10/11/2011PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING October 11, 2011 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, October 11, 2011, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 7:00 p.m. Mr. Easley gave the invocation. Ms. Hayes called the roll. PRESENT Kenneth Talbott R. Allan Easley Larry Estes Mrs. Helen Glass Carroll Yeaman H. Blair Reynolds Karen Hayes, Deputy Zoning Administrator ABSENT Ronald Merricks Odie H. Shelton, Jr. APPROVAL OF THE MINUTES By motion of Mr. Estes, seconded by Mr. Yeaman, and by unanimous vote the Minutes of the September 13, 2011, meeting were approved as presented. Old Business There was no old business. New Business Ms. Hayes reported on the cases for the November cycle. CHAIRMAN’S REPORT There was no Chairman’s report. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:00 p.m. Case S-1, Riceville Wildlife Management, S-11-012 – Mr. Talbott opened the public hearing at approximately 7:01 p.m. Ms. Hayes, Deputy Zoning Administrator, reported Riceville Wildlife Management, Inc., had petitioned for a Special Use Permit on 2.54 acres, located on McDaniel Road, in the Banister Election District, for construction of a 24 x 32 (768 square feet) building for a hunting clubhouse and storage building. Ms. Hayes further reported the Planning Commission, with no opposition, recommended granting the petitioner’s request. Mr. Beale was present to represent the petition. He stated Riceville Wildlife Management, Inc., was just going through the proper channels for the construction of their building and they had been looking for property for some years to construct the clubhouse. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:02 p.m. The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects. During the discussion, it was stated this was a good location for this facility. Upon motion of Mr. Reynolds, seconded by Mr. Easley, the following motion was adopted: Whereas, Riceville Wildlife Management, Inc., has petitioned the Board of Zoning Appeals for a Special Use Permit for construction of a 24 x 32 (768 square feet) building for a hunting clubhouse and storage building and, Whereas, we find no substantial detriment to adjacent property, that the character of the Board of Zoning Appeals Page 2 October 11, 2011 zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous. Case S-2, Carolyn Bahr and Charles Sidney Cook, S-11-013 – Mr. Talbott opened the public hearing at approximately 7:04 p.m. Ms. Hayes, Deputy Zoning Administrator, reported Carolyn Bahr and Charles Cook had petitioned for a Special Use Permit on 47.87 acres, located on Tomahawk Mill Road, in the Callands-Gretna Election District, for public power generation. Ms. Hayes further reported the Planning Commission, with opposition, recommended granting the petitioner’s request. Mr. Lee Abernathy with Protech Energy Systems was present to represent the petition. He read a letter from the property owners. Mr. Fred Ingram came forward and spoke regarding the petition. He stated he and the Planning Commission member for this district had received several calls regarding this petition. He further stated he had met with people in the area and they were very receptive to the petition. Mr. Ingram further stated some issues regarding Tomahawk Mill Road and Colony Road and stated Protech had promised to pave Tomahawk Mill and possibly Colony Road. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:11 p.m. The Board asked several questions of Mr. Abernathy. The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects. During the discussion the funding for this project, return on investment and the number of jobs to be created were discussed. Upon motion of Mr. Easley, seconded by Mr. Estes, the following motion was adopted: Whereas, Carolyn Bahr and Charles Sidney Cook have petitioned the Board of Zoning Appeals for a Special Use Permit for public power generation and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous. This concludes the Special Use Cases.
