9. HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be
a resident or land owner of the County, or the registered agent of such
resident or land owner. Each person shall step up, give his/her name and
district in an audible tone of voice for the record, and unless further time
is granted by the Chairman, shall limit his/her address to three (3) minutes.
No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board
as a body and not to any individual member thereof. Hearing of the
Citizens shall last for a maximum of forty-five (45) minutes. Any individual
that is signed up to speak during said section who does not get the
opportunity to do so because of the aforementioned time limit, shall be
given speaking priority at the next Board meeting. Absent Chairman’s
approval, no person shall be able to speak who has not signed up.
10. PUBLIC HEARINGS
a. Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning
Ordinance, the Board of Supervisors have been empowered to
hear and decide specific zoning issues and zoning map changes in
support of said Ordinance. In accomplishing this important task, the
Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must
ensure that all of its decisions and regulations be directed to these
goals and that each be consistent with the environment, the
comprehensive plan, and in the best interest of Pittsylvania County,
its citizens, and its posterity.
1. Case R-25-012, Victor and Neil Hardy; Rezoning from R-1,
Residential Suburban Subdivision District, to A-1, Agricultural
District. The Planning Commission recommended by a 7-0
vote, with no opposition, that the petitioners' request be

The Danville Metropolitan Planning Organization (MPO), in collaboration with EPR, PC has
developed a Safe Streets for All (SS4A) Safety Action Plan to identify and address safety concerns
within the MPO area, including the County’s urban areas adjacent to the City of Danville. Joe
Bonanno from WPPDC presented the plan to the Board.
b. U.S. 58 West Sewer Capacity Analysis Report
Leslie Mantiply from Dewberry Engineering discussed the U.S. 58 West Sewer Capacity Analysis
Report with the Board.

Jerome Adams, Tunstall District, shared sentiments regarding the Public Safety system.
Katie Whitehead, Chatham-Blairs District, urged the Board to avoid delay and adopt the revised
Zoning Ordinance the County has been working on for two years.
Joseph Hairston, Tunstall District, shared concerns regarding a pit bull in his community.
Gage Dillon, Tunstall District, and neighbor of Joseph Hairston, also shared concerns regarding the
pit bull in his community.
Anna Farrar, Tunstall District, shared concerns of the condition of Whitetail Avenue.
Shane Pressley, Business Owner in the County, questioned the County's plan for the Inspection
Office.
PUBLIC HEARINGS
Rezoning Public Hearings
1. Case R-25-010 John Geyer; Requesting to rezone from R-1, Residential Suburban
Subdivision District, and A-1, Agricultural District, to A-1, Agricultural District. The
Planning Commission recommended by a six (6) to zero (0) vote, with no opposition, that the
petitioner's request be granted. (Chairman Tucker)
In Case R-25-010, John Geyer (Petitioner) has petitioned to rezone property located on State Road
686/Markham Road in the Banister Election District and shown on the Tax Maps as GPIN #2468-
80-2515. The applicant is requesting to rezone 35.60 acres, from R-1, Residential Suburban
Subdivision District, and A-1, Agricultural District, to A-1, Agricultural District, to assign one
zoning classification to a parcel that currently has two and allow for a conservation easement on
the property. Once the property is rezoned to A-1, all uses listed under Pittsylvania County Code
Section 35-178 are a Permitted Use. The Comprehensive Plan indicates the area is suitable for
Agricultural and Rural Residential uses. Zoning conditions and Ordinance standards shall control
the density of allowable development. On April 1, 2025, the Planning Commission recommended
by a 6-0 vote, with no opposition, that the petitioner's request be granted.
Tucker opened the Public Hearing 8:12 PM. No one signed up to speak and he closed the Public
Hearing at 8:13 PM.

Annually, the Board and the Virginia Department of Transportation (“VDOT”) are required to hold
a Public Hearing to receive citizen input on the proposed Secondary Six (6)-Year Plan. Jay
Craddock, VDOT Assistant Resident Engineer, was present to answer any questions from the
Board.

The School FY2026 Budget, in the amount of $132,471,056, was presented to the Board on April
15, 2025, as part of the total County budget. A related Public Hearing was conducted on May 13,
2025, after the same was noticed in The Chatham Star Tribune on April 23, 2025 and April 30,
2025. Tonight's approval of the FY26 School Budget in the amount of $132,471,056 meets the 7-
day waiting period set forth in Virginia Code §15.2-2503 and the requirement to approve a budget
for school purposes set forth in §22.1-93.

