MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, April 6, 2010, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting
to order at approximately 7:00 p.m. Mr. Stowe thanked the members for their concerns, flowers and cards on the passing of his mother. Dr. Miller gave the invocation. Mr. Stowe called
the roll.

No citizens came forward to speak.
APPROVAL OF THE MINUTES
A motion was made by Mr. Motley, seconded by Ms. Mease, and by a unanimous vote the March 2, 2010, minutes were approved as presented.
CHAIRMAN’S REPORT
There was no Chairman’s Report.
THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m.
Case 1, Roy & Doris Bennett, R-10-011. Mr. Stowe opened the public hearing at 7:02 p.m. Mr. Shelton, Director of Code Compliance, reported that Roy & Doris Bennett had petitioned to
rezone 1.22 acres, located on State Road 640/Renan Road, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (for
future subdivision of the property for family members). James Kent, Jr., was present to represent the petition. Mr. Kent explained the petition. There was no opposition to the petition.
Mr. Stowe closed the public hearing at 7:04 p.m. During the discussion it was stated this parcel was 800-1000 feet off the road and surrounded by farmland. A motion was made by Mr.
Arthur, seconded by Mr.Welborn, to recommend the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion
passed unanimous.

Case 2, Bertha A. Bennett, R-10-012. Mr. Stowe opened the public hearing at 7:05 p.m. Mr. Shelton, Director of Code Compliance, reported that Bertha A. Bennett had petitioned to rezone
1.00 acre, located on State Road 640/Renan Road, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District (for future
subdivision of the property for family members). Mr. James Kent, Jr., had explained this case with Case 1. There was no opposition to the petition. Mr. Stowe closed the public hearing
at 7:06 p.m. During the discussion it was stated this property is approximately 800 feet off the road and also has agricultural property around it. A motion was made by Mr. Arthur,
seconded by Mr. Ingram, that the Board of Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous.
Case 3, Clyde B. East, Trustee of Survivor Trust, R-10-013. Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Clyde B. East had
petitioned to rezone 0.442 of an acre, located on State Road 649/Payneton Road, in the Banister Election District from A-1, Agricultural District to R-1, Residential Suburban Subdivision
District (to combine with adjoining property). Jennifer East-Cole was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition.
Mr. Stowe closed the public hearing at 7:08 p.m. During the discussion it was stated the Board was familiar with this area and had no concerns regarding the rezoning. A motion was
made by Dr. Miller, seconded by Mr. Ingram, that the Board of Supervisors rezone this property from A-1, Agricultural District to R-1, Residential Suburban Subdivision District. Motion
passed unanimous.
Case 4, Pablo & Melody Ann Davila, R-10-014. Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Pablo and Melody Ann Davila had
petitioned to rezone 20.72 acres, located on State Road 1132/Old Mayfield Road, in the Westover Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural
District (for a second dwelling for a family member). Mr. Shelton further stated Mr. & Mrs. Davila had proffered that all deeds pertaining to the above-referenced parcel would have
a restriction prohibiting placement of single-wide and/or double-wide mobile homes, to satisfy the concerns of adjacent property owners and neighbors. Mr. Shelton also stated should
the Board decide to grant the rezoning, he would request that the Board member making the motion include the proffer. Mr. Davila was present to represent the petition. He stated he
wanted to survey off a parcel for his daughter to build a home. Melvin Hines came forward and stated his concerns regarding single-wide and double wide mobile homes and he had concerns
that this rezoning would decrease his property value. Vickie Baker then came forward and asked some questions regarding the position of the home, animals and fencing and the entrance
into the property. It was stated there would be a temporary drive for construction equipment. Mr. Davila stated this parcel did not have enough road frontage to survey off a lot for
his daughter. He also stated there would not be any animals, the home would be at the front of the property on Old Mayfield Road and that he felt a stick built home would increase the
value of the property. Mr. Stowe closed the public hearing at 7:19 p.m. A motion was made by Mr. Weatherford, with the proffer included, seconded by Mr. Motley, that the Board of
Supervisors rezone this property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimous.
This concludes the Rezoning Cases.
OLD BUSINESS
Mr. Sides and the Board discussed some issues regarding the Comprehensive Plan and some materials VDOT had asked to be included in the plan. He further stated these were not substantial
changes. It was decided that Mr. Sides would check regarding the legalities of adding these changes and inform the Board.
