HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be
a resident or land owner of the County, or the registered agent of such
resident or land owner. Each person shall step up, give his/her name and
district in an audible tone of voice for the record, and unless further time
is granted by the Chairman, shall limit his/her address to three (3) minutes.
No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board
as a body and not to any individual member thereof. Hearing of the
Citizens shall last for a maximum of forty-five (45) minutes. Any individual
that is signed up to speak during said section who does not get the
opportunity to do so because of the aforementioned time limit, shall be
given speaking priority at the next Board meeting. Absent Chairman’s
approval, no person shall be able to speak who has not signed up.
PUBLIC HEARINGS
a.Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning
Ordinance, the Board of Supervisors have been empowered to
hear and decide specific zoning issues and zoning map changes in
support of said Ordinance. In accomplishing this important task, the
Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must
ensure that all of its decisions and regulations be directed to these
goals and that each be consistent with the environment, the
comprehensive plan, and in the best interest of Pittsylvania County,
its citizens, and its posterity.

Dr. Jones presented to the Board the School's Budget request for the upcoming year. Jones stated
that all County Elementary, Middle, and High Schools are at or above State average on the SOL
pass rates. Mrs. T. Worley also covered their plans for spending the remaining CARES ACT and
ARPA funds, as well as ADM history, and School Board priorities for FY 2024. The full 6

PRESENTATIONS
a. RiverStreet Broadband Project Update Presentation (30 minutes)
RiverStreet Networks’ Director of Business Development and Government Relations, Rob Taylor,
presented the Board a County Broadband Project update. He shared that 75% of the fiber design is
complete and property acquisition is 100% complete. Construction is currently underway in Sandy
Level and Renan, and they anticipate a possible Groundbreaking at the Java Volunteer Fire
Department towards the end of March or early April. His full presentation can be found on the

b. Virginia State Route 41 Traffic Study Update/Discussion (7 minutes); (J. Craddock
(VDOT)/B. Bowman)
Brenda Bowman spoke on behalf of businesses on the commercial corridor of Rt. 41 in the
Chatham-Blairs and Westover Districts of the County. She stated on January 21, 2023, a 66-year-
old woman died and a 17-year-old female was seriously injured due to an automobile accident in
front of the Tuscarora Shopping Center. That same afternoon, there were two (2) additional
accidents in the same area. In her efforts to gather information needed to request a traffic study
from VDOT, she learned that this corridor was already on their radar. She worked with Jay
Craddock (VDOT) and was able to advance the status of the study.
Craddock stated there is a "Project Pipeline" planning program that identifies solutions to
transportation needs in Virginia, and Bowman requested the Board fully understand the importance
of this study and support the efforts of this project in the next few years.
STAFF, COMMITTEE, AND/OR CONSTITUTIONAL OFFICER REPORTS
a. Town of Chatham/County Master Water and Sewer Agreement Revisions
Discussion (5 minutes)
Adcock stated that over the past several months, County Staff and Supervisor Warren (as
appointed by the Board as a representative) have been negotiating with Town of Chatham Staff
and Town Council Members to consolidate and update the various water and wastewater
agreements that have existed between the Town and the former Pittsylvania County Service
Authority since at least 1982. The consolidated and revised agreement will help to eliminate
service territory confusion and will simplify billing between the Town and County. The updated
agreement is on the night's Business Meeting Agenda for action.

HEARING OF THE CITIZENS
Jim Scearce, Westover District, shared concern regarding a Motion that was made at the December
Meeting to name the new Jail after former Sheriff McGregor and if there was a Naming Committee
Meeting. He stated he had consulted with his attorney about VA FOIA requirements and the
penalties that surround illegal Meetings and is awaiting his next steps.
Vanessa Scearce, Westover District, apologized for missing last month's Meeting as she was
attending Chamber Day at the Capitol. She believes it is more important now than ever to be
involved in government. Her hope is that the citizens of the County do their part to make this
County the best place to live, and she provided copies of The Constitution of the United States and
The Declaration of Independence for everyone.
Steven Vanairsdale, Chatham-Blairs District, is current active-duty army and has served over
twenty (20) years. He shared a quote by Teddy Roosevelt that said, "The most important single
ingredient in the formula of success is knowing how to get along with people." He stated humility
is a fragile thing, and he feels the Board has an obligation to move forward as a team.
Brenda Bowman, Chatham-Blairs District, followed up on her earlier presentation at the Work
Session with Jay Craddock, and asked the Board to support a traffic study for the commercial
corridor of Rt. 41 in the Chatham- Blairs and Westover Districts of the County.

