Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.

Regular Meeting - May 4, 2021
Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the
board regarding zoning cases will be limited to (3) three minutes.

April 6, 2021 in the Board Meeting Room, 39 Bank Street, SE, Chatham, Virginia. Chairman -

HEARING OF CITIZENS
Open at 7:07 p.m., Pat Sheldon, owner of Romar Elevators, voiced concerns regarding required
parking for his storage facility located on U.S Highway 29. Mr. Sheldon stated that his use was
not properly accounted for in Pittsylvania Count Code Section 35-82; therefore, the Planning
Commission should set the required parking under Section 35-82 (6). Other Uses. Mr. Haymore
suggested that he go before the Board of Zoning Appeals for a Variance. County Attorney Vaden
Hunt suggested a meeting with Mr. Sheldon at a later date to further discuss this matter. The
Hearing of the Citizens closed at 7:09 p.m.

PUBLIC HEARING

Mr. Haymore opened the public hearing at 7:14 pm. Mrs. Ragsdale, Director of Community
Development, reported that Cornerstone Church of Christ petitioned to rezone 1.74 acres, located
on State Road 703/Fairview Road N, in the Banister Election District from R-1, Residential
Suburban Subdivision District, to A-1, Agricultural District, to combine with an adjacent parcel of
land zoned A-1. William Randolph was present to represent the petition. There was no opposition
to the petition. Mr. Haymore closed the public hearing at 7:16 pm. A motion was made by Mrs.
Mease, seconded by Mr. Stowe, to recommend the Board of Supervisors grant the rezoning
request. Motion passed by a 7 to 0 vote (one (1) member, Ms. Henderson was absent).

Development, reported that Gregory & Janie Robinson petitioned to rezone 24.72 acres, located
on State Road 750/Oxford Road, in the Callands-Gretna Election District from R-1, Residential
Suburban Subdivision District, to A-1, Agricultural District to allow for an additional dwelling to
be placed on the property. Gregory Robinson was present to represent the petition. There was no

District, to A-1, Agricultural District to combine with an adjacent parcel of land zoned A-1. Mr.
Gatewood was present to represent the petition. There was no opposition to the petition. Mr.

Development, reported that Mark Redd, contract purchaser, petitioned to rezone 0.118 acres,
located off State Road 685/Chalk Level Road, in the Banister Election District from A-1,
Agricultural District, to R-1, Residential Suburban Subdivision District, to combine with an
adjacent parcel of land zoned R-1. Mr. Redd was present to represent the petition. There was no
opposition to the petition. Mr. Haymore closed the public hearing at 7:23 pm. A motion was made
by Mr. Stowe, seconded by Mrs. Mease to recommend the Board of Supervisors grant the rezoning

Development, reported that Jeremy & Julia Watson petitioned to rezone 44.30 acres, located on
State Road 665/ Rockford School Road, in the Staunton River Election District from RC-1,

use. Mr. Watson was present to represent the petition. Faye Dalton, Juan Smith, Ruby Wilson,
James Wilson, & James Gibson spoke in opposition. Their concerns included but were not limited
to: the tax values of their properties decreasing, concern for the number of livestock that could
occupy the property and future use of the property if sold. Mr. Haymore closed the public hearing
at 7:57 pm. Mr. Watson, petitioner, stated that only 10-12 cattle would be on the property and he
does not plan to keep cattle during the winter months. A motion was made by Mr. Harker, seconded
by Mr. Dudley, to deny the rezoning request. Motion passed by a 7 to 0 vote (one (1) member, Ms.
Henderson was absent).

Mr. Haymore opened the public hearing at 7:59 pm. Mrs. Ragsdale, Director of Community
Development, reported that Gentry Farms, LLC, petitioned to rezone two parcels totaling 56.13
acres, located on State Road 734/Clarks Mill Road, in the Dan River Election District from R-1,
Residential Suburban Subdivision District, to A-1, Agricultural District, to allow for agricultural
use and an event venue. Mr. R.J. Lackey was present to represent the petition. Mr. Haymore closed
the public hearing at 8:00 pm. A motion was made by Mr. Horne, seconded by Mr. Stowe, to grant
the rezoning request. Motion passed by a 7 to 0 vote (one (1) member, Ms. Henderson was absent).

