PC Minutes 09 04 2018PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING September 4 , 2018 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, September 4, 2018, in the General District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Motley called the roll. APPROVAL OF THE AGENDA A motion was made by Mr. Horne, seconded by Dr. Miller, and by a 7 to 0 vote (one (1) member, Mr. Stowe, was absent), the agenda was approved as presented. APPROVAL OF THE MINUTES A motion was made by Mr. Horne, seconded by Mr. Haymore, and by a 7 to 0 vote (one (1) member, Mr. Stowe, was absent), the August 7, 2018, minutes were approved as presented. CHAIRMAN ’S REPORT Mr. Motley welcomed Mr. J. Vaden Hunt, County Attorney, to the meeting. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately 7:03 p.m. Planning Commission September 4, 2018 Page 2 Case R-18-01 8, Mozelle K. Reynolds, Life Tenant (Deceased), Nancy Reynolds Amos, Remainderman, Randall C. Amos, Remainderman, Janice Reynolds Spinella, Remainderman , & David G. Spinella, Remainderman – Mr. Motley opened the public hearing at 7:03 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Nancy Reynolds Amos and Others had petitioned to rezone 0.450 acre from A-1, Agricultural District to R-1, Residential Suburban Subdivision District, and 0.679 acre from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to combine with the adjacent parcels of land zoned R-1 and A-1, respectively. She then stated the petitioners were moving lot lines and the parcels are located on State Highway 57/Callands Road, in the Callands-Gretna Election District. Mrs. Hayes also stated once the properties are rezoned to R-1 and A-1, all uses listed under Section 35-222 and Section 35-178 are permitted. Mrs. Janice Spinella was present to represent the petition. She stated she had nothing to add except the house would be sold. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:04 p.m. A motion was made by Mrs. Mease, seconded by Mr. Haymore, to recommend the Board of Supervisors grant the rezoning request. Motion passed by a 7 to 0 vote (one (1) member, Mr. Stowe, was absent). Case R-18-01 9, Roger C. Chriscoe & Kathy C. Chriscoe – Mr. Motley opened the public hearing at 7:05 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Roger and Kathy Chriscoe had petitioned to rezone 0.89 acre, located on State Road 855/Cascade Mill Road, in the Tunstall Election District from A-1, Agricultural District to R-1, Residential Suburban Subdivision District to combine with the adjacent parcel of land zoned R-1. Mrs. Hayes also stated once the property is rezoned to R-1, all uses listed under Section 35-222 are permitted. Mr. Roger Chriscoe was present to represent the petition. He stated the parcel was surveyed, the house on the adjacent parcel was too close to the property lines, and the septic system of the adjacent parcel was located on his property. He then stated this rezoning would give the adjacent parcel owner her back yard and would straighten out his property. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:07 p.m. A motion was made by Dr. Miller, seconded by Mr. Dudley, to recommend the Board of Supervisors grant the rezoning request. Motion passed by a 7 to 0 vote (one (1) member, Mr. Stowe, was absent). This concludes the Rezoning cases. Case S-18 -009, Lumpkin Farms, LLC – Mr. Motley opened the public hearing at 7:09 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Lumpkin Farms, LLC, had petitioned for a Special Use Permit on 69.00 acres, located on State Road 626/Smith Mountain Road, in the Callands-Gretna Election District for a campground. Mrs. Hayes then stated the Special Use Permit would be for only 10.00 acres. Mr. Wayne Lumpkin and Mr. Christopher Cooper with Gilbert, Bird, Sharpes & Robinson, Attorneys, were present to represent the petition. Mr. Cooper then requested that Mr. Lumpkin’s application for a Special Use Permit be withdrawn without penalty. Mr. Motley closed the public hearing at 7:11 p.m. A motion was made by Mrs. Mease, seconded by Mr. Haymore, that the application be withdrawn without penalty . Motion passed by a 7 to 0 vote (one (1) member, Mr. Stowe, was absent). This concludes the special Use Permit case. Case Z-18-003, Blairs Fire & Rescue, Inc. – Mr. Motley opened the public hearing at 7:11 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Blairs Fire & Rescue, Inc., had petitioned for a Sign Permit on 12.21 acres, located on U.S. Highway 29 North, in the Banister Election District for an on-site, 3 ½’ x 5’ (17.5 square feet) heliport donor sign. Mrs. Hayes then stated Mr. Dean Fowler, Chief of Blairs Fire & Rescue, Inc., was unable to attend the meeting due to a meeting conflict. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:12 p.m. A motion was made by Dr. Miller, seconded by Mr. Horne, to recommend the Board of Zoning Appeals grant the Sign Permit request. Motion passed by a 7 to 0 Planning Commission September 4, 2018 Page 3 vote (one (1) member, Mr. Stowe, was absent). This concludes the Sign Permit case. OLD BUSINESS There was no old business. NEW BUSINESS Mrs. Hayes reported on the cases for the October, 2018, cycle, which include four (4) rezoning cases; two (2) in the Dan River Election District, one (1) in the Callands-Gretna Election District, and one (1) in the Banister Election District.
