MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, December 7, 2010, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting
to order at approximately 7:00 p.m. Mr. Stowe gave the invocation. Mr. Stowe called the roll.

No citizens came forward to speak.
APPROVAL OF THE MINUTES
A motion was made by Mr. Motley, seconded by Mr. Arthur, and by a unanimous vote the November 4, 2010, minutes were approved as presented.
CHAIRMAN’S REPORT
There was no Chairman’s Report.
Public Hearing – Amendments to the Pittsylvania County Zoning Ordinance and the Pittsylvania County Subdivision Ordinance as Advertised
Mr. Stowe opened the public hearing at approximately 7:00 p.m. Mr. Shelton reported on the advertised amendments to the Pittsylvania County Zoning Ordinance and the Pittsylvania County
Subdivision Ordinance for the addition of supplementary definitions. Mr. Stowe closed the public hearing at approximately 7:01 p.m. Upon motion of Mr. Motley, seconded by Mr. Welborn,
and by unanimous vote it was recommended that the supplementary definitions be presented to the Pittsylvania County Board of Supervisors for approval.

Case 1, Withdrawn, R-10-050.
Case 2, Richard L. Sowers, Jr., R-10-051. Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code Compliance, reported that Richard L. Sowers, Jr., had petitioned
to rezone 1.11 acres, located on State Road 730/Countryside Drive, in the Dan River Election District from B-2, Business District, General to M-2, Industrial District, Heavy Industry
(for a vehicle demolisher). Mr. Sowers was not present to represent the petition; however, Mr. Shelton stated that he would answer any questions from the Board members. There was no
opposition to the petition. During the discussion, it was stated that there are no homes around the petitioned property and that the area is very neat and it would be a benefit to the
county. Mr. Stowe closed the public hearing at 7:04 p.m. A motion was made by Mr. Welborn, seconded by Mr. Motley, to recommend the Board of Supervisors rezone this property from B-2,
Business District, General to M-2, Industrial District, Heavy Industry. Motion passed unanimous.
Case 3, Timothy R. Barber & Kimberly R. Barber, R-10-052. Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that Timothy R. Barber
and Kimberly R. Barber had petitioned to rezone a total of 2.23 acres, two parcels of land, located on State Road 862/Oak Hill Road, in the Tunstall Election District from RC-1, Residential
Combined Subdivision District to A-1, Agricultural District (to combine with their existing farm (GPIN # 1358-62-1692) for agricultural use). Mr. Barber was not present to represent
the petition; however, Mr. Shelton stated that he would answer any questions from the Board members. There was no opposition to the petition. During the discussion, it was stated that
there is A-1, Agricultural District, land behind the petitioned parcels. Mr. Stowe closed the public hearing at 7:07 p.m. A motion was made by Mr. Motley, seconded by Mr. Weatherford,
to recommend the Board of Supervisors rezone these properties from RC-1, Residential Combined Subdivision District to A-1, Agricultural District. Motion passed unanimous.
Case 4, John W. Adkins & Jane M. Adkins, R-10-053. Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that John and Jane Adkins had
petitioned to rezone 22.39 acres, located on State Road 817/Turkeycock Mountain Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to
A-1, Agricultural District (to make the zoning consistent with the adjoining parcels of land zoned
A-1). Jane Adkins was present to represent the petition. She stated that the property is in land use and she felt that the land should be zoned A-1. There was no opposition to the
petition. Mr. Stowe closed the public hearing at 7:09 p.m. A motion was made by Ms. Mease, seconded by Mr. Ingram, to recommend the Board of Supervisors rezone this property from
R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous.
Case 5, Tony A. Fox, R-10-054. Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported that Tony Fox had petitioned to rezone 3.12 acres,
located on State Road 799/Climax Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (to allow for construction
of a garage/shop that is larger than the dwelling). Tony Fox was present to represent the petition. He stated he would like to build a 32’ x 40’ shop that would serve as a multi-purpose,
personal use building for his restored 1969 Chevrolet Camaro and his tractor. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:13 p.m. A motion was
made by Mr. Ingram, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District.
Motion passed unanimous.
This concludes the Rezoning Cases.
Case S-1, Withdrawn, S-10-013.
Case S-2, Betty Davis Huppert, S-10-014. Mr. Stowe opened the public hearing at 7:14 p.m. Mr. Shelton, Director of Code Compliance, reported that Betty Huppert had petitioned for a
Special Use Permit on 1.18 acres, located on State Road 875/Horseshoe Road, in the Westover Election District (for a single-wide mobile home for her son’s residence). James Huppert
was present to represent the petition. He stated that he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:15 p.m. A motion was
made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Zoning Appeals grant this Special Use Permit request. Motion passed unanimous.

Case S-3, William H. Simms, S-10-015. Mr. Stowe opened the public hearing at 7:16 p.m. Mr. Shelton, Director of Code Compliance, reported that William Simms had petitioned for a Special
Use Permit on 8.85 acres, located on Ponderosa Drive, in the Dan River Election District (for an automobile graveyard). William Simms was present to represent the petition. He stated
that he is a hobbyist and collects old cars, trucks and tractors and restores them. He also stated that this will not be an automobile junkyard. Several individuals came forward and
spoke in opposition to the petition. Some of their concerns were as follows: property values would be lowered as a result of having a junkyard nearby, difficulty in renting property
located next to a junkyard and road conditions on Ponderosa Drive, which is not state-maintained and is a dead end road. Mr. Simms then stated, in rebuttal, that he had offered to help
fix up and restore the road and that he would not keep anything in the vehicles that was not being used, such as gasoline and oil, etc. The Board members then recommended that the neighbors
who were in opposition to the petition discuss their concerns with Mr. Simms. Mr. Stowe closed the public hearing at 7:38 p.m. A motion was made by Mr. Welborn, seconded by Mr. Ingram,
to recommend the Board of Zoning Appeals grant this Special Use Permit request with the condition that the verbiage in the proffer be expanded. Motion passed unanimous.
This concludes the Special Use Cases.
OLD BUSINESS
Mr. Sides gave a brief update on the Comprehensive Plan and provided the Comprehensive Plan to the Board members in a three-ring binder as promised in the November meeting. He also
stated that the Comprehensive Plan will be updated regularly and will be available on-line and on GeoBlocks soon.
NEW BUSINESS
There was no new business.
The meeting was adjourned at approximately 7:55 p.m.