Rezoning Public Hearings
1. Public Hearing: Case R-22-038: Myrtle Shields; Rezoning from A-1, Agricultural
District, to R-1, Residential Suburban Subdivision District. The Planning Commission
recommended, by an 8-0 vote, with no opposition, that the Petitioner's request be granted
(Supervisor Warren).
In Case R-22-038, Myrtle Shields (“Petitioner”) has petitioned to rezone 0.31 acres from A-1,
Agricultural District, to R-1, Residential Suburban Subdivision District (to allow the property to be
consolidated with an adjacent parcel zoned R-1). The subject property is located on State Road
835/Pleasant Gap Drive, in the Chatham-Blairs Election District, and shown on the Tax Maps as
GPIN # 2412-38- 6637. Once the property is rezoned to R-1, all uses listed under Pittsylvania
County Code § 35-222 are permitted. On January 3, 2023, the Planning Commission recommended,
by an 8-0 vote, with no opposition, that the Petitioner’s request be granted.

State Road 806/Ivory Branch Road, in the Callands-Gretna Election District, and shown on the Tax
Maps as GPIN # 1477-14-0194. Once the property is rezoned to A-1, all uses listed under
Pittsylvania County Code § 35-178 are permitted. On January 3, 2023, the Planning Commission

Other Public Hearings
1. PCC Chapter 43 Revisions (VA COIA Filing Forms)
Chapter 31 of the Code of Virginia outlines the Conflict of Interest Act for State and Local
Government, which includes annual disclosure statements that are required to be filed. Virginia §
2.2-3115 was recently updated and now requires Industrial Development Authority Members to file
the Statement of Economic Interest Form, instead of the Financial Disclosure Statement. County
Staff was also contacted by the Office of Children’s Services stating that all CPMT and FAPT
Members who are Parent Representatives and/or Private Providers, need to complete the Statement
of Economic Interest form as well.
For the above reasons, Pittsylvania County Code (“PCC”), Chapter 43, Disclosure of Personal
Business Interests by County Officials and Employees, needs to be updated to reflect said Virginia
Code changes, and to bring all other Boards and Commissions up to date with current filing
requirements. There are Boards that have been eliminated and created since the last update to PCC
Chapter 43.
Finally, this year, the Virginia Conflict of Interest Advisory Council sent communication that 14
localities can determine if they will allow electronic signature and acceptance of all annual filing
forms. If so, localities are required to adopt a written policy stating the same. County Staff believes
including this addition to PCC Chapter 43 will make the collection of filing forms more efficient.

2. Public Property Disposition (Southside Soccer, Inc.)
Southside Soccer Club, Inc, ("Soccer Club"), a non-profit tax-exempt corporation, has for some
time afforded thousands of County youths the opportunity to participate in an organized soccer
league. The Soccer Club has been very successful and enjoyed by many. Currently, the Soccer
Club uses the recreational fields adjacent to the old Blairs School located on East Whitt Road (Tax
Parcel ID# 2421-71-1625) in the Blair’s Magisterial District for soccer games. The Soccer Club
has approached the County requesting to have the land transferred to their ownership to pursue
grants to upgrade the facilities. This parcel is approximately 9.519 acres. The sale of land would
be for $1.00.

