Minimum Yard Dunensions, (B.) Side Setback, of the Pittsylvania County Zoning OTdinance xequesting a variance of 11.3 feet to allow fox construction of an axtached gaxage. Mazcie Cobble was present to xepxesent the petirion. She stated she had notified her neighboxs of her plans, and thexe was no opposirion to this. She also stated she felt the garage would enhance her properry. One of the Boaxd membexs stated his concern that if this cariance was granted, it would open the door fox futuxe variances ro be allowed in the area. Mx. James Lockexman spokc in favor of construction of [he garage, and he stated there are othex homes in the axea with gaxages. TheTe was no opposition to the petition. :�1r. Motley, to recommend the Soard of Loning Appeals grant this Vaxiance. Moaon passed unanimously. This concludes the Variance case. OLD BUSINESS Thexe was no old business. NEW BUSINESS Gxeg Sides, Assistant Counry Admiiiistratox, presented two (2) Conservation Easement Request summaries fox the Boaxd's xeview. Mr. Sides also stated the pxoperries must be consistent with the Pittsylvania County CompTehensive Plan. The first case pxesenred was a 185 acxe paxcel of land owned by Coleman Lawrence, Sx., a family woxking faxm, compxised of xolling topogxaphy along a bend in the I3anister Rivex. This pxopexty is used to graze xace horses, for wheat and hay collecaon and has previously been used for commexcial tunbering and hoxse boaxding. "1'he Consexvation Easement texms include, but axe not limited to, the following: No subdivision of the propertv is allowed; the propexry can be put in land use, but must meet the standard land use requ�ements; one dwclling is allowed on the property. The pxoperty drains to Stsaightstone Cxeek, a tributary to the Roanoke River and is adjacent to othex Conservarion Lasement pTOpernes. The Conseroadon Easemcnt texms include, but axe not limited tq the following: Two subdicisions (three paxcels) axe allowed on the pxopexty; five (5) dwellings are allowed. The Lien holdex fox this pxoperty is Fust Bank and Trust Company, and D4T. Sides stated the bank must give their approval in ordex for the Conservanon Easement request to be gxanted. Sides then held a ciiscussion xegarding zoning designation fox truning. He stated as an example, in �1-1, Agricultural Distxict, mining is allowed with a Special Use Permit. The Special Use Pexmit pxocess would incolve the Planning Commission and the Boaxd of Zoning Appeals; howecer, the I3oard of Supervisoxs would not be incolved in this pTOCess, and several of the Board members had concexns about this, especially incolving something as potenually disruptive as mining. F'ollowing the discussion, a morion was made by b1x. Hagexman, seconded by Dx. Nliller, to have the legal and planning staff bring back suggestive language to be used in the Zoning Ordinance on mining before the Planning Conunission. Motion passed unanunously.
