Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the

Mr. Haymore opened the public hearing at 7:02 p.m. Mrs. Ragsdale, Director of Community
Development, reported that Timothy Duffer, has petitioned to rezone 10.36 acres, generally
located off State Road 694/David Giles Lane, in the Chatham-Blairs Election District from B-2,
Business District, to RC-1, Residential Combined Subdivision District, to construct a single-family
dwelling. Timothy Duffer was present to represent the petition. There was no opposition to the
petition. Mr. Haymore closed the public hearing at 7:0 3 p.m. A motion was made by Mr. Waters,
seconded by Mr. Dudley to recommend the Board of Supervisors grant the rezoning request.

Development, reported that Samuel and Carolyn Munford have petitioned to rezone 0.203 acres,
generally located on State Road 834/Jones Mill Road, in the Tunstall Election District from A-1,
Agricultural District, to R-1, Residential Suburban Subdivision District to combine with an
adjacent parcel of land zoned R-1. Mr. and Mrs. Munford were present to represent the petition.
There was no opposition to the petition. Mr. Haymore closed the public hearing at 7:06 p.m. A
motion was made by Mr. Stowe, seconded by Mrs. Mease to recommend the Board of Supervisors

Development, reported that Michael and Cynthia Flanigan have petitioned for a Special Use Permit
on one parcel of land, a total of 2.00 acres, located at 1415 W I Powell Road, in the Chatham-
Blairs Election District to offer sales, service and operate a public garage. Michael Flanigan was
present to represent the petition. There was no opposition to the petition. Mr. Haymore closed the
public hearing at 7:14 p.m. A motion was made by Mr. Waters, seconded by Mrs. Mease to
recommend the Board of Supervisors grant the Special Use Permit. Motion passed by an eight (8)

was made by Ms. Henderson to approve the easement, seconded by Ms. Mease. Motion passed
by a seven (7) to zero (0) vote.

BACKGROUND/DISCUSSION
Andrew Pope is requesting to rezone a total of 1.339 acres from R-1, Residential Suburban
Subdivision District, to A-1, Agricultural District, so that property lines may be adjusted. If
rezoned, the property will be consolidated with an adjacent parcel currently zoned A-1,
Agricultural District. All properties must share the same zoning classification to be
consolidated, requiring the subject property to be rezoned prior to consolidation.
A plat titled Andrew Ryan Pope & Brianna Nicole Pope has been submitted with the application
to identify the area where zoning changes are necessary and to present the proposed property line
adjustments.
Once the property is rezoned to A-1, all uses listed under Section 35-178 are a permitted
use.
FUTURE LAND USE DESIGNATION
The Comprehensive Plan designates the future land use as Agricultural and Rural Residential.

Requested by Roger and Debra Emerson dba Da Spot, LLC, for a Special Use Permit for a
private club. The property is 5.67 acres, located on State Road 750/Whitmell School Road, in the
Chatham-Blairs Election District and shown on the Tap Maps as GPIN # 1480-76-0840.
BACKGROUND/DISCUSSION
The applicants are requesting a Special Use Permit to operate a private motorcycle club on the
subject property. The subject property is zoned A-1, Agricultural District. According to
Pittsylvania County Code § 35-179, Private Clubs are allowed by Special Use Permit. The club,
known as Da Spot, has operated at this location for several years. Staff learned that the property
was being used as a private club when members contacted Staff about regulations that might
apply to a club event that they were planning to have on the property.
The property is occupied by a structure that was originally used as a single-family dwelling. It is
now being used as the clubhouse for a private motorcycle club known as “Da Spot”.
DIRECTIONS
The address is 4953 Whitmell School Road.

BACKGROUND/DISCUSSION
The applicants are requesting a Special Use Permit to allow a cell tower to be constructed on the

According to Pittsylvania County Code § 35-384, Towers are allowed by Special Use Permit.
The proposed tower will occupy approximately 0.092 acres and will be approximately 260 feet
tall. After the installation of the lightning rod, the total height of the tower will be approximately
266 feet. Parallel Infrastructure is leasing this property from Mount Hermon Volunteer Fire &
Rescue and will own the tower. AT&T equipment will be installed once the tower is constructed.

BACKGROUND/DISCUSSION
The Dock at SML, LLC, is requesting a Special Use Permit to operate a marina and boat storage
area on a total of 23.25 acres, located State Road 626/Smith Mountain Road and Locus Lane, in
the Callands-Gretna Election District. A marina has been in operation on the property since
before the Pittsylvania County Zoning Ordinance was adopted in 1991, making the use legal
non-conforming. The applicant submitted a proposal to Community Development requesting to
add additional boat slips and a dry storage area. Due to the non-conforming status, the
applicant’s proposal was denied. According to Pittsylvania County Code § 35-164, non-
conforming uses cannot be expanded or enlarged unless they can be brought into compliance.
The Dock at SML, LLC is requesting a Special Use Permit for a marina to bring the property
into compliance in accordance with Pittsylvania County Code § 35-295, allowing the marina to
be expanded and dry boat storage to be added.
If the Special Use Permit is denied, the marina will still be allowed to continue as a legal non-
conforming use; however, they will not be allowed to modify the current boat slips or add
additional storage areas.
A Special Use Permit Application was heard by the Planning Commission in April 2021. At that
meeting, the Planning Commission tabled the application to give the applicant time to meet with
neighbors on Locust Lane and reach an agreement regarding the maintenance of Locust Lane.
After the April meeting, it came to the attention of Staff that the existing legal nonconforming
marina operation was out of compliance with the Virginia Department of Health, there were
existing violations preventing a demolition permit from being closed that included Erosion and
Sediment Control issues, and the original plans submitted to Community Development did not
match those being reviewed by AEP. On April 27, 2021, County Staff sent the applicant a letter

identifying six (6) things that must be done before Staff could recommend granting the Special
Use Permit. This letter is included in the packet. To date, the current nonconforming marina
operation is still out of compliance with the Virginia Department of Health State Marina
Regulations. Additionally, a meeting was held with property owners on Locust Lane on August
24, 2021. The applicants stated that their plan was to install an access to the property from Smith
Mountain Road but would not commit to eliminating the access from Locust Lane. A possible
maintenance agreement for Locust Lane was discussed if a Homeowners Association was
created; however, documentation of an agreement has not been provided. To Staff’s knowledge,
the process has not been initiated.