• Tucker thanked County Staff for their prep work for the Meetings and he also recognized
Black History Month. He stated he wanted to celebrate those who gave of themselves
to help make our Nation what it is today, and those who are currently making history in
their communities. 16
• Dudley thanked everyone for coming to the Meeting. He thanked County Staff for their
dedication to these Meetings, and to the Board for their work as well.
• Warren recognized Ronnie Haymore and stated his recent passing was a big loss for this
County. He served for many years on the IDA and coached many youths throughout the
County. He asked to remember his family in prayer and it is hard to find a public servant
such as Haymore.
• Scearce stated the last Resolution passed was to renew the contract for the County
Attorney, and he thanked Hunt for his service.
• Ingram echoed sentiments about Haymore and asked everyone to keep his family in
thought and prayer. He also recognized Black History Month and mentioned Wendell
Scott, Tommy McMannon, George Coleman, and Altavista native, Juan Thornhill, who
is the safety for the Kansas City Chiefs. He also recognized the Tunstall High School
Varsity Basketball team as they are working towards the State Championship.
• Chesher thanked everyone for coming to the Meeting and thanked Mrs. Scearce for a
copy of the Constitution. He stated one year ago this week he was in ICU, and now his
26-year-old daughter-in-law is going through the same thing and asked for prayers for
her. He also quoted "Hard times create hard men, hard men create soft times, soft times
create soft men, soft men create hard times" to remind everyone that there still are good
people out there.
• Dalton thanked citizens for coming out to the Meeting and thanked County Staff for their
work. He asked everyone to remember Jeff Stone's family after his passing, as he was a
former County employee, as well as the Haymore Family.
COUNTY ADMINISTRATOR REPORTS
Hunt thanked the Board for continuing to show their faith in him by approving his revisions
to his Employment Agreement. He stated that countless hours went into the preparation of
implementing new software at this Meeting, and he thanked County Staff for their hard work
and dedication.

Revisions include Utility-Scale Solar Energy Facilities shall not be located less than five

(2%) of the total acreage within a single zoning district shall be approved for use as a
Utility Scale Solar Energy Facility, and Utility Scale Solar Energy Facilities shall be
exempt from Sec. 35-141(C)(1) and (2), if the proposed Project has entered into a Power

Purchase Agreement (“PPA”), or similar agreement, with a tenant company located
within the defined boundaries of the Southern Virginia Megasite at Berry Hill, which
also has an approved Local Performance Agreement with the Board. Ragsdale’s full

SUMMARY:
Justin Price, County Director of Parks and Recreation, recently received the
attached Grant award notification from Danville Regional Foundation (“DRF”)
to fund fifty percent (50%); (up to, but not exceeding $25,000) of the expenses
associated with updating the County Parks and Recreation Department's
Master Plan. This Plan, which was originally created in 2010, needs to be
updated to establish new and confirm existing priorities for Parks and Recreation
for the next five (5) to ten (10) years.
FINANCIAL IMPACT AND FUNDING SOURCE:
This funding will pay up to $25,000 toward updating the Parks and Recreation
Master Plan. The total cost of this project is unknown at this time, but any
remaining funding for this update will come from the Virginia Department of
Forestry Grant and the Parks and Recreation Operating Budget.
RECOMMENDATION:
County Staff recommends the Board approve funding from DRF in the amount
of $25,000 and appropriate these funds to the Grants Fund to cover expenses
related to updating the Parks and Recreation Master Plan.

SUMMARY:
In 2021, the Board appropriated $1,000,000 to the Volunteer Fire and Rescue
Agencies and the funds were divided equally among the
Departments. However, there is a remaining balance of $11,588.45. At the
February 2023 Fire and Rescue Commission ("FRC") Meeting, the FRC approved
a request by the Fire and Rescue Association to have the remaining ARPA funds
($11,588.45) be used to assist with purchasing and implementing a County-wide
Accountability System to include accountability boards, rehab boards, triage
system, name tags, and training. Improving and standardizing fire ground
accountability was one of the recommendations from the 2016 Fire and Rescue
Study.
FINANCIAL IMPACT AND FUNDING SOURCE:
The ARPA funds are in the FY23 County Fire and Rescue Budget.
RECOMMENDATION:
County Staff recommends the Board approve the purchase of equipment as
proposed using the leftover ARPA funds in the County's Fire and Rescue Budget.

SUMMARY:
County Public Safety Department Staff (“Staff”) is requesting permission to apply
for the following Grant with the Rescue Squad Assistance Fund (“RSAF”) for one
(1) item in the Spring 2023 Cycle (note: Funding is usually at fifty percent (50%)
of the request):
• Replace a 2004 Ford F450 Type I Ambulance. The vehicle is currently in a
reserve status to fill in when necessary. Once replaced, the new ambulance will
be a front-line ambulance responding out of the Mt. Herman Station. The
vehicle is in fair shape, but the engine and transmission of the truck have had
serious repair issues. If this is approved for funding, it could be up to eighteen
(18) months before receiving the new truck, and by that time, Staff will need to
replace 2007 ambulance with 100,000 miles that is being run daily out of the
Chatham Fire Department. The Grant is for $143,000.00, with the total
replacement cost quoted at $320,513.00.
FINANCIAL IMPACT AND FUNDING SOURCE:
A portion of the matching funds for the ambulance were funded in the FY23
County Budget and the additional needed match has been requested in the
FY24 CIP County Budget.
RECOMMENDATION:
Staff recommends the Board authorize it to submit the RSAF Grant Application
request for the ambulance as presented, and if awarded, the Board approves
having the matching funds appropriated, should the additional matching funds
be appropriated in the FY24 County Budget.

