02/09/2010PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING February 9, 2010 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, February 9, 2010, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 6:40 p.m. Mr. Easley gave the invocation. Mr. Shelton called the roll. PRESENT Kenneth Talbott R. Allan Easley Larry Estes H. Blair Reynolds Ronald Merricks Carroll Yeaman Odie H. Shelton, Jr. ABSENT Mrs. Helen Glass APPROVAL OF THE MINUTES By motion of Mr. Reynolds, seconded by Mr. Yeaman, and by unanimous vote the Minutes of the January 12, 2010, meeting were approved as presented. Old Business There was no old business. New Business Mr. Shelton reported there were two special use permit cases for the March cycle. Mr. Shelton also stated that a copy of the memorandum from Mr. William Sleeper dated February 4, 2010, regarding the Amendment to Inclement Weather Policy had been mailed to each of the Board members. CHAIRMAN’S REPORT Mr. Talbott welcomed Mr. Larry Estes to the Board of Zoning Appeals. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:00 p.m. Case S -1, Gerald A. Doss & Darlene K. Doss, S-10-001 – Mr. Talbott opened the public hearing at approximately 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported that Gerald and Darlene Doss had petitioned for a Special Use Permit on 5.37 acres, located on State Road 629/Piney Grove Road, in the Staunton River Election District Board of Zoning Appeals February 9, 2010 Page 2 (for emergency services, rescue and medical transport). Mrs. Doss was present to represent the petition and stated several issues regarding the application. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:15 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Merricks, seconded by Mr. Reynolds, the following motion was adopted: Whereas, Gerald and Darlene Doss have petitioned the Board of Zoning Appeals for a Special Use Permit for emergency services, rescue and medical transport and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous. Case S-2, Janice Lee Way LLC, S-10-002 – Mr. Talbott opened the public hearing at approximately 7:17 p.m. Mr. Shelton, Director of Code Compliance, reported that Janice Lee Way LLC had petitioned for a Special Use Permit on 94.3 acres, located on State Road 832/Halifax Road, in the Banister Election District (for an indoor shooting range). Mr. Tim Reynolds with Reynolds & Clark was present to represent the petition and gave a brief description of the construction and operation of the proposed indoor shooting range. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:24 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Easley, seconded by Mr. Estes, the following motion was adopted: Whereas, Janice Lee Way LLC has petitioned the Board of Zoning Appeals for a Special Use Permit for an indoor shooting range and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed unanimous. This concludes the Special Use Permit cases. Case Z-1, Edge Hill Church Parsonage, Z-10-003 – Mr. Talbott opened the public hearing at approximately 7:27 p.m. Mr. Shelton, Director of Code Compliance, reported that Edge Hill Church Parsonage had petitioned for a Sign Permit on 3.54 acres, located on State Road 668/Level Run Road, in the Staunton River Election District (for a second on-site church sign). Mr. Edward Moon, Jr., was present to represent the petition and stated that this would be a separate, stand-alone sign, and it may be digital; however, the church had not made a final decision regarding this. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:29 p.m. The Board discussed the petition as the Committee of the Whole and determined that there were no adverse effects. Upon motion of Mr. Reynolds, seconded by Mr. Merricks, the following motion was adopted: Whereas, Edge Hill Church Parsonage has petitioned the Board of Zoning Appeals for a Sign Permit for a second on-site church sign and, Whereas, the application meets the requirements of Section 35-95 of the Pittsylvania County Zoning Ordinance, I move the Sign Permit be granted. Motion passed unanimous. This concludes the Sign Permit case. .
