What Does It Mean to Be
“Grandfathered”?
Legally established lots, structures, and/or uses according
to applicable zoning laws at the time that the structure, lot,
or use began, but which do not meet current zoning
regulations.
State Code Section § 15.2-2307 allows localities to permit
nonconforming lots, structures, and uses to continue,
provided they are not enlarged, extended, reconstructed,
structurally altered unless such changes comply with
current zoning regulations. State Code provides for special
considerations where a locality has issued permits and/or all
local taxes have been paid for the previous fifteen years.
Residential Agriculture (Section 7-2-2)
•Changes proposed to better align with best
practices for accessory animal keeping and
allow more flexibility for residential
agriculture on large lots
•Virginia Extension Office: Support of
requirements related to spacing for animal
units; provide flexibility for residential
agriculture on large R-E and R-1 lots; allow
sheep similar to goats

“For the purpose of determining the number of livestock
animals permitted to be kept as residential agriculture, one (1)
animal unit shall be an animal of any size,except nursing
juveniles, and shall consist of domestic or domesticated
animals/fowl based on the following:”
“The keeping of livestock animals as a residential agriculture use
on lots of less than 10 acres, as permitted in Article VI, Use
Matrix, of this Ordinance, shall comply with (C), (D), and (E) of
this Section.
The keeping of livestock animals as a residential agriculture use
on 10 or more acres in the R-E, R-1, and MHP districts shall only
be permitted through administrative approval, in accordance
with Article III, Permits and Applications, of this Ordinance.