HONORING CAPTAIN GEORGE COLEMAN’S RETIREMENT

VIRGINIA: The Pittsylvania County Board of Supervisors (“Board”) adopted the following Resolution at its
Business Meeting on March 21, 2023:
WHEREAS, after forty-two (42) years of serving the citizens of Pittsylvania County, Virginia, (“County”)
in the Sheriff’s Department, Captain George Coleman (“Coleman”) hung up his badge, retiring at seventy (70) years
old on January 31, 2023; and
WHEREAS, Coleman began his career with the County on June 16, 1980, when he was hired as a Field Deputy;
and
WHEREAS, throughout the years, Coleman moved up the ranks from Deputy to Field Sergeant and Field
Supervisor to Investigator, where he was responsible for looking into various crimes such as murders, rapes, sexual
assault, and crimes involving money; and
WHEREAS, in 2008, Coleman began working in Civil Process, dealing with serving subpoenas, depositions,
evictions, Sheriff sales, and other areas; and
WHEREAS, Coleman assisted with the development of a Crime Scene Unit, as well as the Crimestoppers
Program, and he played a key role in recruiting new deputies for the Sheriff’s Department and mentoring them after
they were hired; and
WHEREAS, Coleman believed in taking time with people and has worked to treat others with respect; and
WHEREAS, when Coleman was on the road, he made a point to stop and talk to citizens on their front porches,
in the fields, or at their place of business, where he earned respect from not only those in the County, but from Senators,
Delegates, Judges, Commonwealth Attorneys, and many other prominent people; and
WHEREAS, Coleman was an asset to the County and a loyal member of his community and faithfully
performed his duties in a diligent and dependable manner.
NOW, THEREFORE, BE IT RESOLVED, that the Board expresses its sincere appreciation to Coleman for his
forty-two (42) years of service to the County and his dedication of time towards the law enforcement community and
congratulates him on his well-deserved retirement.

RESOLUTION HONORING THE LIFE OF RONNIE L. HAYMORE
VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) Business Meeting on Tuesday, March
21, 2023, the following Resolution was presented and adopted:
WHEREAS, Ronnie Lee Haymore (“Haymore”) was born on May 30, 1947, in Danville, Virginia, and he
was the son of the late Herman Faye Haymore, Sr., and Lillian Hearp Haymore; and
WHEREAS, Haymore graduated from Tunstall High School in 1965, and married his high school sweetheart,
Penny Powell Haymore, in 1968; and
WHEREAS, Haymore served in the Virginia National Guard and was a long time Dry Fork tobacco farmer,
until he became the Owner/Operator of Danville Casket Company, Inc., which he ran until his passing; and
WHEREAS, Haymore loved all sports, especially baseball, as he was a catcher for Tunstall High School and
was a competitive and successful slow-pitch softball player for many years; and
WHEREAS, Haymore began coaching youth baseball in the 1980’s and eventually moved to Chatham High
School, where he coached for fourteen (14) years; and
WHEREAS, Haymore continued his passion of coaching at Hargrave Military Academy and George
Washington High School, and was inducted to the Pittsylvania County Sports Hall of Fame in 2014; and
WHEREAS, Haymore served multiple terms on the Pittsylvania County Department of Social Services Board
and was currently serving on the Pittsylvania County Industrial Development Authority and the Tunstall Volunteer Fire
and Rescue Department at the time of his passing; and
WHEREAS, Haymore was a faithful and loyal member of his community and faithfully performed his duties
in a diligent and dependable manner; he was always willing to give support, guidance, and love to anyone he
encountered.
NOW, THEREFORE, BE IT RESOLVED, as he was an honored and respected County citizen, that the Board
and the Industrial Development Authority expresses its sincere regret and grief over Haymore’s loss; and
BE IT FURTHER RESOLVED, that the Board of Supervisors and the Industrial Development Authority
expresses its condolences to Haymore’s family for their great loss; and

