Each person addressing the Board under a Public Hearing shall step
up, give his/her name and district, and/or his/her place of residency
for non-County citizens, in an audible tone of voice for the record,
and unless further time is granted by the Chairman, shall limit his/her
address to three (3) minutes; speakers for a group shall be limited to
ten (10) minutes. Speakers shall conclude their remarks at that time,
unless the consent of the Board is affirmatively given to extend the
speakers allotted time. Absent Chairman’s approval, no person shall
be able to speak who has not signed up.

SUMMARY:
Due to redistricting, the previous Tunstall precinct located at Tunstall High School
was located more than one (1) mile outside of the boundary and thus required
a location change. At its June Business Meeting, following a lawfully conducted
Public Hearing, the Tunstall precinct was moved from Tunstall High School to
Mount Hermon Baptist Church (Fellowship Hall). Subsequently, the Electoral
Board was notified that the new precinct was no longer available at Mount
Herman Baptist Church, and Shani A. Shorte ("Shorter"), Registrar, submitted a
waiver request to the State Board of Elections Commissioner Susan Beals on July
24, 2023, to change the location of the Tunstall Precinct from its current location
of 4385 Franklin Turnpike, Danville, Virginia 24540, Mount Hermon Baptist Church
(Fellowship Hall), to 100 Trojan Circle, Dry Fork, Virginia 24549, Tunstall High
School. This waiver request was approved on August 2, 2023, and Shorter was
granted a permanent exception for the precinct to be moved back to Tunstall
High School.
Following a lawfully advertised and conducted Public Hearing, the Board is
legally required to vote to amend Pittsylvania County Code (“PCC”) § 8-7 to
formally implement the Registrar’s aforementioned voting precinct relocation
recommendation. The proposed Voting Precinct relocation Public Hearing
Notice was advertised in the Chatham Star Tribune on August 23, 2023, and
August 30, 2023. For your reference and review, a copy of said PCC changes is
attached.
FINANCIAL IMPACT AND FUNDING SOURCE:
None.
RECOMMENDATION:
Following conducting of the legally required Public Hearing, County Staff
recommends approving the revision to PCC § 8-7 as attached and presented.

The Pittsylvania County Board of Supervisors will hold a Public Hearing at 7:00 p.m. on Tuesday,
September 5, 2023, at the Board Meeting Room, 39 Bank Street, Chatham, Virginia 24531, to
receive citizen input on proposed revisions to Pittsylvania County Code § 8-7 related to changing
the location of the Tunstall Precinct from its current location of 4385 Franklin Tpke, Danville,
Virginia 24540, Mount Hermon Baptist Church – Fellowship Hall, to 100 Trojan Circle, Dry Fork,
Virginia 24549, Tunstall High School. A complete copy of the proposed revisions is available at
the Pittsylvania County Administrator’s Office, 1 Center Street, Chatham, Virginia 24531,
Monday through Friday, 8:00 a.m. to 5:00 p.m., as well as on the County’s website at
www.pittsylvaniacountyva.gov.

PURPOSE OF THIS WAIVER
Pursuant to 24.2-310 (G), general registrars or the governing body of a locality may
submit this waiver if they wish to establish or relocate a precinct polling place that will
not be within the precinct or within one mile of the precinct boundary. ELECT will grant
this waiver if and only if general registrars or the governing body of a locality
certify that they meet all of the conditions in the waiver below.

Please describe how it was determined that there is no suitable building for this
polling place within the precinct*
The Pittsylvania County Electoral Board is requesting a waiver for the #106-Tunstall
precinct which is currently located in the Tunstall High School. We have reached out
to (5) different places, in the hopes we could use their facility, within the district and
all of them turned us down. They were the Mt. Herman Baptist Church, Mt. Herman
Fire Department, Mt. Freeman Baptist Church, Bethel Baptist, and Stanley Art Paving
Specialists. When the redistricting was done, the Tunstall precinct voting locality of
the High School fell out of the one mile radius. It is now 1.88 miles outside the
boundary. There is not another place in this rural area in which to have the voting
location.
The voters are familiar with this precinct as well and it will help ease confusion this fall
if we can maintain this voting precinct.
Therefore, we are asking that a motion be made that the Pittsylvania County Electoral
Board be granted a waiver to be allowed to use the Tunstall High School for the
voting precinct.
