9. HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be
a resident or land owner of the County, or the registered agent of such
resident or land owner. Each person shall step up, give his/her name and
district in an audible tone of voice for the record, and unless further time
is granted by the Chairman, shall limit his/her address to three (3) minutes.
No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board
as a body and not to any individual member thereof. Hearing of the
Citizens shall last for a maximum of forty-five (45) minutes. Any individual
that is signed up to speak during said section who does not get the
opportunity to do so because of the aforementioned time limit, shall be
given speaking priority at the next Board meeting. Absent Chairman’s
approval, no person shall be able to speak who has not signed up.
10. PUBLIC HEARINGS
a. Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning
Ordinance, the Board of Supervisors have been empowered to
hear and decide specific zoning issues and zoning map changes in
support of said Ordinance. In accomplishing this important task, the
Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must
ensure that all of its decisions and regulations be directed to these
goals and that each be consistent with the environment, the
comprehensive plan, and in the best interest of Pittsylvania County,
its citizens, and its posterity.
1. Case R-25-002 Nancy Weatherford; Rezoning from R-1, Residential
Suburban Subdivision District, to A-1, Agricultural District. The Planning
Commission recommended by a 7-0 vote, with no opposition, that

SUMMARY:
David and Linda Sutherlin (“Sutherlin”) own Lots 156, 137A, and 158B on Jasper
Wood Road in the County’s Staunton River Magisterial District. Lot 156 is their
residence, being 1097 Jasper Wood Road, as shown on the plat attached to
the Board Meeting Packet, and Lot 137A is 1041 Jasper Wood Road. The
Sutherlin’s desire to have the adjacent roadway (which is not open)
abandoned between their Lots 156, 137A, and 158B to be transferred to them
for its maintenance and upkeep. Said roadway is currently used as the driveway
for 1041 Jasper Wood Road. This roadway needs to be abandoned and
removed from the County public roadway system in order to effectuate that
transfer.
Per Virginia Code § 33.2-909, the procedures for the abandonment of an
existing road, or portion of a road have been met as follows:
(1) The Board at its Meeting held on November 19, 2024, by a 7-0 vote decided
that no public necessity exists for the continuance of the public road;
(2) The Board sent a formal notice of its intent to abandon to David and Linda
Sutherlin;
(3) The Board posted notice in at least three (3) places on and along the road
sought to be abandoned for at least thirty (30) days;
(4) The Board published notice of its intent to abandon the road in two (2) or
more issues of a newspaper having general circulation in the County;
5
(5) The Board has waited thirty (30) days for any interested party to request a
Public Hearing of or related to the road abandonment; and
(6) No request for a Public Hearing has been received, thus the Board, within
the four (4) months of the thirty (30) day posting period, must pass an Ordinance
or Resolution abandoning the road.
For the Board’s review and consideration, related and supporting
documentation is attached in the Board Meeting Packet.
FINANCIAL IMPACT AND FUNDING SOURCE:
None.
RECOMMENDATION:
County Staff recommends the Board pass an Ordinance or Resolution
abandoning the road and authorizing County Staff to proceed with the
preparation of the appropriate transfer to the Sutherlin’s.

REQUEST TO ABANDON PORTION OF JASPER WOOD ROAD IN THE STAUNTON RIVER
MAGISTERIAL DISTRICT
VIRGINIA: At Pittsylvania County Board of Supervisors’ (“Board”) February 18, 2025, Business
Meeting, the following Resolution was presented and adopted:
WHEREAS, public notice was posted as prescribed under § 33.2-909, Code of Virginia 1950, as
amended, announcing the Board’s intent to abandon the road described below from the County public roadway
system, and offering to hold a public hearing on the same, if so requested by any interested party; and
WHEREAS, David and Linda Sutherlin were provided the prescribed notice of this Board’s intent to
abandon the subject section of road; and
WHEREAS, no person requested a public hearing on this matter during the statutory posting notice
period; and
WHEREAS, after considering all evidence available, this Board is satisfied that no public necessity exists
for the continuance of the following portion of Jasper Wood Road:
the property shown as “Sixth Street” on the plat by Adam L. Lane, L.S. and recorded as Instrument
Number 240004812 in the Staunton River Magisterial District of Pittsylvania County, Virginia and hereby
deems that section of road is no longer necessary as a part of the County public roadway system.
NOW, THEREFORE, BE IT HEREBY RESOLVED, this Board abandons the above-described section
of road and removes it from the County public roadway system, and authorizes County Staff to prepare the
appropriate documents for the transfer of said property to David and Linda Sutherlin, with the Interim County
Administrator given the authority herein to execute any and all documents needed to effectuate that transfer.