For the Board’s review and consideration, attached is a copy of a Resolution to
set rates for the upcoming FY 2023 - 2024 County Budget. Typically, these rates
are set when the Budget is adopted by the Board. It is necessary to set these
rates this year via Resolution, since the County has not received final State
Budget figures for fiscal year 2023 - 2024 and is therefore not able to adopt the
FY 2023-2024 County Budget at this time.
FINANCIAL IMPACT AND FUNDING SOURCE:
Setting these rates now will allow the Commissioner of Revenue and Treasurer's
Office to complete the tax billing process in a timely fashion. This will also allow
sufficient time for bills to be mailed to citizens and payments to be returned to
the Treasurer and processed in the system by year-end.

VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) Business Meeting on Tuesday,
March 21, 2023, the following Resolution was presented and adopted:
NOW, THEREFORE, BE IT RESOLVED, pursuant to the provisions of Virginia Code §58.01-3001,
the Board hereby establishes the tax levies for the fiscal budget year beginning July 1, 2023, and ending June 30,
2024, and calendar tax year beginning January 1, 2023, and ending December 31, 2023, as follows:

3524(C)(2) and 58.1-3912(E), 1950, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1)
and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of
Assembly, any qualifying vehicle situated within the County commencing January 1, 2023, shall receive personal
property tax relief in the following manner:
• Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief;
• Personal use vehicles valued at $1,001 to $20,000 will be eligible for 40% tax relief;
• Personal use vehicles valued at $20,001 or more shall only receive 40% tax relief on the first $20,000 of
value;
• All other vehicles which do not meet the definition of “qualifying” (business use vehicles, farm use
vehicles, motor home, etc.) will not be eligible for any of tax relief under this Program;
• Generating Equipment: $.62 per $100 of assessed value, 100% of value;
• Capital Merchant Tax:
Tier 1 $2.75 per $100 of assessed value, 30% of inventory value from $1
to $1,000,000;
Tier 2 $2.75 per $100 of assessed value, 10% of inventory value from
$1,000,001 to $5,000,000;
Tier 3 $2.75 per $100 of assessed value, 5% of inventory value from

$5,000,001 to unlimited; and
• Consumer Utility Tax: 20% of the first $15.00 monthly for residential users and 20% of the first
$100.00 monthly for commercial or industrial users, except as required for Gas and Electricity, as defined
by Chapter 6 Section 13 of the Pittsylvania County Code 1975, as amended.
BE IT FINALLY RESOLVED, that the following fees will also be collected by Pittsylvania County,
Virginia, for tax year beginning January 1, 2023, and for the fiscal year beginning on July 1, 2023:
• Motor Vehicle License Fee: $40.75 per vehicle/truck; $28.75 per motorcycle;
These are the rates not to exceed the vehicle registration fees set by the Virginia Department of Motor
Vehicles and Virginia Code; and
• County Fees for Services: These fees included in Exhibit “C.”

In Case R-23-001, Riceville Baptist Church (“Petitioner”) has petitioned to rezone
4.0 acres from R-1, Residential Suburban Subdivision District, to A-1, Agricultural

is located on State Road 640/Riceville Road, in the Banister Election District, and

In 2021, Pittsylvania County Code (“PCC”) § 35-141(C), Utility Scale Solar Energy
Facility, was amended to increase regulations for Utility Scale Solar Energy
Facilities. Specifically, said PCC section was revised to increase buffering
requirements and provide additional controls to ensure all conditions and
regulations are met prior to producing power, while reducing the required
distance between approved projects to allow the County to capitalize on the
ability to enter into Siting Agreements as allowed by the Virginia Code. In
October 2022, the Board instructed County Community Development Staff to
propose additional amendments to PCC § 35-141 to further restrict the
development of Utility Scale Solar Energy Facilities. On January 3, 2022, the
Planning Commission recommended, by an 8-0 vote, with no opposition, that
the proposed amendments be adopted. On March 7, 2023, the Legislative
Committee voted to send the proposed revisions to the full Board for review and
consideration. This Public Hearing has been duly advertised in the Chatham
Star Tribune on March 8, 2023, and March 15, 2023. For the Board's review and
consideration, attached are the proposed revisions to PCC § 35-141.

