REGULAR MEETING

MINUTES
VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, August 10, 2010, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia.
Mr. Talbott called the meeting to order at approximately 6:45 p.m. Mr. Easley gave the invocation. Mr. Shelton called the roll.

APPROVAL OF THE MINUTES
By motion of Mr. Estes, seconded by Mr. Easley, and by unanimous vote the Minutes of the July 13, 2010, meeting were approved as presented.
Old Business
Mr. Shelton updated the Board on the proposed changes to the Pittsylvania County Zoning Ordinance, which included the following: (A) The addition of Non-Emergency Medical Transport
under all zoning districts allowing Emergency Services Facilities – Fire, Rescue as a Special Use and the addition of Non-Emergency Medical Transport under all zoning districts allowing
Emergency Services Facilities – Fire, Rescue as a Permitted Use. (B) The addition of Internet Sweepstakes Cafes under Special Use Permits under B-1, Business District, Limited and
B-2, Business District, General. There was then a general discussion regarding the Non-Emergency Medical Transport and Internet Sweepstakes Cafes.
New Business
Mr. Shelton reported there will be one (1) Special Use Permit case for the September cycle.

THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at
approximately 7:00 p.m.
Case S-1, Roger P. Jefferson, S-10-009 – Mr. Talbott opened the public hearing at approximately 7:05 p.m. Mr. Shelton, Director of Code Compliance, reported that Roger Jefferson had
petitioned for a Special Use Permit on 280.96 acres, located on State Road 750/Oxford Road, in the Callands-Gretna Election District (for an anaerobic digester). Fred Wydner was present
to represent the petition. Mr. Wydner stated this digester was identical to the other anaerobic digester that was being installed in the county, with the exception that this one was
larger and was scaled up to meet Mr. Jefferson’s operation with a 750 kilowatt gen-set. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately
7:14 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Merricks, seconded by Mr. Reynolds, the
following motion was adopted: Whereas, Roger P. Jefferson has petitioned the Board of Zoning Appeals for a Special Use Permit for an anaerobic digester and, Whereas, we find no substantial
detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance,
I move the Special Use Permit be granted. Motion passed unanimous.
Case S-1, Paulett Crews, S-10-005 – Mr. Talbott opened the public hearing at approximately 7:15 p.m. Mr. Shelton, Director of Code Compliance, reported that Paulett Crews had petitioned
for a Special Use Permit on 0.50 of an acre, located on State Road 630/Hodnetts Road, in the Staunton River Election District (for emergency services, rescue and medical transport).
Paulett Crews was not present to represent the petition. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:17 p.m. The Board discussed
the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Easley, seconded by Mr. Yeaman, the following motion was adopted: Whereas,
Paulett Crews has petitioned the Board of Zoning Appeals for a Special Use Permit for emergency services, rescue and medical transport and, Whereas, we find no substantial detriment
to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move
the Special Use Permit be granted. Motion passed unanimous.
This concludes the Special Use Permit cases.
