03/09/2010PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING March 9, 2010 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, March 9, 2010, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 6:45 p.m. Mr. Easley gave the invocation. Mr. Shelton called the roll. PRESENT Kenneth Talbott R. Allan Easley Larry Estes Mrs. Helen Glass H. Blair Reynolds Carroll Yeaman Odie H. Shelton, Jr. ABSENT Ronald Merricks APPROVAL OF THE MINUTES By motion of Mr. Reynolds, seconded by Mr. Estes, and by unanimous vote the Minutes of the February 9, 2010, meeting were approved as presented. Old Business There was no old business. New Business Mr. Shelton reported there will be no cases for the April cycle. CHAIRMAN’S REPORT There was no Chairman’s report. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:00 p.m. Case S-1, Pat M. Allbeck, S-10-003 – Mr. Talbott opened the public hearing at approximately 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported that Pat Albeck had petitioned for a Special Use Permit on 100 feet x 100 feet (10,000 square feet), part of 8.83 acres, located off State Road 998/Albeck Drive, in the Staunton River Election District (for construction of a cellular communication tower). Mr. Richard Rosenfeld, Agent for AT & T, was present to represent the petition and stated that Crown Castle would be the company constructing the tower for four (4) or Board of Zoning Appeals March 9, 2010 Page 2 possibly five (5) carriers and that there are no dwellings near the proposed tower site. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:04 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Reynolds, seconded by Mrs. Glass, the following motion was adopted: Whereas, Pat M. Allbeck has petitioned the Board of Zoning Appeals for a Special Use Permit for construction of a cellular communication tower and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous. Case S-2, Randolph B. Chandler, S-10-004 – Mr. Talbott opened the public hearing at approximately 7:05 p.m. Mr. Shelton, Director of Code Compliance, reported that Randolph Chandler had petitioned for a Special Use Permit on 100 feet x 100 feet (10,000 square feet), part of 44.57 acres, located off State Road 924/Pocket Road, in the Staunton River Election District (for construction of a cellular communication tower). Mr. Richard Rosenfeld, Agent for AT & T, was present to represent the petition and stated that the proposed site for the tower is against the highway and the surrounding area is rural farmland. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:07 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Easley, seconded by Mr. Estes, the following motion was adopted: Whereas, Randolph B. Chandler has petitioned the Board of Zoning Appeals for a Special Use Permit for construction of a cellular communication tower and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted.