County staff recently met with the West Piedmont Planning District Commission (WPPDC) to
discuss the County’s potential application for a Safe Streets for All (SS4A) Implementation Grant.
This grant would support the corrective safety measures identified in the County’s SS4A Action
Plan, which was formally adopted by the Board of Supervisors last month. The grant application
is due by June 26, and it requires a 20% local match, which must be approved by the Board. There
was consensus of the Board to add this item to the Business Meeting Agenda for action.
b. Board Compensation
Supervisor Bowman and County Attorney, Matt Evans, presented a Resolution in support of
amending and establishing the following Board of Supervisor salaries for the period beginning
January 1, 2026, and ending December 31, 2026, as follows:
• Chairman: $1850 per month

HEARING OF THE CITIZENS
Chuck Angier, Callands-Gretna District, recommended that an ad-hoc committee of citizens be
formed to work directly with County Staff and the contractor for consistent input for the
Comprehensive Plan process.
Katie Whitehead, Chatham-Blairs District, spoke on behalf of the Coalition for Protection of
Pittsylvania County and urged the Board of Supervisors to take seriously a rumor about a possible
meeting with tech company xAI, cautioning against secrecy and lack of public input. She referenced
past issues with Balico, LLC, and warned that xAI’s recent development in Memphis involved
unpermitted gas turbines and environmental violations. Whitehead encouraged the County to be
proactive by updating its zoning plans and carefully vetting companies before deals are made.
Amy Davis, Banister District, thanked the Board for its "No" vote for the Balico Project and urged
the Board to adopt a new Comprehensive Plan that will protect the land in the County.

Rezoning Public Hearings
1. Case R-25-011; Victor and Vicky Keatts; Requesting to rezone from R-1, Residential
Suburban Subdivision District, to A-1, Agricultural District. The Planning Commission
recommended by a 5-0 vote, with no opposition, that the petitioners' request be granted
(Supervisor Ingram)
In Case R-25-011, Victor and Vicky Keatts (Petitioners) have petitioned to rezone property located
on State Road 954/Plantation Drive in the Tunstall Election District and shown on the Tax Maps as
GPIN # 1430-83-3038. The applicant is requesting to rezone 3.48 acres, from R-1, Residential
Suburban Subdivision District, to A-1, Agricultural District, to allow a campground on the property.
Once the property is rezoned to A-1, all uses listed under Pittsylvania County Code Section 35-178
are a Permitted Use. The Comprehensive Plan indicates the area is suitable for Agricultural and
Rural Residential uses. Zoning conditions and Ordinance standards shall control the density of
allowable development. On May 6, 2025, the Planning Commission recommended by a 5-0 vote,
with no opposition, that the petitioners' request be granted.

1. Public Hearing: Dog Controlled Area (Bridgewood Subdivision)
County Staff received a Petition from Danielle Merricks, resident of Cobblestone Ct. in the County,
requesting the Board consider amending Pittsylvania County Code (“PCC”) § 2.2-22; Running At
Large Restrictions in Designated Areas, to include the Bridgewood Subdivision in Danville, VA.
Ms. Merricks has developed a Petition supporting a dog-controlled area defined as the Bridgewood
Subdivision. County Staff has verified that there are seventy-six (26) property owners within this
area. Ms. Merrick's Petition has fifty-seven (57) signatures, representing 75% of property owners
in the proposed dog-controlled area. At the May 20, 2025, Business Meeting, the Board authorized
County Staff to advertise for a Public Hearing for citizen input on amending PCC § 2.2-22 to include
the aforementioned subdivision. The Public Hearing was advertised in the Chatham Star Tribune
on May 28, 2025, and June 4, 2025.

2. Public Hearing: Ordinance # 2025-06-01 (DSS One-time Bonus)
The Virginia General Assembly approved a one-time bonus of 1.5% of base salary for all full-time
employees of local departments of social services, effective July 1, 2025. In accordance with § 15.2-
1508 of the Code of Virginia, localities must adopt an ordinance to authorize the payment of this
bonus. This ordinance fulfills the requirement to allow eligible employees of the Pittsylvania
County Department of Social Services to receive the bonus, which is fully funded by the
Commonwealth of Virginia. There is no local financial impact. The 1.5% bonus is a state-supported
expenditure, reimbursed by the Virginia Department of Social Services. The bonus must be paid in
Fiscal Year 2026 and submitted through LASER using the appropriate account codes provided in
the DSS Finance Guidelines Manual.

