Sleeper, County Administrator Date: Special Call Meeting: Monday, August 9, 2010 Subject: Tobacco Applications 2010/2011 Attached hereto you will find four (4) resolutions with attached information concerning the tobacco applications we would like to submit on the behalf of Pittsylvania County for the 2010/2011 cycle due August 16, 2010. 4 (a) Resolution 2010-08-04 for the Phase III Engineering and Environmental Work at the Mega Park. Including the required local, the total application will be $985,500. The City's share of that will be $492,750. Because they do not have enough allocation, we are filing for the entire amount from Pittsylvania County's allocation because we owe the City of Danville money from the due to and due from audits at the end of each year from the Regional Industrial Facilities Authority in an amount of $224,000 and the interest due on funding for the Mega Park in the amount of $116,388. Together that amounts to the County owing the City $340,597. Upon a separate written agreement, we will agree that amount could be removed between the County and the City for the City's share of the Phase III Engineering and Environmental Application. That will leave the City owing the County on the due to and due from of the 2010 year of $152,163. In other words, it will be a trade off for amounts already due to make this application from the County's allocation in order to keep this project moving forward. Staff recommends the Board of Supervisors approve the attached resolution for application of $886,950 of Tobacco Funds, matched by $99,850 of local funds. 4(b) Resolution 2010-08-OS- Master Plan Engineering for Mega Park Water System. The County of Pittsylvania is responsible for water and sewer utilities to the various parks owned by the Regional Industrial Facilities Authority that are in the County. Since the Mega Park is in the County, the County is providing the necessary water and sewer. Currently, we have a project running water from RT 58 to the Mega Park. However, it does not include the significant sized pipes and tanks necessary to run the waterline from Eden to the park to meet the required water service at the park. Attached hereto you will find the slides from the presentation of the Mega Park showing the shovel ready engineering requirements for engineering and right-of--way for the water system alone. This is application to the Tobacco Commission from Pittsylvania County's allocation in the amount of $1,325,000 for the Master Plan Engineering of the Mega Park Water System which will be owned by the Board of Supervisors until we determine the necessary ownership; either our Service Authority or working with contracts from the City of Eden to provide water service to the park. Staff recommends the Board of Supervisors approved the attached resolution and authorize the submission of the grant application for funding of the Mega Park Master Plan Engineering Water System in the amount of $1,457,500, including $132,500 of local funds required match. 4(c) Resolution 2010-OS-06 for the Olde Dominion Agricultural Development Center will allow the application from the Pittsylvania County allocation in the amount of $340,000, which will be matched by funding from the Olde Dominion Agriculture Foundation, Inc., at least $100,000 of local funds. There are addition State funds and private funds incorporated into this project for the purchase of 54 acres adjacent to the current Olde Dominion Agricultural Complex. The intent of this is to develop agricultural based industries located next to the center in order to support activities at that center and agricultural development in Pittsylvania County. Staff recommends that the Board of Supervisors approve the attached resolution, authorizing the submission for tobacco application funds in the amount of $340,000 matched by $100,000 from the Olde Dominion Agricultural Foundation, Inc. 4(d) Resolution 2010-08-07-Water and Sewer service at the Hurt Industrial Park (Klopman Mills site). The intent of this application for $985,500 of Pittsylvania County allocation is to provide the necessary water and sewer to the Klopman Mills site in Hurt, Virginia, in order to be able to move this site for industrial purposes. Currently, several vendors have looked at this site for purchasing and development. In all cases, the water and sewer system on site was too large to operate and required that public utilities be provided to this site in order to allow manufacturing there to occur. Therefore, we recommending to the board to apply for this application. Staff recommends the Board approve the attached resolution to authorize submission of a grant from the Tobacco Commission in the amount of $985,000, with $98,500 of local funds for a total project of $1,083,500. Staff will be present at the Special Call Meeting of the Board of Supervisors in order to go over the necessary full applications to answer questions for the approval and submission of these grant request. WDS/rf Attachments RESOLUTION AUTHORIZING SUBMISSION OF THE FY 2011 TOBACCO APPLICATION FOR PITTSYLVANIA COUNTY, VIRGINIA 2010-08-04 WHEREAS, Pittsylvania County has been impacted by the decline of the tobacco industry causing a negative impact on economic development and growth throughout the County, and WHEREAS, the Tobacco Indemnification and Community Revitalization Commission has developed an economic development program to help tobacco related localities to change and revitalize their economy, and WHEREAS, grants from the Tobacco Indemnification and Community Revitalization Commission will assist Pittsylvania County in transforming its economy to replace the decline in the tobacco agro-business community, then BE IT HEREBY RESOLVED, that the Board of Supervisors of Pittsylvania County authorizes the submission of a grant application for Phase III -Environmental Review and Permitting of the Berry Hill Regional Mega Park being developed by the Danville-Pittsylvania Regional Industrial Facility Authority and authorizes the County Administrator to file this application and all necessary correspondence relating to the Tobacco Indemnification and Community Revitalization Commission required by this grant and to be responsible for the accuracy of the application and for the appropriate use of funds, should they be granted. Sleeper, Clerk Pittsylvania County Board of Supervisors 2: Project Summary Describe on this page the project for which you are requesting funds from the Cotninission, and clearly describe how Commission funds will be used. Up to three additional pages of description may be included as an Attachment. The Project: The Olde Dominion Agricultural Foundation, Inc. (ODAF) proposes to purchase and develop a 54 acre adjoining tract of land to the future home of the Olde Dominion Agricultural Complex (ODAC) currently being constructed. This concept will be the first of its kind in the Commonwealth, where development sites will be offered for a reasonable purchase price for ag related businesses. The ODAF will make the determining factor as to who will be allowed to locate in the centre in order to protect the mission and vision of the Foundation, the ODAC, and the farming cultures of the area. The site is adjacent to Route 29, a major thoroughfare north and south through the state, and is bordered on the west by the Norfolk Southern (NS) Railroad. While there is no rail access to the property presently, engineers from NS have been advised of these future plans and their engineering department has drafted conceptual schematics of a rail siding for the centre. A portion of the funds requested are to cover additional engineering for the rail access. The Current Situation: This site is currently being held for the ODAF through a long term option offered by a supporter of the Foundation, whose original intent upon purchasing the property was to market it back to the Foundation at a net zero profit (Purchase Option attached). Basically, the individual bought this tract on behalf of the Foundation until funds could be acquired by the Foundation to obtain ownership. This option has been structured so that the ODAF will be allowed to purchase the property at the original purchase price, which is $285,000.00 or $5,277.78/acre. Development sites across the county are currently averaging approximately $10,000/acre, which would have made just the soil worth $540,000.00. In essence, the patron holding this land for the ODAF has potentially saved the Foundation a net $255,000.00. Currently, as part of our arrangement, the ODAF maintains all the upkeep, taxes, and insurance on the property. A pictorial attachment of the site is included. Site Engineering: Site and access engineering, another portion of the proposed application funds, will outline approximate parcels for future availability once developed. Initial discussions with a local engineering firm estimates between five and eight marketable parcels of one to twenty acres each. Each parcel would be sold to a perspective agri-business based on the ideals and nature of the proposed business to support the community and the farming infrastructure that is currently in place. In other words, businesses to locate at the centre would be analyzed for their interest in purchasing goods from local farmers, while supporting the needs of the overall region. While the site is currently unimproved, the board will provide a general engineering detail of each tract, however, grading improvements will be to the discretion of the purchaser.
