04/03/2012 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING April 3, 2012 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, April 3, 2012, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Stowe called the roll. Mr. Harville and Mr. Motley recognized Mrs. Brenda Bowman, Board of Supervisors Representative for the Chatham-Blairs District, who was in attendance at the meeting. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Mr. Harville, and by unanimous vote the March 6, 2012, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately 7:02 p.m. Planning Commission April 3, 2012 Page 2 Case 1, Christopher George Doss, R-12-012. Mr. Stowe opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that Christopher Doss had petitioned to rezone 0.43 acre (part of 0.94 acre), located on State Road 676/Taylors Mill Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to combine with the adjoining parcel, GPIN # 2439-27-3878, zoned A-1. Chris Doss was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:03 p.m. During the discussion, it was stated this is consistent with the Comprehensive Plan. A motion was made by Ms. Mease, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 2, Joseph C. Heath, R-12-013. Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that Joseph Heath had petitioned to rezone a total of 17.88 acres, more or less, three parcels of land, located on State Road 612/Banister Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use (horses and a horse stable). Joseph Heath was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:05 p.m. During the discussion, it was stated this is consistent with the Comprehensive Plan. A motion was made by Ms. Mease, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 3, MMB Properties, LLC, R-12-014. Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that MMB Properties, LLC, had petitioned to rezone 1.20 acre, located on Cherokee Circle, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjacent parcels of land. Doug Dalton was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:07 p.m. During the discussion, it was stated this is definitely consistent with the Comprehensive Plan. A motion was made by Ms. Mease, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 4, Christopher M. Robinson, R-12-015. Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that Christopher Robinson had petitioned to rezone a parcel of land (no size on Commissioner of Revenue’s records), located on State Road 947/Mountain Hill Road, in the Dan River Election District from DZ (R-1, Residential Suburban Subdivision District and B-2, Business District, General) to RMF, Residential Multi-Family District for three (3) apartments in the existing structure. Christopher Robinson was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m. During the discussion, it was stated there are concerns regarding this case and these are still unusual circumstances. A motion was made by Mr. Welborn, seconded by Dr. Miller, to recommend the Board of Supervisors rezone the property from DZ (R-1, Residential Suburban Subdivision District and B-2, Business District, General) to RMF, Residential Multi-Family District. Motion passed unanimously. Case 5, Dorothy Myers, R-12-016. Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported that Dorothy Myers had petitioned to rezone 1.01 acre, located on State Road 839/Waller Lane, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjoining parcels of land. Eleanora Jones was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. Case 6, Jonathan Carroll Rigney, Et Als, Stewart Justin McGann, Et Als & Eric Kevin Dickey, Et Als, R-12-017. Mr. Stowe opened the public hearing at 7:12 p.m. Mr. Shelton, Director of Code Compliance, reported that Jonathan Carroll Rigney and Others had petitioned to rezone 20.19 acres, located off State Road 799/Climax Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District for future subdivision of the property for family members. Justin McGann was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:13 p.m. During the discussion, it was stated this parcel of land has no state-maintained road frontage for the family members. A motion was made by Ms. Mease, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously. This concludes the Rezoning Cases. Case S-1, James Leon Robertson & Deborah Maxine Robertson, S-12-004. Mr. Stowe opened the public hearing at 7:14 p.m. Mr. Shelton, Director of Code Compliance, reported that James Leon Robertson and Deborah Maxine Robertson had petitioned for a Special Use Permit on 0.69 acre, located on State Road 608/Ridgeway Road, in the Callands-Gretna Election District for placement of a single-wide mobile home for their son’s residence. Shanna Unrue was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:15 p.m. During the discussion, it was stated there are numerous mobile homes in the area. A motion was made by Ms. Mease, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. Case S-2, Wilford Grayson Huffman, Jr., S-12-005. Mr. Stowe opened the public hearing at 7:16 p.m. Mr. Shelton, Director of Code Compliance, reported that Wilford Grayson Huffrman, Jr., had petitioned for a Special Use Permit on 1.98 acre, located on State Road 665/Rockford School Road, in the Staunton River Election District for placement of a single-wide mobile home for Robert Daniel’s son’s personal residence. Robert Daniel was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:17 p.m. During the discussion, it was stated there was an old mobile home on the property and this is being replaced with a 1997 model single-wide mobile home. A motion was made by Mr. Arthur, seconded by Mr. Harville, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. This concludes the Special Use Permit cases. OLD BUSINESS There was no old business. Planning Commission April 3, 2012 Page 4 NEW BUSINESS Mr. Shelton reported on the Site Development Plan for the Family Dollar to be located on Highway 41 beside Norris Funeral Home. He stated the property is already zoned B-2, Business District, General. Mark Johnson with LE&D Professionals, PC, presented the Board members with handouts of the proposed site plan for the store. Mr. Johnson stated that LE&D will make minor changes to the entrance angle. He also stated that the Virginia Department of Transportation (VDOT) has changed their entrance regulations and the site currently has 30 feet of pavement for an entrance and this will be widened to 40 feet to accommodate the tractor trailers. During the discussion, it was stated this is a good idea and will generate a lot of business. Upon motion of Mr. Motley, seconded by Mr. Arthur, the Board made a recommendation that the site plan for the new Family Dollar on Highway 41 be approved subject to VDOT’s new standards.
