned to rezone 8.510 acYes (part of 13.09 acres), located on State Road 1800/Wyatt Drive, in the Westovex Elecrion District from B-2, Business District, General to R-1, Residential Suburban Subdivision District to allow for construction of a single family dwelling for their son. Spencer Walker was present to Yepresent the petirion. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:08 p.m. During the discussion, it was stated that Mx. Weatherford had called Mr. Modey and said there was no opposirion to the petirion. A motion was made by Mr. Motley, seconded by Dr. Miller, to recommend the BoaYd of Supervisors rezone the propexty from B-2, Business District, General to R-1, Residential Suburban Subdivision District. Motion passed by a 6 to 0 vote (two members were absent). Case 3, Herman Eugene Crane, Life TenanttJean Crane Wilson, Remainderman, Herman Eugene Crane, Jr., Remainderman, Kenneth Ray Crane, Remainderman, Claude David Crane, Remainderman, R-13-050 — Mr. Stowe opened the public heaxing at 7:09 p.m. Mr. Shelton, Ditector of Code Compliance, reported that HeYman Eugene Crane and Others had petitioned to rezone 11.20 acres, located off State Road 744/Crane Road, in the Chatham-Blairs Election District from R-1, Residenrial Suburban Subdivision District to A-1, Agricultural District to allow for placement of a 1979 single-wide mobile home on the property for Mr. Crane's residence. Raymond Crane was present to represent the petition. He stated he had nothing to add. James W. Hutcherson spoke in opposition to the petition. His main concern was that this property would be turned into a mobile home court since one single-wide mobile home was already located on the property. Mr. Stowe then stated the property would not be turned into a mobile home court. Mr. Stowe closed the public hearing at 7:12 p.m. During the discussion, it was stated the property is surrounded by A-1, Agricultuxal District zoned properries and the mobile home will be located behind a storage builcling and cannot be seen from the road. A motion was made by Mr. Modey, seconded by Mr. ArthuY, to Yecommend the Board of Supervisors rezone the property from R-1, Residenrial Suburban Subdivision District to A-1, Agricultural District. Motion passed by a 6 to 0 vote (two members were absent). Case 4, Robert T. Marshall. Sr., Et Als, Robert T. Marshall, Jr., Et Als, Phyllis S Marshall, Et Als, R-13- 051- Mx. Stowe called the public hearing at 7:14 p.m. Mr. Shelton, Directox of Code Compliance, reported that Robert T. Marshall, Sr., and Others had petitioned to rezone 13.60 acres, located on U.S. Highway 58 West/Martinsville Highway, in the Tunstall Elecrion District from R-1, Residenrial Suburban Subdivision District to RMF, Residential Multi-Family District for a twelve (12) unit apartment building. Phyllis Marshall was present to xepresent the peririon. She stated she had nothing to add. Following questions from the Board members, Ms. Marshall stated the Site Development Plan submitted with this rezoning application was the same site plan submitted with a previous rezoning case (Case R-13-039) due to the high fee charged by the surveyor. She also stated should the rezoning be approved, a new site plan would be provided. She stated no Highway Planning Cominission September 5, 2013 Page 3 Entrance Permit had been submitted yet, and this was also pending appxoval of the rezoning case by the Boaxd of Supervisors. She stated stoxm water management would be the same as pYesented with a previous rezoning case for apartments located on Highway 41 (Case R-13-039). In addirion, Ms. Maxshall stated a fence could be erected, a playground could be built at the site, and an off-site easement on Whispering Pines Road could be provided. A letter in opposition to the perition written by an adjacent parcel owner was presented to the Board members. Mr. Stowe closed the public hearing at 7:22 p.m. During the discussion, it was stated the Board's recommendarion was due to a Site Development Plan and a Highway Entxance Permit from VDOT not being submitted with the applicarion foY Yezoning. A morion was made by Mr. Motley (on behalf of Mr. Stowe), seconded by Mr. Arthur, to recommend the Board of Supervisors deny this rezoning request. Motion passed by a 6 to 0 vote (two members were absent). This concludes the Rezoning cases. OLD BUSINESS There was no old business. NEW BUSINESS A site plan review for a proposed telecommunications toweY to be located at 244 Oakland Road, Danville, Virginia, was pYesented to the Boaxd members for their approval. Mr. Shelton stated a cell tower is a permitted use in propeYty zoned M-1, Industrial DistYict, Light Industry, and if the Board had no quesrions and the site plan was approved as presented, then a building permit would be issued. A motion was made by MY. Modey, seconded by Ms. Mease, that the site plan be approved and accepted. Motion passed by a 6 to 0 vote (two members were absent). Mr. Sides and Mr. Shelton then briefed the Planning Coinmission membeYS on a special committee to be appointed to look at agricultural setbacks. The cominittee will consist of Greg Sides, Odie Shelton, Vaden Hunt, Fred Wydner, three (3) Planning Coininission members, three (3) Board of Zoning Appeals member, and two (2) developeYS.
