Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the

Mr. Haymore opened the public hearing at 7:04 p.m. Mrs. Hayes, Deputy Director of
Community Development, reported that the Olde Dominion Agricultural Foundation, Inc. has
petitioned to rezone 2.39 acres, generally located off US Highway 29, in the Banister Election
District from M-1, Industrial District, Light Industry to A-1, Agricultural District to combine
with an adjacent parcel of land zoned A-1. No representatives were present to represent the
petition. There was no opposition to the petition. Mr. Haymore closed the public hearing at 7:05

6. Public Hearing: Case S-21-007 Rodney and Patricia Barker; Special Use Permit for a
Kennel (Haymore)
Mr. Haymore opened the public hearing at 7:16 p.m. Mrs. Hayes, Deputy Director of
Community Development, reported that Patricia Barker, has petitioned for a Special Use Permit
on one parcel of land, a total of 4.75 acres, generally located on US Highway 29, in the
Westover Election District for a kennel for boarding and grooming dogs . Patricia Barker was
present to represent the petition. Dan Marshall, and Hunter Byrnes spoke in opposition to the
petition. Their concerns included but were not limited to: property values decreasing, noise level
due to the kennel being adjacent to homeowners, and the overall negative impact on the
neighborhood. Several Board members had questions as well. Mr. Harker questioned the
entrance from R-1 property, and suggested the entrance should be located off of US Hwy 29
using the B-1 property for all kennel traffic. Mrs. Mease questioned the number of dogs that
would be groomed on a daily basis (eight to ten). Mr. Waters questioned when the structure
would be built (only if Special Use Permit passes and amount of business allows for new
structure). Mr. Haymore closed the public hearing at 7:34 p.m. A motion was made by Mr.
Dudley, seconded by Mr. Stowe to recommend the Board of Supervisors deny the Special Use
Permit. Motion passed by a 5 (five) to 3 (three) vote.

Use Permit on one parcel of land, a total of 14.70 acres, located on State Road 734/Clarks Mill
Road, in the Dan River Election District to operate an Event Venue. R. J. Lackey was present to
represent the petition. Mr. Haymore closed the public hearing at 7:38 p.m. A motion was made
by Mr. Horne, seconded by Mr. Dudley to recommend the Board of Supervisors grant the
Special Use Permit. Motion passed by an 8 (eight) to 0 (zero) vote.

BACKGROUND/DISCUSSION
Timothy Duffer is requesting to rezone a total of 10.36 acres from B-1, Business District
General, to RC-1, Residential Combined Subdivision District. Currently, one parcel is occupied
by a single-family dwelling and the other is currently vacant. The applicant is in the process of
selling both properties. Potential buyers of the vacant parcel are interested in constructing a
single-family dwelling on the property to conform with the use of the surrounding properties.
Additionally, in order for potential buyers of properties to get financing, banks are requesting
that the zoning of the parcels match the intended use.
The majority of the properties along David Giles Lane are residential properties with the
exception of a few properties used for agricultural purposes.
Once the property is rezoned to RC-1, all uses listed under Section 35-266 are a permitted
use.
FUTURE LAND USE DESIGNATION
The Comprehensive Plan designates the future land use as Agricultural and Rural Residential.

BACKGROUND/DISCUSSION
The applicants are proposing to operate a public garage on the subject property. Due to the
applicant’s request to service automobiles, a Special Use Permit for a public garage is required in
accordance with Pittsylvania County Code § 35-179. The applicants currently operate a towing
and repair business in the City of Danville and have stated that this will not be an expansion of
that operation. They will be using an existing structure on the property and plan to primarily
restore antique vehicles.
Currently, the property is accessed by a shared driveway that provides access to the subject
property and two neighboring properties. A maintenance agreement was signed in 1992 between
the property owners stating that the private road could be used for access and the maintenance
was to be shared between property owners using the road. This agreement is still in affect and a
copy is included in the packet.

Staff recommends APPROVAL of Case S-21-009 with the following conditions:

1. This property shall not be used for the sale of automobiles.
2. Repair activities shall be contained within an enclosed structure.
3. Inoperable vehicles shall not be stored on the property for longer than two (2) weeks and
must be stored in an area screened in accordance with PCC § 35-121.