3. Public Hearing: Solar Siting Agreement & Extension Request
In 2021, the General Assembly passed legislation giving localities additional measures to further
regulate the development of utility-scale solar energy facilities. This legislation requires that any
solar project or an energy storage project applicant give the host locality written notice of the
applicant’s intent to locate in the locality and request a meeting to discuss a related Siting
Agreement. Once a Siting Agreement has been negotiated with the County, a Public Hearing must
be held before it can be executed. This Public Hearing has been duly and legally advertised/noticed.
For the Board’s review and
consideration, attached is a solar Siting Agreement for the Acton Solar, LLC, to be in the Tunstall
Election District. Said Siting Agreement has been successfully negotiated with the County. A
Special Use Permit was previously approved by the Board of Zoning Appeals for Axton Solar, LLC,
Case S-20-019, on December 8, 2020, and an amendment on December 13, 2021, Case S-21-012.
Both SUPs
included a condition that the project commence construction within three (3) years of the approval
of the SUP; however, this was automatically extended to July 1, 2025, by Va Code Section 15.2-
2209. In addition to the proposed siting agreement, the applicant is also requesting a 2-year
extension. If approved, this would extend the SUP to July 1, 2027.

precedence and reject the extension and the siting agreement.
Mike Pyrtle, Tunstall District, shared his support for this extension request and the solar siting

they need a little more time.

SUMMARY:
Pittsylvania County is a participating plaintiff in the national opioid litigation and
is eligible to take part in a proposed $450,000 settlement agreement with Henry
Schein, Inc. and its affiliates. This agreement resolves claims related to the
defendants’ alleged role in the opioid epidemic. Although Henry Schein is
considered a minor actor in Virginia, outside opioid litigation counsel and the
County Attorney recommend participation as a strategic and beneficial
resolution. To participate, the County must submit a signed Participation and
Release Form (Exhibit D) by August 1, 2025, and dismiss any related claims with
prejudice.
FINANCIAL IMPACT AND FUNDING SOURCE:
Pittsylvania County’s estimated share of the settlement is $4,651.41, based on
the allocation formula in the Virginia Opioid Abatement Fund and Settlement
Allocation Memorandum of Understanding (“Virginia MOU”). Funds received
must be used in accordance with the Virginia MOU. No local match or
additional funding is required.
RECOMMENDATION:
Staff recommends that the Board adopt the resolution authorizing participation
in the Henry Schein opioid settlement and authorize the County Attorney and/or
outside litigation counsel to execute and submit the required forms and take all
necessary follow-up actions.

RESOLUTION AUTHORIZING PARTICIPATION IN THE HENRY SCHEIN OPIOID SETTLEMENT
AGREEMENT.

VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) July 15, 2025, Business Meeting,
the following Resolution was presented and adopted:
WHEREAS, Pittsylvania County, Virginia (“County”) has been severely affected by the opioid crisis, which
continues to place a significant burden on public health, safety, and governmental resources; and
WHEREAS, the County previously authorized litigation against various opioid manufacturers, distributors,
and other entities involved in the opioid supply chain, and has entered into multiple opioid-related settlements to date;
and
WHEREAS, Henry Schein, Inc., General Injectables & Vaccines, Inc., and Insource, Inc. (collectively, the
“Henry Schein Defendants”) have agreed to a proposed settlement resolving opioid-related claims brought by
Virginia local governments, including the County, in the amount of $450,000; and
WHEREAS, Pittsylvania County is listed as a plaintiff in the litigation and entitled to a portion of this
settlement as identified in Exhibit C of the Henry Schein Settlement Agreement, with an approximate allocation of
$4,651.41, subject to final calculation and disbursement by counsel; and
WHEREAS, it has been determined that the Henry Schein Defendants had only minimal involvement with
the distribution of opioids in Virginia localities; and
WHEREAS, the proposed settlement is conditioned upon each Virginia local government executing and
submitting the required Participation and Release Form (Exhibit D) no later than August 1, 2025, unless otherwise
extended; and
WHEREAS, the County Attorney and outside opioid litigation counsel have reviewed the terms of the
proposed settlement and recommend the County’s participation as being in its best interest; and
WHEREAS, the County affirms that this settlement is subject to and shall be administered consistent with
the Virginia Opioid Abatement Fund and Settlement Allocation Memorandum of Understanding (“Virginia MOU”),
as with prior opioid settlements.
BE IT FURTHER RESOLVED, that the Pittsylvania County Board of Supervisors hereby approves the
County’s participation in the Henry Schein opioid settlement, authorizes the execution of the required Participation
and Release Form (Exhibit D), and further authorizes the County Attorney and/or the County’s designated outside
counsel to take all necessary steps to effectuate the County’s participation, including dismissal of claims against the
Henry Schein Defendants with prejudice, as required by the terms of the Settlement Agreement.