PROPOSED AMENDMENTS TO PCC § 35-141(C), UTILITY SCALE SOLAR ENERGY
FACILITY, AND PCC § 35-141(D), PERMITTING REQUIREMENTS FOR LARGE
SCALE AND UTILITY SCALE SOLAR ENERGY FACILITIES
SEC. 35-141(C). UTILITY SCALE SOLAR ENERGY FACILITY
1. Utility-Scale Solar Energy Facilities shall not be located less than one five (5) miles from
any other Utility Scale Solar Energy Facility.
1.2. No more than two percent (2%) of the total acreage within a single zoning district shall be
approved for use as a Utility Scale Solar Energy Facility.
2.3. No rezoning or Special Use Permit Application for a Utility Scale Solar Energy Facility
shall be initiated until the Applicant has first initiated negotiations with the County for a
Siting Agreement as authorized by the Code of Virginia.
Utility Scale Solar Energy Facilities shall be exempt from Sec. 35-141(C). Items 1. and 2. if the
proposed project has entered into a Power Purchase Agreement (“PPA”), or similar agreement,
with a tenant company located within the defined boundaries of the Southern Virginia Megasite at
Berry Hill which also has an approved local performance agreement with the Board of Supervisors.
SEC. 35-141(D). PERMITTING REQUIREMENTS FOR LARGE SCALE AND UTILITY
SCALE SOLAR ENERGY FACILITIES
In addition to the requirements of Article V, Division 4 (Site Development Plans) and, where
applicable, Article V, Division 3 (Special Use Permits) of Chapter 35, Pittsylvania County
Zoning Ordinance, the following documents, and information must be provided for review and
approval of large- and utility-scale solar energy facilities:
1. A narrative identifying the applicant, owner, and operator, and describing the proposed
solar energy project, including: an overview of the project and its location, approximate
rated capacity of the solar energy project, the approximate number, representative types
and expected footprint of solar equipment to be constructed, and a description of ancillary
facilities, if applicable.
2. Project site development and landscape plans demonstrating that the solar project
minimizes impacts on the visual character of an existing public right-of-way (ROW) or
historic properties listed on the Virginia Landmarks Register, or the National Register of
Historic Places.
3. A site plan meeting the requirements of Chapter 35, Article V, Division 4 Pittsylvania
County Code, including the following additional information and details:
a) Property lines and setbacks as set out below, unless required setbacks are increased by
the Board of Zoning Appeals as a condition of approval for a Special Use Permit.

• All aspects and components associated with a solar energy facility shall be no less
than one hundred fifty (150) feet from any property line. No setbacks are required
between the property lines of parcels that are adjacent to each other and within the
project area of a single project.
• The project area shall be no less than two hundred (200) feet from the property
line of any residential use located outside of the project area.
b) Existing and proposed buildings and structures, including preliminary location(s) of the
proposed solar equipment.
c) Existing and proposed access roads, drives, turnout locations, and parking; however, this
requirement shall not exceed VDOT requirements for other types of projects in the
underlying zoning district.
d) Location of substations, electrical cabling from the solar systems to the substations,
ancillary equipment, buildings, and structures (including those within any applicable
setbacks).
e) Fencing, or other methods of ensuring public safety, in accordance with Section 35-121.
f) Buffering as required based on the visual impacts of the project or as required by the Board
of Zoning Appeals as a condition of approval for a Special Use Permit. Required buffers
shall be placed or preserved between any required fencing and adjoining properties and/or
adjacent rights-of-way. Buffering or vegetative screening shall include a minimum 100-
foot-wide landscaped area comprised of any existing vegetation supplemented as needed
with a staggered row of planted trees and large shrubs. All rows of planted vegetation shall
be evergreen plantings of varieties native or adaptable to the region, with one (1) row
consisting of a variety expected to reach a minimum height of twenty-five (25) feet and the
remaining rows of varieties designed to reach at least fifteen (15) feet in height at maturity.
All evergreens shall be a minimum of six (6) feet in height at time of planting.
g) Additional information may be required, as determined by the Community Development
Director, such as a scaled elevation view and other supporting drawings, photographs of
the proposed site, photo or other realistic simulations or modeling of the proposed solar
energy project from potentially sensitive locations as deemed necessary by the Community
Development Director to assess the visual impact of the project, landscaping and screening
plan, coverage map, and additional information that may be necessary for a technical
review of the proposal. Landscape renderings or simulations shall be sealed by a registered
landscape architect.
4. Documentation shall include proof of control over the land or possession of the right
to use the land in the manner requested. The applicant may redact sensitive financial
or confidential information.
5. Document that the panels are located and installed so that the sum of the glare is
directed away from an adjoining property or public rights of way.

