MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, April 2, 2019, in the General
District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately
7:00 p.m. Mr. Motley called the roll.

APPROVAL OF THE MINUTES
A motion was made by Mr. Dudley, seconded by Mr. Stowe, and by a unanimous vote, the March 5, 2019,
minutes were approved as presented.
CHAIRMAN’S REPORT
Mr. Motley read a thank you note from Tim and Kim Barber in appreciation of the flowers sent during the
recent loss of Mr. Barber’s mother, Mrs. Estelle Barber.
THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at
approximately 7:03 p.m.
R-19-012, Randy Thomas Owen & Nikki Robertson Owen – Mr. Motley opened the public hearing at
7:04 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Randy and Nikki Owen
had petitioned to rezone 15.590 acres, located on Meadowview Drive and on River Ridge Road, in the
Westover Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District
for agricultural purposes. She then stated once the property is rezoned to A-1, all uses listed under Section
35-178 are permitted. Mr. Owen was present to represent the petition. He stated he wanted to plant pine
trees for harvesting and someday add a pond on the property. Katherine Hamlett spoke in opposition to the
petition. Her concerns included, but were not limited to, the following: concerns regarding what will happen
once the property is rezoned to A-1; opposed to mobile homes (except a garage), junky cars, and farm
animals; wants the property to stay completely residential. Sue Phillips, Jason Miller, James Pendry and Don
Burton spoke in favor of the petition. Their comments included, but were not limited to, the following: this
rezoning is needed in the neighborhood; Mr. Owen should wait until the pine trees are ready to harvest to
rezone the property; Mr. Owen should wait until he builds his home to rezone the property. Mr. Owen
offered a rebuttal and stated the fifteen (15) acres were wooded with a few hardwoods and had not been
maintained in the past. Mr. Motley closed the public hearing at 7:39 p.m. A motion was made by Mr.
Haymore, seconded by Dr. Miller, to recommend the Board of Supervisors grant the rezoning request with
proffered conditions as follows: (1) If sold, the petitioners will petition to rezone back to R-1, Residential
Suburban Subdivision District, within thirty (30) days; (2) No manufactured housing will be allowed. Motion
passed by a 7 to 1 vote. Those voting in favor of the motion were as follows: Mr. Motley, Mr. Dudley, Mrs.
Mease, Mrs. Henderson, Mr. Haymore, Mr. Horne, and Dr. Miller. The Board member voting against the
motion was Mr. Stowe.
Case R-19-013, Henry Lynwood Reynolds, Life Tenant, and Henry E. Reynolds, Remainderman –
Mr. Motley opened the public hearing at 7:42 p.m. Mrs. Hayes, Deputy Director of Community
Development, reported that Henry Reynolds had petitioned to rezone 3.46 acres, located off Franklin
Turnpike, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1,
Agricultural District to make the zoning consistent with the farm. She then stated once the property is
rezoned to A-1, all uses listed under Section 35-178 are permitted. Mr. Reynolds was present to represent the
petition. He stated he wanted to combine with the farm. There was no opposition to the petition. Mr.
Motley closed the public hearing at 7:43 p.m. A motion was made by Mr. Stowe, seconded by Mr. Horne, to
recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously.

Case R-19-014, Jasmine E. Barbee – Mr. Motley opened the public hearing at 7:44 p.m. Mrs. Hayes,
Deputy Director of Community Development, reported that Jasmine Barbee had petitioned to rezone 3.77
acres, located on Cascade Road, in the Tunstall Election District from R-1, Residential Suburban Subdivision
District to A-1, Agricultural District to allow for subdivision of the property for family. She then stated once
the property is rezoned to A-1, all uses listed under Section 35-178 are permitted. Ms. Barbee not was
present to represent the petition. Mr. Stowe stated he could not find the sign posted on the property. There
was no opposition to the petition. Mr. Motley closed the public hearing at 7:45 p.m. A motion was made by
Mr. Stowe, seconded by Mr. Haymore, that no action be taken on this case. Mr. Vaden Hunt, County
Attorney, informed the Board members they have sixty (60) days to make a final decision on the case.
This concludes the Rezoning cases.
Case V-19-001, July, Inc. – Mr. Motley opened the public hearing at 7:49 p.m. Mrs. Hayes, Deputy Director
of Community Development, reported that July, Inc., had petitioned for a Variance of 25 feet on 0.84 acre,
located on W. Gretna Road and on Lotus Drive, in the Callands-Gretna Election District to Section 35.369.
MINIMUM YARD DIMENSIONS. (A.) Front Setback, of the Pittsylvania County Zoning Ordinance to
allow for installation of a 20 x 20 canopy over an existing gas pump. She then stated she had spoken with Jay
Craddock and he had no issues with the request at a VDOT standpoint. Tim Davis with Davenport Energy
was present to represent the petition. Mr. Davis stated in order for the store to be branded as Marathon, one
of Marathon’s requirements is that both gas pumps be covered with a branded canopy. He then stated the
additional canopy would allow customers to fuel their vehicles protected from rain and inclement weather and
would also provide better lighting and security. There was no opposition to the petition. Mr. Motley closed the
public hearing at 7:54 p.m. A motion was made by Mrs. Mease, seconded by Mr. Dudley, to recommend the
Board of Zoning Appeals grant this Variance request. Motion passed unanimously.
This concludes the Variance case.
OLD BUSINESS
Mrs. Hayes presented the site plan for the Danville Solar Project to the Board members for their review. A
copy of the Vegetation Management Plan for Danville Farm, LLC, was also presented to the Board members
for their review. Following questioning from the Board members, it was stated when the trees are planted,
they will be 4-6 feet tall.
NEW BUSINESS
PUBLIC HEARING – REVISION TO THE PITTSYLVANIA COUNTY ZONING ORDINANCE
Mr. Motley opened the public hearing at 8:00 p.m. Mrs. Hayes presented a revision to the Pittsylvania
County Zoning Ordinance, Section 35-50.EXEMPTIONS. The proposed amendment would add a new item to
the existing exemptions, specifically: (4) Electrical transmission lines sized 138kv or less, constructed to serve
a properly zoned industrial park shall be exempt from this Zoning Ordinance, with approval subject to a
public hearing and vote by the Board of Supervisors. No one was signed up to speak. Mr. Motley closed the
public hearing at 8:01 p.m. A motion was made by Mr. Dudley, seconded by Mr. Haymore, to recommend
that the proposed amendments to Section 35-50 of the Pittsylvania County Zoning Ordinance be referred to

the Pittsylvania County Planning Commission for a Public Hearing at their April 2, 2019, meeting and
authorizing County Staff to advertise the proposed revisions to Pittsylvania County Code Section 35-50 for a
Public Hearing for potential adoption at the April 16, 2019, Board of Supervisors Business Meeting. Motion
passed unanimously.
The meeting was adjourned at approximately 8:02 p.m.
