PC Minutes 05 07 2019 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING May 7, 2019 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, May 7, 2019, in the General District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:00 p.m. Mrs. Hayes called the roll. PLEDGE OF ALLEGIANCE The Board recited the Pledge of Allegiance. HEARING OF THE CITIZENS No citizens came forward to speak. APPROVAL OF THE AGENDA Mrs. Hayes stated that Case S-19-004 had been removed from the agenda and the case would be heard next month. A motion was made by Mr. Dudley, seconded by Dr. Miller, and by a unanimous vote, the agenda was approved as corrected by Mrs. Hayes. Planning Commission May 7, 2019 Page 2 APPROVAL OF THE MINUTES A motion was made by Mr. Dudley, seconded by Mr. Stowe, and by a unanimous vote, the April 2, 2019, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m. Case R-19-016, James T. Motley – Mr. Motley opened the public hearing at 7:02 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Tommy Motley had petitioned to rezone 17.31 acres, located on Chalk Level Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to combine with the adjacent farm. She then stated once the property is rezoned to A-1, all uses listed under Section 35-178 are permitted. Mr. Motley was present to represent the petition. He stated the 17 acre parcel of land will not perk and he wanted to combine this parcel with the original farm. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:04 p.m. During the discussion, it was stated this parcel of land is surrounded by A-1, Agricultural District, zoned properties. A motion was made by Mrs. Mease, seconded by Mr. Haymore, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously. Case R-19-017, J D A Associates, Inc. – Mr. Motley opened the public hearing at 7:05 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that J D A Associates had petitioned to rezone a total of 98.66 acres, located off Orphanage Road, in the Chatham-Blairs and Westover Election Districts from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to subdivide into approximately seven (7) lots using the 50 feet of road frontage that was left from the developed subdivision. She then stated a proffer had been submitted. Mr. Billy Talbott was present to represent the petition. He stated he had nothing to add except most of the land would not perk. There was no opposition to the petition. Mr. Guy Lankford spoke during the hearing. He was not opposed to the development, but he had concerns as to whether a buffer of trees would be provided between his lot and the new development. Mr. Talbott offered a rebuttal and stated he did not intend to cut trees down. Mr. Motley closed the public hearing at 7:13 p.m. During the discussion, it was stated this is a win-win situation and this is not spot zoning. A motion was made by Mr. Haymore, seconded by Mr. Dudley, to recommend the Board of Supervisors grant the rezoning request with proffered conditions as presented in the packet as follows: (1) All deeds shall have a restriction prohibiting all uses listed in the A-1, Agricultural District other than those allowed by right in the R-1, Residential Suburban Subdivision District. Placement of single-wide mobile homes shall be prohibited. Stick built homes only to be built by Talbott Construction and Walker Contractors. Motion passed unanimously. Planning Commission May 7, 2019 Page 3 Case R-19-018, Kenneth Scott Yeaman – Mr. Motley opened the public hearing at 7:16 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Kenneth Yeaman had petitioned to rezone 5.00 acres, located on Mount View Road, in the Westover Election District from R -1, Residential Suburban Subdivision District to A-1, Agricultural District to consolidate with his adjacent farm. She then stated once the property is rezoned to A-1, all uses listed under Section 35-178 are permitted. Mr. Yeaman was present to represent the petition. He stated he had nothing to add except the five (5) acre parcel came off the original farm and he wanted to put it back into the farm to make the zoning consistent. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:17 p.m. A motion was made by Mr. Haymore, seconded by Mrs. Mease, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously. This concludes the Rezoning cases. Case S-19-003, Steven Lynn Amos & Anita H. Amos – Mr. Motley opened the public hearing at 7:18 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Steven and Anita Amos had petitioned for a Special Use Permit on property located off Glory Drive, in the Callands-Gretna Election District for a 195’ telecommunications tower and compound. Mr. Jonathan Yates was present to represent the petition. Mr. Yates gave a brief description of the project and then stated he would be glad to answer any questions. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:21 p.m. During the discussion, it was stated this is a win-win situation. A motion was made by Mrs. Mease, seconded by Mr. Stowe, to recommend to the Board of Zoning Appeals that the Special Use Permit request be granted. Motion passed unanimously. This concludes the Special Use Permit case. OLD BUSINESS There was no old business. NEW BUSINESS Potential Revision to SEC.35-406. MAXIMUM HEIGHT OF BUILDINGS. M-2, Industrial District, Heavy Industry Mr. Sides presented a potential revision to the Pittsylvania County Zoning Ordinance SEC. 35-406. MAXIMUM HEIGHT OF BUILDINGS., M-2, Industrial District, Heavy Industry, for the Board’s consideration. Mr. Matt Rowe, Director of Economic Development, presented an overview of the current maximum height for buildings in this zoning designation which is currently 80 feet, and stated an increase in the height of buildings, especially larger tracts located on properties zoned M-2, would be beneficial to Pittsylvania County by allowing for development of larger facilities that would have their own fire protection. A motion was made by Mr. Dudley, seconded by Mr. Haymore, to recommend the potential revision to SEC.35-406.MAXIMUM HEIGHT OF BUILDINGS. be referred to the Pittsylvania County Planning Commission for a Public Hearing at their June 4, 2019, meeting and authorizing County Staff to advertise the Planning Commission May 7, 2019 Page 4 proposed revisions to Pittsylvania County Code Section 35-406 for a Public Hearing for potential adoption at the June 18, 2019, Board of Supervisors Business Meeting. Motion passed unanimously. The meeting was adjourned at approximately 7:40 p.m.
