05/04/2010 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING May 4, 2010 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, May 4, 2010, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m.. Dr. Miller gave the invocation. Mr. Stowe called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Mr. Ingram, and by a unanimous vote the March 2, 2010, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m. Case 1, Jackie Ray Atkinson, Jr. & Jennifer K. Atkinson, R-10-015. Mr. Stowe opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that Jackie Ray Atkinson, Jr. and Jennifer K. Atkinson had petitioned to rezone a total of 1.19 acres, two parcels, located on U. S. Highway 41/Franklin Turnpike, in the Westover Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General (for an insurance office). Jackie Ray Atkinson, Jr. was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:03 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that Katie A. Burnette and Others had petitioned to rezone 1.23 acres, located on State Road 640/Spring Garden Road, in the Banister Election District from Business District, General to R-1, Residential Suburban Subdivision District (for future sale of the property). Lisa Cox was present to represent the petition. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:05 p.m. A motion was made by Dr. Miller, seconded by Mr. Ingram, that the Board of Supervisors rezone this property from B-2, Business District, General to R-1, Residential Suburban Subdivision District. Motion passed unanimous. Case 3, Brenda Blair, R-10-017. Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton, Director of Code Compliance, reported that Brenda Blair had petitioned to rezone the A-1, Agricultural District portion of 10.32 acres to B-2, Business District, General (for future commercial development). The A-1 portion is 7.94 acres, located on U. S. Highway 29, in the Callands-Gretna Election District. Brenda Blair was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:07 p.m. A motion was made by Ms. Mease, seconded by Mr. Motley, that the Board of Supervisors rezone the A-1, Agricultural District portion of this property to B-2, Business District. General. Motion passed unanimous. Case 4, Withdrawn, R-10-018. Case 5, Parks I Limited Partnership, R-10-019. Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that Parks I Limited Partnership had petitioned to rezone the R-1, Residential Suburban Subdivision District portion of 9.51acres to RMF, Residential Multi-Family District (to make the zoning consistent with the adjoining parcel). The R-1 portion is .51 of an acre, located on at 1152 North Main Street, in the Banister Election District. William Fekas was present to represent the petition. He stated they just wanted the zoning consistent for rehab of the apartments. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m. A motion was made by Dr. Miller, seconded by Mr. Arthur, that the Board of Supervisors rezone the R-1, Residential Suburban Subdivision District portion of this property to RMF, Residential Multi-Family District. Motion passed unanimous. Case 6, River Landing, LLC , R-10-020. Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported that River Landing, LLC had petitioned to rezone the R-1, Residential Suburban Subdivision District portion of 63.66 acres to A-1, Agricultural District (to construct a dwelling and combine with the adjoining parcel which is zoned A-1). The R-1 portion is 49.47 acres, located off State Road 1142/Ferry Road, in the Westover Election District. Johnny Haymore was present to represent the petition. He stated he had nothing to add. He then clarified the location of the site and stated he owned property adjacent in the city but would construct his dwelling on the County property. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:11 p.m. A motion was made by Mr. Weatherford, seconded by Ms. Mease, that the Board of Supervisors rezone the R-1, Residential Suburban Subdivision District portion of this property to A-1, Agricultural District. Motion passed unanimous. This concludes the Rezoning Cases. Case S-1, Paulett Crews, S-10-005. Mr. Stowe opened the public hearing at 7:12 p.m. Mr. Shelton, Director of Code Compliance, reported that Paulett Crews had petitioned for a Special Use Permit on .50 of an acre, located on State Road 630/Hodnetts Road, in the Staunton River Election District (for emergency services, rescue and medical transport). Mr. Shelton further reported he had just received a complaint regarding junk cars Planning Commission Page 3 May 4, 2010 that will have to be removed from the property. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:14 p.m. A motion was made by Mr. Arthur, seconded by Mr. Welborn, that this petition be tabled until the cars are removed and the property is properly posted. Motion passed unanimous. OLD BUSINESS Mr. Sides discussed the progress with the Comprehensive Plan. He stated the Board of Supervisors would hold a public hearing on the plan on May 18, 2010. The Board commented that this was a good plan. NEW BUSINESS There was no new business.