SUMMARY:
The Virginia Department of Transportation ("VDOT") requests the Board’s
approval for changes to the secondary state highway system as outlined in the
sketch dated December 5, 2024, for Project 6311-071-454, C-501 and included in
the Board Packet. The proposed changes include the abandonment of certain
road segments that no longer serve a public need and the addition of new
road sections that will continue to serve the same citizens. VDOT asks the Board
to approve the abandonment of the identified road segments from the primary
system and to request the addition of the new road sections to both the
secondary and primary highway systems. Resolution # 2025-02-02 is attached to
the Board Packet for your review and consideration.

ROUTE 311 BERRY HILL VDOT PROJECT
VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) February 18, 2025, Business
Meeting, the following Resolution was presented and adopted:
WHEREAS, the Virginia Department of Transportation has provided this Board with a sketch dated
December 5, 2024, depicting the additions and abandonments required in the secondary system of state highways
as a result of Project 6311-071-454, C-501, which sketch is hereby incorporated herein by reference; and
WHEREAS, the new road serves the same citizens as those portions of old road identified to be
abandoned and those segments no longer serve a public need; and
NOW, THEREFORE, BE IT RESOLVED this Board abandons as part of the primary system of state
highways those portions of road identified by the sketch to be abandoned, pursuant to §33.2-906, Code of
Virginia, and
BE IT FURTHER RESOLVED, that this Board requests the Virginia Department of Transportation to
add to the secondary system of state highways those portions of road identified by the sketch to be added, pursuant
to §33.2-705. Code of Virginia, and
BE IT FURTHER RESOLVED, this Board requests the Virginia Department of Transportation to add
to the primary system of state highways those portions of road identified by the sketch to be added, pursuant to
§33.2-317, Code of Virginia, and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Area Land

SUMMARY:
Two teenage cousins in Hurt, Virginia, faced a life-threatening emergency on
January 19, 2025, after falling through the ice of a frozen pond in their
backyard. One teen managed to call 911, allowing Pittsylvania County
emergency dispatchers to quickly coordinate a response. Within ten minutes,
first responders arrived, demonstrating exceptional bravery and skill in rescuing
the boys and providing them with immediate medical care. In recognition of
their heroic efforts, the Pittsylvania County Board of Supervisors honors the Hurt
Fire Department, other participating Fire and EMS agencies, E-911 operators,
Public Safety Staff, local law enforcement, and volunteers for their dedication
and life-saving actions. As evinced by Resolution # 2025-02-03 attached, the
Board desires to recognize the efforts and sacrifices of the first responders who
risked their own safety to respond to this emergency.

HONORING COUNTY FIRST RESPONDERS FOR THEIR HEROIC ACTIONS IN THE RESCUE OF TWO
TEENAGERS FROM A FROZEN POND
VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) February 18, 2025, Business Meeting,
the following Resolution was presented and adopted:
WHEREAS, emergencies can occur at any time that require police, fire, or emergency medical services, and when
an emergency occurs, the prompt response of our First Responders is critical to the protection of life and preservation of
property; and
WHEREAS, on January 19, 2025, two teenage cousins found themselves in a life-threatening situation when they
fell through the ice of a frozen pond in their backyard in Hurt, Virginia; and
WHEREAS, despite warnings about the dangers of walking on the frozen pond, the teenagers ventured onto the
ice, and within minutes, one fell into the freezing water, prompting the other to attempt a rescue, which led to both boys
being submerged in the icy depths; and
WHEREAS, one teen displayed remarkable quick thinking and bravery by using his waterlogged phone to call
911, an action that was critical in ensuring the prompt arrival of emergency responders; and
WHEREAS, the Pittsylvania County emergency dispatchers acted swiftly and efficiently in coordinating the
rescue response, ensuring that first responders arrived at the scene within ten minutes of the distress call; and
WHEREAS, the dedicated first responders, including members of the fire and rescue teams, arrived at the 300
block of Lonesome Road and demonstrated exceptional courage, skill, and professionalism in executing the successful
rescue of both teenagers from the freezing water; and
WHEREAS, their rapid response and life-saving efforts prevented what could have been a tragic loss of life and
ensured that both teenagers received the immediate medical attention they needed; and
WHEREAS, the community of Pittsylvania County deeply appreciates the heroism, dedication, and selfless service
of all first responders who risk their own safety to protect and serve others in times of crisis;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Pittsylvania County hereby
recognizes and honors the bravery and heroism of the Hurt Fire Department, and all participating Fire Departments and
EMS Agencies, E-911 Operators, Public Safety Staff, Local Law Enforcement Staff, and Volunteers, for their courageous
and life-saving actions on January 19, 2025; and encourages the citizens of the County to join in expressing our heartfelt
thanks to these brave men and women for their exemplary service and sacrifice.