RURAL RUSTIC ROADS DESIGNATION
VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) Business Meeting on Tuesday, July
15, 2025, in the Board Meeting Room, the following Resolution was presented and adopted:
WHEREAS, §33.2-332, Code of Virginia, 1950, as amended, permits the hard surfacing of certain unpaved
roads deemed to qualify for designation as a Rural Rustic Road; and
WHEREAS, any such road must be located in a low-density development area and have no more than 1,500
vehicles per day; and
WHEREAS, the Board desires to consider whether the following Routes should be designated a Rural Rustic
Road:
• Route 928 (Spruce Road) from Route 649 to Route 626;
• Route 613 (Newby Lane) from Route 703 to the dead end;
• Route 850 (Brown Road) from Route 831 to the dead end; and
• Route 812 (Berry Road) from Route 807 to Route 657.
WHEREAS, the Board is unaware of pending development that will significantly affect the existing traffic on
these roads; and
WHEREAS, the Board believes that these roads should be designated due to their qualifying characteristics;
and
WHEREAS, these roads are on the Board’s Six (6)-Year Plan for improvements to the secondary system of
state highways.
NOW, THEREFORE, BE IT RESOLVED, the Board requests that these roads be hard surfaced and, to the
fullest extent prudent, be improved within the existing right-of-way and ditch-lines to preserve as much as possible
the adjacent trees, vegetation, side slopes, and rural rustic character along the roads in their current state; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to the Virginia
Department of Transportation’s Residency Administrator.

SUMMARY:
During a recent Tunstall District town hall meeting, community members raised
significant concerns regarding traffic safety at the intersection of Tunstall High
Road, Stony Mill Road, and Mt. Cross Road—an area that experiences high
traffic volumes, particularly during school hours. In response to these concerns,
Supervisors William "Vic" Ingram and Murray Whittle, along with Virginia
Department of Transportation (VDOT) representative Jay Craddock, discussed
potential solutions and identified the installation of a four-way stop as a
potential safety improvement.
VDOT has advised that in order to complete this work prior to the start of the
2025–2026 school year in August, it would be preferred to receive a Resolution
of support from the Board of Supervisors at the July meeting. The proposed
Resolution expresses the Board’s formal support for the installation of a four-way
stop at the intersection to improve traffic flow and enhance safety for students,
school staff, and local residents.
FINANCIAL IMPACT AND FUNDING SOURCE:
There will be no cost to the County, as VDOT will be responsible for all aspects of
installation and ongoing maintenance.
RECOMMENDATION:
County Staff recommends the Board adopt Resolution # 2025-07-02 as
presented.

RESOLUTION IN SUPPORT OF A FOUR-WAY STOP AT THE INTERSECTION OF TUNSTALL HIGH
ROAD, STONY MILL ROAD, AND MT CROSS ROAD

VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) July 15, 2025, Business Meeting,
the following Resolution was presented and adopted:
WHEREAS, the intersection of Tunstall High Road (Route 869), Stony Mill Road (Route 869), and Mt Cross
Road (Route 844) is a heavily trafficked area, particularly during school hours due to its proximity to Tunstall High
School; and
WHEREAS, citizens have expressed safety concerns regarding the current traffic flow at this intersection,
particularly during peak school arrival and dismissal times; and
WHEREAS, at a town hall meeting held in the Tunstall District on July 8, 2025, Supervisor William “Vic”
Ingram and Supervisor Murray Whittle, along with Virginia Department of Transportation (VDOT) representative
Jay Craddock, acknowledged these concerns and identified the installation of a four-way stop as a potential safety
improvement; and
WHEREAS, Mr. Craddock advised that in order for this traffic control measure to be implemented before
the start of the 2025-2026 academic school year in August, it would be preferred to receive a Resolution of support
from the Board of Supervisors at this meeting;
NOW, THEREFORE, BE IT RESOLVED, that the Pittsylvania County Board of Supervisors hereby
supports the installation of a four-way stop at the intersection of Tunstall High Road, Stony Mill Road, and Mt Cross
Road as a measure to enhance traffic safety and protect the students, staff, and residents who travel this corridor; and
BE IT FURTHER RESOLVED, that the Board formally requests the Virginia Department of
Transportation proceed with all necessary steps to install the four-way stop in advance of the 2025-2026 school year
opening.