marina operation into compliance with applicable VDH regulations and ongoing discussions
regarding the use and maintenance of Locust Lane.
If the Planning Commission chooses to recommend APPROVAL, Staff recommends the
following conditions:
1. Smith Mountain Road be used as the access for the property.
2. Construction of the proposed marina expansion cannot begin until the Smith Mountain
Road access has been installed.
3. The current “No Wake” buoy must be maintained in the cove and the applicant must
apply and exercise reasonable and good faith efforts to secure an additional “No Wake”
buoy.
4. Must remain in compliance with all applicable Virginia Department of Health
regulations.
5. Must remain in compliance with AEP regulations.

Currently, Pittsylvania County Code (“PCC”), Chapter 35, Division 11, Industrial District, Light
(M-1); PCC Sec. 35-387, Maximum Height of Buildings; and PCC, Chapter 35, Division 12,
Industrial District, Heavy Industry (M-2); PCC Sec. 35-406, Maximum Height of Buildings,
limits the maximum height of structures to eighty (80) feet. As technology continues to evolve
as it relates to manufacturing, and a wider variety of manufacturing businesses continue to locate
within Pittsylvania County, it has come to Staff’s attention that this height restriction has become
a hardship for potential companies, specifically large manufacturing operations locating in the
County’s Industrial Parks. Staff is proposing to increase the maximum height of buildings on
properties within M-1, Industrial District, Light, and M-2, Industrial District, Heavy Industry
zoning districts, and within the boundaries of an identified Industrial Park, be increased to a
maximum height of 120 feet. A redline version of the related sections are included in the packet
showing the proposed changes.
RECOMMENDATION

SEC. 35-382. PURPOSE
This district is established to encourage the development of manufacturing and wholesale business establishments
which do not produce high levels of smoke, smell, noise, light, dust and other nuisances; who operate primarily
within enclosed structures and who do not deal with large volumes of customers on a continuous basis throughout
the day.
Limitations on (or provisions relating to) height of building, horsepower, heating, flammable liquids or explosives,
controlling emission of fumes, odors, or noise, landscaping and the number of persons employed may be imposed
to protect and foster environmental desirability while permitting industries of certain types to locate near a labor
supply, provided buffering districts or buffering land is provided, Buffer zones may required by the Zoning
Administrator to mask industry operations from adjacent non-industrial zoned districts. This buffering may take
several forms including but not limited to fencing, barriers, trees, shrubs, or other ornamental landscaping. This
buffering action will be the responsibility of the industry and the requirements described on the zoning document
and/or building permit.

SEC. 35-386. AREA REGULATIONS
Notwithstanding any definitive area requirement herein, the minimum permitted size of any commercial district or
commercial lot, parcel, or tract shall be subject to approval by the local Department of Health.
SEC. 35-387. MAXIMUM HEIGHT OF BUILDINGS
The maximum height of buildings in this district shall be eighty (80) feet.
The maximum height of buildings located within an Industrial Park recognized by Pittsylvania County shall be one
hundred twenty (120) feet.
Belfries, cupolas, chimneys, flues, flagpoles, television antennae, radio aerials, silos, and water tanks are exempt.
Any building or structure shall be constructed, erected, maintained, and be of an approved type in accordance with
the provisions-of the Virginia Uniform Statewide Building Code as amended and the Fire Prevention Code.
SEC. 35-388. MINIMUM YARD DIMENSIONS
A. Front Setback
Setback from the nearest point of house or principal structure (including porches, stoops or any accessory buildings)
shall be thirty-five (35) feet from the edge of right-of-way.
B. Side Setback
No side setback is required except that no building, structure, accessory use or outdoor storage area shall be located
closer than fifty (50) feet from any type of residential use or living quarters nor residential district boundary.
C. Rear Setback
No rear setback is required except that no building, structure, accessory use or outdoor storage area shall be located
closer than fifty (50) feet from any type of residential use or living quarters nor residential district boundary.
SEC. 35-389. MAXIMUM FLOOR AREA

DIVISION 12. INDUSTRIAL DISTRICT (M-2); HEAVY INDUSTRY
SEC. 35-401. PURPOSE
This district is established to provide locations for larger scale manufacturing, processing, and
warehousing operations which may require extensive community facilities and access to
transportation facilities have open storage and service areas and generate heavy, truck traffic. These
districts may be established by amendment to the Zoning Map to permit industries which have a
public nuisance potential and will therefore be subject to intensive review for locational impact on
surrounding land uses and environment. These districts may be established in areas; a) that are served
by major highways, rail or air service, or secondary road improved to state standards; b) that are
either served by public water and sewer or meet requirements of the local office of the State Health
Department, and c) that are clearly suitable for intended uses with regard to physical characteristics
and relationship to surrounding development. This district is designed to encompass heavy
manufacturing with large outside storage, warehousing, and large product display, areas. Buffering
zones may be required by the Zoning Administrator to mask industry operations from adjacent non-
industrial zoned districts. This buffering may take several forms including but not limited to fencing,
barriers, trees, shrubs, or other ornamental landscaping. This buffering action win be the
responsibility of the industry and requirements described on the zoning document and/or building
permit.