SUMMARY:
The Board of Supervisors of Pittsylvania County originally declared a Local
Emergency on October 15, 2024, due to the impact of Hurricane Helene and an
F2 tornado in the Dry Fork and Callands communities. Now that emergency
response and recovery efforts have been completed or can be managed
through normal operations, the Board finds it appropriate to rescind the
declaration. This resolution officially ends the Local Emergency and revokes all
emergency powers and duties granted under the previous declaration.

RECISSION OF TROPICAL STORM HELENE STATE OF EMERGENCY
DECLARATION
VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) February 18,
2025, Business Meeting, the following Resolution was presented and adopted:
WHEREAS, on October 15, 2024, the Board adopted a Resolution proclaiming a Local
Emergency in Pittsylvania County, Virginia (“County”), due to the impact of Hurricane Helene
and the resulting F2 tornado in the Dry Fork and Callands communities; and
WHEREAS, the conditions that necessitated the Local Emergency Declaration have been
sufficiently addressed, and emergency response and recovery efforts have been completed or are
now manageable through normal governmental operations; and
WHEREAS, the Board finds it appropriate and necessary to formally rescind the Local
Emergency Declaration and all powers, functions, and duties granted therein.
NOW, THEREFORE, BE IT RESOLVED that the Board hereby rescinds the Resolution
adopted on October 15, 2024, which proclaimed the existence of a Local Emergency in the County
due to Hurricane Helene; and
BE IT FURTHER RESOLVED that all emergency powers, functions, and duties
prescribed by the previous Resolution shall no longer be in effect as of the adoption of this
Resolution.

As authorized by Virginia Code § 59.1-148.3, the following Sheriff’s Office
personnel have requested to purchase their assigned duty weapons upon their
retirement:
• Connie Barksdale; Glock 22: Serial Number YMT843; and

SUMMARY:
On February 11, 2025, a winter storm moved through the County that brought
an excessive accumulation of ice, causing extensive damage across the area,
including damage to homes and structures, downed trees and limbs, and
hazardous conditions across the County. Due to the damage in the County
from the recent storm, and the corresponding necessary related clean up, the
Interim County Administrator, in conjunction with Chairman Tucker and
members of the Board, agreed to waive County Landfill Tipping fees for storm-
related debris, subject to the attached criteria and restrictions. County Staff
now seeks the Board to formally ratify the County Winter Storm Debris Landfill
Tipping Fee Waiver action.

Winter Storm – Brush Landfill Tipping Fee Waiver – February 2025
To support residents impacted by the recent winter storm in Pittsylvania County, Virginia
(“County”), the Board of Supervisors has authorized a temporary waiver of County Landfill
tipping fees for residentially generated vegetative brush and trees from County residents.
Valid identification showing proof of County residence is required for disposal and must be
presented at the County’s Landfill office upon delivery, or to other County Staff upon request.
Accepted identification is as follows:
• Unexpired Virginia Driver’s license, military ID, or photo ID card with Pittsylvania County
address;
• Deed, mortgage, or monthly mortgage/rental statement with matching photo ID verifying
residence in Pittsylvania County;
• U.S. Postal Service change of address confirmation form with matching photo ID; or
• Current payroll stub by employer with matching photo ID showing a valid County address
of the employee.
The County Landfill tipping fee waiver is only in effect for residentially generated brush and
vegetative debris, not any material generated through business, commercial, or agricultural
sources. Commercial enterprises collecting waste from a County residence would not be eligible
for the waiver. No quantity limits are placed on residential customers delivering their own brush
by personal passenger vehicle smaller than a one (1) ton pickup truck and/or a flat, 4’x8’ single
axle trailer with sides no greater than thirty-six (36) inches high.
The County Landfill tipping fee waiver is valid from 2/11/2025 through 3/11/2025.

however, this use is considered a legal nonconforming use because it began prior to the adoption of the
Pittsylvania County Zoning Ordinance in 1991. Nonconforming uses can continue as is; however,
Pittsylvania County Code § 35-161 states that nonconforming uses are deemed abandoned if the use is
discontinued for a period of two (2) or more years. The applicant wishes to rezone to ensure that agricultural
uses can continue on the property as a conforming use and allow the construction of a single-family dwelling
on the property in the future.
