01/10/2012PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING January 10, 2012 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, January 10, 2012, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 7:00 p.m. Mr. Easley gave the invocation. Mr. Shelton called the roll. PRESENT Kenneth Talbott R. Allan Easley Larry Estes Mrs. Helen Glass Carroll Yeaman H. Blair Reynolds Ronald Merricks Odie H. Shelton, Jr. APPROVAL OF THE MINUTES By motion of Mr. Reynolds, seconded by Mr. Estes, and by unanimous vote the Minutes of the December 13, 2011, meeting were approved as presented. Old Business There was no old business. New Business Mr. Shelton reported there were no cases for the February 2012 cycle. CHAIRMAN’S REPORT There was no Chairman’s report. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:00 p.m. Case S-1, Moncie E. Mease, II, S-12-001 – Mr. Talbott opened the public hearing at approximately 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported Moncie E. Mease, II, had petitioned for a Special Use Permit on a 100 x 100 foot (10,000 square feet) compound, part of 144 acres, more or less, located on Route 40/West Gretna Road in the Calllands-Gretna Election District, for a 195 foot telecommunications tower, lattice design, with equipment shelter for Verizon Wireless. Mr. Shelton further reported the Planning Commission, with no opposition, recommended granting the petitioner’s request. Ms. Lori Schweller, attorney for Verizon Wireless, was present to represent the petition. She gave some specifics regarding the service area and stated Verizon is licensed for three (3) different technologies, PCS, Cell and LTE. The tower would contain twelve (12) antennas and four (4) antennas for each technology. She also stated this tower supports all objectives in the Comprehensive Plan. She also confirmed this was a lattice design, not monopole. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:06 p.m. The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects. During the discussion, it was stated this tower would be on approximately 144 acres. Upon motion of Mr. Reynolds, seconded by Mr. Easley, the following motion was adopted: Whereas, Moncie Mease, II, has petitioned the Board of Zoning Appeals for a Special Use Permit for a 195 foot telecommunications tower, lattice design, with equipment shelter for Verizon Wireless and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous. Case S-2, James and Angela Chalmers, S-12-002 – Mr. Talbott opened the public hearing at approximately 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported James and Angela Chalmers had petitioned for a Special Use Permit on a 100 x 100 foot (10,000 square feet) compound, part of 23.03 acres, located off State Road 1431/Neighborhood Road, in the Banister Election District, for a 300 foot telecommunications tower, self-support design, with equipment shelter for Verizon Wireless. Mr. Shelton further reported the Planning Commission, with opposition, recommended granting the petitioners’ request. Ms. Lori Schweller, attorney for Verizon Wireless, was present to represent the petition. Stephen Waller was also present to represent the petition. Ms. Schweller stated some specifics regarding the application. She also stated this tower supports all objectives in the Comprehensive Plan. Ms. Schweller also stated this property was surrounded by undeveloped parcels but there was a landscaping plan to buffer the tower. She then stated this tower would be lighted. Mr. Waller discussed some specifics regarding the lighting of the tower and stated that Verizon would be willing to work with the County on any lighting issues. He further stated the tower had been approved by the FAA with their input. Mr. Talbott closed the public hearing at approximately 7:13 p.m. The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects that could not be mitigated through conditions. Upon motion of Mr. Merricks, seconded by Mr. Reynolds, the following motion was adopted: Whereas, James and Angela Chalmers have petitioned the Board of Zoning Appeals for a Special Use Permit for a 300 foot telecommunications tower, self-support design, with equipment shelter for Verizon Wireless and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, and Whereas adverse effects can be mitigated through conditions, I move the Special Use Permit be granted. Motion passed unanimous. This concludes the Special Use Cases.