Mr. Haymore opened the public hearing at 8:02 pm. Mrs. Ragsdale, Director of Community
Development, reported that IPS Solar, LLC, petitioned for a Special Use Permit, on one (1) parcel
of land, a total of 62 acres, located off Highway 40/East Gretna Road, in the Callands-Gretna
Election District (for a utility-scale solar energy facility). Representatives from IPS Solar, LLC
were present to represent the petition. Mr. Haymore closed the public hearing at 8:09 pm. A motion
was made by Mrs. Mease, seconded by Mr. Stowe to grant the Special Use Permit. Motion passed
by a 7 to 0 vote (one (1) member, Ms. Henderson was absent).

8. Case S-21-003 The Dock at SML, LLC; Special Use Permit for a Marina (Mease)
Mr. Haymore opened the public hearing at 8:12 pm. Mrs. Ragsdale, Director of Community
Development, reported that The Dock at SML, LLC, petitioned for a Special Use Permit, on four
(4) parcels of land, a total of 23.25 acres, located on State Road 626/Smith Mountain Road and
Locust Lane, in the Callands-Gretna Election District (for a marina with boat storage). Jeff Wilson
from The Dock at SML, LLC was present to represent the petition. Ronald Root, Lloyd Ruona,
Amy Smitherman, & Deborah Foor spoke in opposition. Their concerns included but were not
limited to: damage to Locus Lane caused by construction vehicles being used on this project,
repairs not being made to Locust Lane, increased in traffic on Locust Lane as the project is
completed, parking accommodations for vehicles towing boats to access boat ramps, and large fuel
trucks that will service the marina. Homeowners on Locust Lane, a private road, have maintained
the road, incurring expenses of fresh gravel and making repairs when needed. Due to the volume
of traffic on their private road, adjacent property owners requested that The Dock at SML, LLC
help with costs to maintain and to repair damage to Locust Lane. Mr. Haymore and Mrs. Mease
both read e-mails that they received opposing this project. Many of the residents stated that they
would like to see Route 626/Smith Mountain Road used as the primary access point. Mr. Haymore
closed the public hearing at 8:45 pm. Mrs. Mease made the motion to grant the Special Use Permit
with the conditions recommended by Staff with the addition that Route 626/Smith Mountain Road
be used as the property entrance. The Motion died, due to lack of a second. A motion was made
by Mr. Harker, seconded by Mr. Dudley, that this case be tabled until the ownership group and
adjacent property owners can meet to discuss concerns and come to an agreement regarding the
maintenance of Locust Lane. Motion passed by a by 7 to 0 vote (one (1) member, Ms. Henderson
was absent).

BACKGROUND/DISCUSSION
George and Kathy Jones are requesting to rezone a total of 0.083 acres from B-1, Business
District, Limited, to R-1, Residential Suburban Subdivision District, so that property lines may
be adjusted. If rezoned, the property will be consolidated with an adjacent parcel currently
zoned R-1, Residential Suburban Subdivision District. All properties must share the same
zoning classification to be consolidated, requiring the subject property to be rezoned prior to
consolidation.
A plat titled George Thomas Jones, Jr. & Kathy Kennedy Jones has been submitted with the
application to identify the area where zoning changes are necessary and to present the proposed
property line adjustments.
Once the property is rezoned to R-1, all uses listed under Section 35-222 are a permitted
use.
FUTURE LAND USE DESIGNATION
The Comprehensive Plan designates the future land use as Agricultural and Rural Residential.