6. The applicant shall provide proof of adequate liability insurance for a large and
utility- scale solar facility prior to issuance of a zoning or building permit.
7. Power cannot be sold until a final inspection has been conducted to determine if all requirements
of this Ordinance, the Special Use Permit, and any Siting Agreement have been met, or a schedule
of completion, with appropriate surety as requested, has been approved by the Community
Development Director.
8. The facility operator shall provide the name and contact information of a person with authority
over the facility who can provide access for any requested inspections.
9. The facility shall be opened upon three (3) days’ notice for compliance inspections.
10. Prior to generation of power, a Fire Suppression Plan shall be approved by the Public Safety
Director.
11. All inspections required under the Uniform Statewide Building Code shall be conducted by a
third-party inspector in accordance with the Virginia Construction Code and the County’s Third-
party Inspection Policy. All associated inspection costs shall be borne by the facility operator.
12.A Viewshed Protection Plan shall be submitted to and approved by the Director of Community
Development prior to the issuance of permits, identifying appropriate measures that will be taken
throughout the viewshed surrounding the project.
Sec. 35-141(E) Decommissioning Requirements for Large and Utility Scale Solar Energy
Facilities
The owner or operator of a large or utility scale solar energy facility shall completely
decommission a facility within 12 months if the facility ceases to generate electricity for a
continuous period of 12 months This period may be extended by the Board of Zoning Appeals if
the owner or operator provides evidence that the failure to generate electricity is due to
circumstances beyond their control and the facility has not been abandoned. Decommissioning
shall include the removal of all solar collectors, cabling, electrical components, fencing and any
other associated equipment, facilities, and structures to a depth of at least 36 inches and
stabilization of the site, returning the property to a condition that is conducive to its prior use. A
decommissioning plan shall be submitted, which shall include the following: (1) the anticipated
life of the project; (2) the estimated decommissioning cost in current dollars, not including a
salvage or recyclable material value used to offset the decommissioning cost, provided in an
itemized format by a Virginia Licensed Professional Engineer (PE); (3) how said estimate was
determined; and (4) the manner in which the project will be decommissioned. As allowed by
Section 35-714 of the Pittsylvania County Zoning Ordinance, the Board of Zoning Appeals shall
require a bond with surety or other approved security to ensure compliance with conditions
imposed in a Special Use Permit. The plan shall acknowledge that if at any time the project is
declared to be an unsafe structure by the Pittsylvania County Building Code Official, the terms
of the “unsafe structure” code
shall apply.

Sec. 35-141(F) General Requirements for Large and Utility Scale Solar Energy Facilities
1. The height of roof mounted large and utility-scale solar energy facilities shall not exceed the
maximum height of other structures as permitted in the zoning district, and the maximum
height of ground mounted facilities shall be 15 feet, as measured from the grade or base of
the facility to its highest point,
2. Warning signage shall be placed on solar equipment and facilities to the extent appropriate.
Solar equipment shall not be used for the display of advertising, except for reasonable
identification of the photovoltaic equipment manufacturer or operator of the solar energy
facility. All signs, flags, streamers, or similar items, both temporary and permanent, are
prohibited on solar equipment except as follows: (a) manufacturer's or installer's
identification; (b) warning signs and placards; (c) signs that may be required by a federal
agency; and (d) signs that provide a 24-hour emergency contact phone number and warn of
any danger. Educational signs providing information about the project and the benefits of
renewable energy may be allowed as provided in Article II, Division 3 of the Pittsylvania
County Zoning Ordinance.
3. All large and utility scale solar energy facilities shall utilize components which have a UL
listing or equivalent and fully comply with all applicable building and electrical codes, and
shall not generate or create electrical interruptions or interference with existing electrical or
electronic uses.
4. All large and utility scale solar energy facilities shall comply with all applicable state and
federal permitting and regulatory requirements.
5. All large and utility scale solar energy facilities must comply with the Pittsylvania County
Noise Ordinance, but the requirements shall be no more stringent than for other development
in the underlying zoning district.
