REGULAR MEETING

MINUTES
VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, March 8, 2011, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia.
Mr. Talbott called the meeting to order at approximately 7:00 p.m. Mr. Easley gave the invocation. Mr. Shelton called the roll.

APPROVAL OF THE MINUTES
By motion of Mr. Merricks, seconded by Mr. Yeaman, and by unanimous vote the Minutes of the February 8, 2011, meeting were approved as presented.
Old Business
There was no old business.
New Business
Mr. Shelton reported there would be no cases for the April cycle.
CHAIRMAN’S REPORT
There was no Chairman’s report.
THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at
approximately 7:01 p.m.
Case S-1, Richard L. Sowers, Jr., LLC, S-11-004 – Mr. Talbott opened the public hearing at approximately 7:03 p.m. Mr. Shelton, Director of Code Compliance, reported Richard L. Sowers
had petitioned for a Special Use Permit on 1.11 acres, located on State Road 730/Countryside Drive, in the Dan River Election District for a vehicle demolisher. Mr. Sowers was present
to represent the petition and explained he would be purchasing recreational vehicles and removing the parts that could be used to restore other recreational vehicles. He further stated
he lived next door to this property and would not be storing any junk on the property. This Special Use Permit would be required for State approval so that he could purchase from Copart.
There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:05 p.m. The Board discussed the petition as the Committee of

the Whole and determined that there were no adverse effects. Upon motion of Mr. Merricks, seconded by Ms. Glass, the following motion was adopted: Whereas, Richard L. Sowers, Jr.
has petitioned the Board of Zoning Appeals for a Special Use Permit for a salvage yard and, Whereas, we find no substantial detriment to adjacent property, that the character of the
zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed
unanimous.
Case S-2, David Calloway, S-11-005 – Mr. Talbott opened the public hearing at approximately 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported David Calloway had petitioned
for a Special Use Permit on 0.65 of an acre, located on State Road 832/Halifax Road, in the Banister Election District for placement of a single-wide mobile home for his personal residence.
Mr. Calloway was present to represent the petition and stated this home was for his residence. There was no opposition to the petition. Mr. Talbott closed the public hearing at
approximately 7:09 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. During the discussion it was stated there
are other mobile homes in the area. Upon motion of Mr. Easley, seconded by Mr. Yeaman, the following motion was adopted: Whereas, David Calloway has petitioned the Board of Zoning
Appeals for a Special Use Permit for a single-wide mobile home for his personal residence and, Whereas, we find no substantial detriment to adjacent property, that the character of the
zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed
unanimous.
Case S-3, Samuel Tarpley Adams, Jr. , Trustee, S-11-006 – Mr. Talbott opened the public hearing at approximately 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported Samuel
Tarpley Adams, Jr., Trustee, had petitioned for a Special Use Permit on 3.284 acres, located on State Road1044/Beechnut Road, in the Tunstall Election District for a salvage yard.
Mr. Adams was present to represent the petition. Mr. Adams stated he would buy and sell four wheeler parts and that anything related to this would be stored in a 40 x 40 building.
He further stated there would not be any outside storage. Mr. Adams also stated he lived in close proximity to the property. There was no opposition to the petition. Mr. Talbott
closed the public hearing at approximately 7:13 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of
Mr. Easley, seconded by Mr. Estes the following motion was adopted: Whereas, Samuel Tarpley Adams, Jr., Trustee has petitioned the Board of Zoning Appeals for a Special Use Permit for
a salvage yard and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in
harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous.
This concludes the Special Use Permit cases.
The meeting adjourned at approximately 7:14 p.m.