Requested by Robert Vaughan, to rezone property located on State Road 631/Dews Road, in the
Staunton River Election District and shown on the Tax Maps as GPIN # 2574-27-4340. The
applicant is requesting to rezone 34.40 acres, from R-1, Residential Suburban Subdivision
District, to A-1, Agricultural District to allow for Agricultural Uses (Livestock).
BACKGROUND/DISCUSSION
Robert Vaughan is requesting to rezone 34.40 acres from R-1, Residential Suburban Subdivision
District, to A-1, Agricultural District. The applicant is requesting to use the property for
livestock. Under the current zoning classification, this type of use would only be allowed as an
incidental use. Section 35-51 of the Pittsylvania County Zoning Ordinance states that “incidental
agricultural is permitted in any district that allows residential uses provided that such agricultural
use shall not occupy over five (5) acres.” In order for the property to be used for agricultural
uses that would allow livestock with the current R-1 zoning classification, the agriculture use
would have to remain under five (5) acres.
The property is currently occupied by a single-family dwelling and multiple accessory buildings.
The subject property is adjacent to properties zoned A-1, Agricultural District on the south, east,
and west.
Once the property is rezoned to A-1, all uses listed under Section 35-178 are a permitted
use.
FUTURE LAND USE DESIGNATION
The Comprehensive Plan designates the future land use as Agricultural and Rural Residential.

BACKGROUND/DISCUSSION
Ronnie Warren is requesting to rezone 6.45 acres from R-1, Residential Suburban Subdivision
District, to A-1, Agricultural District. The applicant is requesting to place a second dwelling on
the property. Pittsylvania County Code § 35-53 allows an additional dwelling to be placed on
properties zoned A-1, Agricultural District, or C-1, Conservation District as long as all the
additional dwelling can meet the minimum lot area, minimum lot width, and maximum lot
coverage for the Zoning District; the arrangement of the additional dwelling is in such a manner
that if the lot were to be subdivided, a nonconforming lot would not be created; and the
additional dwelling has access to a public street by a passage that is at least fifteen (15) wide.
The property is currently occupied by a single-wide mobile home. Based on the position of the
current structure, another dwelling could be placed on this property and meet the requirements of
PCC § 35-53.
Once the property is rezoned to A-1, all uses listed under Section 35-178 are a permitted
use.

The Comprehensive Plan designates the future land use as Agricultural and Rural Residential.

on the Tap Map as GPIN # 1563-52-1714, 1563-53-1917, 1563-53-1623 and 1563-53-1223.
BACKGROUND/DISCUSSION
The Dock at SML, LLC, is requesting a Special Use Permit to operate a marina and boat storage
area on a total of 23.25 acres, located State Road 626/Smith Mountain Road and Locus Lane, in
the Callands-Gretna Election District. A marina has been in operation on the property since
before the Pittsylvania County Zoning Ordinance was adopted in 1991, making the use legal
non-conforming. The applicant submitted a proposal to Community Development requesting to
add additional boat slips and a dry storage area. Due to the non-conforming status, the
applicant’s proposal was denied. According to Pittsylvania County Code § 35-164, non-
conforming uses cannot be expanded or enlarged unless they can be brought into compliance.
The Dock at SML, LLC is requesting a Special Use Permit for a marina to bring the property
into compliance in accordance with Pittsylvania County Code § 35-295, allowing the marina to
be expanded and dry boat storage to be added.
At the April 6, 2021 meeting, the Planning Commission tabled this request to allow the applicant
to meet with neighboring property owners and attempt to reach an agreement regarding the
maintenance of Locust Lane. The applicants are requesting to withdraw their application without
penalty, allowing them to reapply at a later date.
RECOMMENDATION
Staff recommends APPROVAL of the request to withdraw without penalty.

BACKGROUND/DISCUSSION
The Mill House at Motleys Mill, LLC is requesting a Special Use Permit to operate an Event
Venue on the subject property. A dwelling was constructed on the property in 2017 and a permit
for the construction of a pavilion was issued. In 2021, The Building Official determined that the
applicants would need to renew their permit due inactivity. It was then determined that the work
that had been done on the property expanded beyond the original permit. Due to modifications
made to the initial design of the building, the applicants were notified that a new building permit
would be required. Before this could be issued, a Special Use Permit would need to be granted.
The subject property is zoned A-1, Agricultural District. According to Pittsylvania County Code
§ 35-179, Recreational Uses require a Special Use Permit.
At this time, all construction that has been done has been inspected by the Pittsylvania County
Building Inspections Office and has been approved. If a Special Use Permit is granted,
additional inspections will be needed before a Certificate of Occupancy can be issued.
The majority of this property is located within the 100-year flood plain. The current construction
is outside of the flood plain; however, any future construction activities will need to comply with
the Pittsylvania County Floodplain Ordnance.
