10/04/2011 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING October 4, 2011 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, October 4, 2011, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Dr. Miller gave the invocation. Mr. Stowe called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Mr. Arthur, and by a unanimous vote the September 8, 2011, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:02 p.m. Planning Commission October 4, 2011 Page 2 Case 1, Don Roscoe Gauldin & Joanne Womack Gauldin, R-11-037. Mr. Stowe opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that Don and Joanne Gauldin had petitioned to rezone a total of 20.08 acres, six parcels, from MHP, Residential Manufactured Housing Park District to A-1, Agricultural District to allow for construction of a dwelling for their personal residence. Don Gauldin was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:03 p.m. During the discussion, it was stated that everyone is delighted that these properties have been sold and are being rezoned. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the properties from MHP, Residential Manufactured Housing Park District to A-1, Agricultural District. Motion passed unanimously. Case 2, Woodrow F. Hancock, Betty C. Hancock & Jason W. Hancock, R-11-038. Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that Woodrow F. Hancock and Others had petitioned to rezone a total of 10.37 acres, two parcels, from M-1, Industrial District, Light Industry, to M-2, Industrial District, Heavy Industry to obtain a license from the Department of Motor Vehicles (DMV) in order to buy salvage vehicles for resale. Mr. Shelton also reported that Mr. Hancock had submitted a proffer stating the following: (1) We proffer to the Pittsylvania County Board of Supervisors to not store any salvage cars on the petitioned properties to be rezoned. (2) Should we decide to store salvage cars on the properties under petition, we will provide a site plan approved by Pittsylvania County, complying with all local and State code requirements and develop according to site plan. Woodrow Hancock was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:06 p.m. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the properties from M-1, Industrial District, Light Industry to M-2, Industrial District, Heavy Industry with proffer. Motion passed unanimously. This concludes the Rezoning Cases. Case S-1, Riceville Wildlife Management, Inc., S-11-012. Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Riceville Wildlife Management, Inc., had petitioned for a Special Use Permit on 2.54 acres, located off State Road 702/McDaniel Road, in the Banister Election District for construction of a 24 x 32 (768 square feet) building for a hunting clubhouse and storage building. Kenneth Beale was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:08 p.m. A motion was made by Dr. Miller, seconded by Mr. Harville, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. Case S-2, A. Carolyn Bahr & Charles Sidney Cook , S-11-013. Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Carolyn Bahr and Charles Cook had petitioned for a Special Use Permit on 47.87 acres, located on State Road 783/Tomahawk Mill Road, in the Callands-Gretna Election District for public power generation. Lee Abernathy with Protech Energy Systems was present to represent the petition. He stated he had received several letters from adjacent property owners who were in favor of the petition. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:11 p.m. During the discussion, it was stated that this is a wonderful opportunity and will bring new jobs to the community. Mr. Abernathy was also praised for the presentation he had provided for the Board packet. A motion was made by Ms. Mease, seconded by Mr. Motley, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously. This concludes the Special Use Cases. Planning Commission September 8, 2011 Page 3 OLD BUSINESS There was no old business. NEW BUSINESS Mr. Shelton brought several areas of concern to the attention of the Board members, which included, but were not limited to, the following: (1) Deletion of Public Garages under Chapter 35, SEC. 35-223. SPECIAL USE PERMITS. of the Pittsylvania County Zoning Ordinance; and (2) Issues regarding salvage and storage of vehicles. Mr. Shelton stated that he will prepare a draft of the revisions for the Planning Commission to review at next month’s meeting.
